&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mediante el Decreto 99/2008, de 26 de septiembre, se creó la escuela infantil de primer ciclo Verge de la Salut, de Palma, con el código de centro 07013671.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Mediante la Orden de la consejera de Educación y Cultura, de 7 de octubre de&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2008, se dispuso la puesta en funcionamiento de la escuela infantil pública de primer ciclo EEI Verge de la Salut de Palma, para el curso 2008-2009. Como consecuencia de esta puesta en funcionamiento, el centro quedó configurado de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4 unidades de educación infantil de primer ciclo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En la Resolución del consejero de Educación y Universidad de 29 de diciembre de 2016 se reconoció a efectos administrativos, la autonomía de gestión de la Escuela Infantil Magdalena Humbert, de Maó y de la escuela infantil Verge de la Salut, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Mediante la Orden de 30 de junio de 1971 se creó la escuela graduada mixta “Casa de la Maternidad” ubicada en la calle General Riera sin número con 4 unidades escolares y dirección con curso (dos unidades de niños y dos unidades de niñas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Mediante la Orden de 11 de diciembre de 1978, se autorizó el cambio de denominación del Colegio Nacional “Casa de la Maternidad” por Miguel Costa y Llobera y se modificó su configuración con 16 unidades escolares mixtas de educación general básica y dirección con función docente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Mediante la Orden de 28 de junio de 1992 se implantó de forma gradual el segundo ciclo de educación infantil en distintos centros públicos de las Illes Balears, entre ellos en el CEIP Miquel Costa i Llobera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Actualmente, el CEIP Miquel Costa i Llobera está configurado de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6 unidades de educación infantil de 2º ciclo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12 unidades de educación primaria&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El 10 de abril de 2025, la directora general de Primera Infancia, Atención a la Diversidad y Mejora Educativa comunicó a la dirección general de Planificación y Gestión Educativas la necesidad del traslado temporal del EI Verge de la Salut a las instalaciones del CEIP Miquel Costa i Llobera, ambos de titularidad de la Consejería de Educación y Universidades, como consecuencia del inicio de las obras de reforma del edificio donde se ubica la escuela de primer ciclo de educación infantil EI Verge de la Salut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para llevar a cabo este traslado, los alumnos del centro se desplazarán, temporalmente, a un aula mixta de 1 a 3 años del CEIP Miquel Costa i Llobera situado en el municipio de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Del mismo modo, se desplazará también, al mismo CEIP, el personal del centro que figura a continuación: un cocinero de primera, un ayudante de cocina, el personal de servicios, auxiliar técnico educativo, una técnica de educación infantil y dos maestras que ocupan los cargos de directora y secretaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. El 29 de abril de 2025, la jefa de Departamento de Planificación y Centros emitió informe favorable del traslado temporal de la escuela infantil de primer ciclo EI Verge de la Salut a las instalaciones del CEIP Miquel Costa i Llobera, ambos del municipio de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. El 6 de mayo de 2025, la directora general de Planificación y Gestión Educativas emitió una propuesta de resolución por la que se propone autorizar el traslado temporal de la escuela infantil de primer ciclo EI Verge de la Salut a las instalaciones del CEIP Miquel Costa i Llobera, ambos del municipio de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Estatuto de autonomía de las Islas Baleares, aprobado por la Ley orgánica 1/2007, de 28 de febrero (BOE núm. 52, de 1 de marzo), el cual establece, en el artículo 36.2, que, en materia de enseñanza, corresponde a la Comunidad Autónoma de las Islas Baleares la competencia de desarrollo legislativo, de competencia modalidades y especialidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Ley orgánica 8/1985, de 3 de julio, reguladora del derecho a la educación (BOE núm. 159, de 4 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Ley orgánica 3/2020, de 29 de diciembre, por la que se modifica la Ley orgánica 2/2006, de 3 de mayo, de educación (BOE núm. 340 de 30 de diciembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 44, de 3 de abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Ley 1/2022, de 8 de marzo, de educación de las Illes Balears, que establece en el artículo 102 de Creación de centros, que la creación, la supresión y la transformación de centros públicos corresponde al Gobierno de las Illes Balears, que debe establecer los tipos de enseñanzas que se desarrollarán (BOIB núm. 38, de 17 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Decreto 23/2020 de 31 de julio, por el que se aprueba el Texto consolidado del Decreto por el que se establecen los requisitos mínimos de los centros de primer ciclo de educación infantil (BOIB núm. 135, de 1 de agosto).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears (&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, y de acuerdo con la propuesta formulada por la Dirección General de Planificación y Gestión Educativas con fecha 6 de mayo de 2025, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Autorizar, con efectos del inicio de curso 2025-2026, el traslado temporal del alumnado y el personal de la escuela infantil de primer ciclo EI Verge de la Salut a las instalaciones habilitadas del CEIP Miquel Costa i Llobera, ambos del municipio de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Establecer que el alumnado desplazado temporalmente se ubicará en un aula mixta de 1 a 3 años del CEIP Miquel Costa i Llobera, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Determinar que, como consecuencia de estas modificaciones, el centro queda configurado temporalmente de la siguiente forma:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Inscribir esta autorización en el registro estatal de centros docentes no universitarios del Ministerio de Educación, Formación Profesional y Deportes (RCD) y en el registro de centros de la Dirección General de Planificación y Gestión Educativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Comunicar esta Resolución al titular del centro, al Instituto para la Educación de la Primera Infancia de la Dirección General de Primera Infancia, Atención a la Diversidad y Mejora Educativa y al Departamento de Inspección Educativa (DIE) para su conocimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Educación y Universidades en el plazo de un mes a contar desde el día siguiente al que se publique en el BOIB, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses a contar desde el día siguiente de la publicación en el BOIB, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
