font-size:12px"><span style="color:#000000"><span style="line-height:115%"><strong>Antecedentes</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%"><span style="color:#000000"><strong>1</strong></span><strong>.</strong> Mediante Resolución de la Gerencia del Instituto Mallorquín de Asuntos Sociales (en adelante, IMAS) de 30 de diciembre de 2024 (Nº 27632), rectificada por la Resolución de 23 de enero de 2025 y publicada en el BOIB núm. 18, de 8 de febrero de 2025 (SEGRA 711420), se concedieron y denegaron las ayudas económicas individuales a las personas beneficiarias y solicitantes, respectivamente, de la convocatoria pública de ayudas económicas individuales para personas con discapacidades del Instituto Mallorquín de Asuntos Sociales para el año 2024 (BOIB núm. 67 de 21 de mayo).&nbsp;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%"><span style="color:#000000"><strong>2. </strong>En fecha </span> 24 de abril de 2025 el responsable del Área de personas con discapacidad informa de que se han detectado errores materiales en el punto<strong> SEXTO</strong> del <strong>RESUELVO </strong>de la referida Resolución, dado que se han anotado unos DNIs erróneos en dos personas endosatarias.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%"><strong><span style="background-color:#ffffff">Consideraciones jurídicas</span></strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%">&nbsp;<span style="color:#000000"><strong>1. </strong>El artículo 109.2 de la Ley 39/20215, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, determina que "Las administraciones públicas pueden rectificar, asimismo, en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos."</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%"><span style="color:#000000"><strong>2.</strong> La Resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales de 17 de mayo de 2024, que aprobó la convocatoria pública de ayudas económicas individuales para personas con discapacidades del Instituto Mallorquín de Asuntos Sociales para el año 2024, cuyo extracto fue publicado en el BOIB núm. 67 de 21 de mayo. </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%"><span style="color:#000000"><strong>3.</strong> La Resolución de la Gerencia del Instituto Mallorquín de Asuntos Sociales (en adelante, IMAS) de 30 de diciembre de 2024 (Nº 27632) rectificada por la Resolución </span>de 23 de enero de 2025 y publicada en el BOIB núm. 18, de 8 de febrero de 2025 (SEGRA 711420) por la que<span style="color:#000000"> se concedieron y denegaron las ayudas económicas individuales a las personas beneficiarias y solicitantes, respectivamente, de la convocatoria pública de ayudas económicas individuales para personas con discapacidades del Instituto Mallorquín de Asuntos Sociales para el año 2024 (BOIB núm. 67 de 21 de mayo).&nbsp;</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000"><strong><span style="background-color:#ffffff">4. </span></strong><span style="background-color:#ffffff">Los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 67, de 18 de mayo de 2019).&nbsp;&nbsp;&nbsp; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><strong>3. </strong>Notificar a las personas afectadas la resolución rectificada y ordenar la tramitación de los expedientes de reconocimiento y reintegro que correspondan.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>4. </strong>DAR TRASLADO de esta resolución a la Dirección Insular de Personas con Discapacidad, al Servicio de Gestión Económica y a la Intervención Delegada del IMAS.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000">Contra esta resolución, que no pone fin a la vía administrativa, podrá interponerse un recurso de alzada en el plazo de un mes, a contar a partir del día siguiente a la publicación en el BOIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%">El recurso puede interponerse formalmente ante la Gerencia del IMAS o ante el Consejo Ejecutivo que es el órgano competente para resolverlo. Contra la desestimación expresa del recurso de alzada podrá interponerse el recurso contencioso administrativo, ante el Juzgado de lo Contencioso Administrativo de Palma que corresponda, en el plazo de dos meses, contados a partir del día siguiente al de la recepción de la notificación de la desestimación del citado recurso de alzada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:115%">Una vez transcurridoS tres meses desde la interposición del recurso sin que se haya notificado la resolución, podrá interponerse recurso contencioso administrativo, contra la desestimación presunta del recurso de alzada, ante el Juzgado de lo contencioso Administrativo de Palma que corresponda, sin limitación temporal, mientras no haya resolución expresa. No obstante lo anterior, puede ejercitarse, en su caso, cualquier otro recurso que se estime pertinente.
