    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 30 de abril de 2025, la jefa de servicio de Administración y Gestión Presupuestaria ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 8 de abril de 2025 se publicó en el BOIB n.º 43 la Resolución de la directora de IBDONA de 4 de abril de 2025 por la que se aprobaba la convocatoria de subvenciones para proyectos de fomento y apoyo a la igualdad de oportunidades entre mujeres y hombres, y de prevención y erradicación de las violencias machistas para el año 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El apartado segundo de la base decimotercera de esta resolución dispone el siguiente: “El plazo de presentación de solicitudes es de veinte días naturales contadores a partir del día siguiente a la publicación de estas bases en el Boletín Oficial de las Islas Baleares”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El día 28 de abril de 2025 se produjo un apagón eléctrico que afectó a todo el territorio peninsular español. Consiguientemente la pasarela de cl@ve del estado y los certificados de la FNMT dejaron de funcionar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Ley 5/2000, de 20 de abril, del Instituto Balear de la Mujer, creó este Instituto como entidad autónoma de carácter administrativo con personalidad jurídica propia y capacidad plena de actuar, que tiene como finalidades básicas elaborar y ejecutar las medidas necesarias para hacer efectivos los principios de igualdad del hombre y la mujer, además de impulsar y promover la participación de la mujer en todos los ámbitos de la sociedad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Decreto 8/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el cual se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, el Instituto Balear de la Mujer queda adscrito a la Consejería de Familias y Asuntos Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El artículo 32 de la Ley 39/2015 de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, dispone que: “La Administración, excepto precepto en contrario, podrá conceder de oficio o a petición de los interesados una ampliación de los plazos establecidos que no se exceda de la mitad, si las circunstancias lo aconsejan y no se perjudican derechos de terceros”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Texto refundido de la Ley de Subvenciones, aprobada por Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El artículo 25.2 de la Orden de la consejera de Asuntos Sociales, Promoción e Inmigración de 18 de mayo de 2009 por la cual se establecen las bases reguladoras de las subvenciones, los certámenes y los premios en materia de políticas de igualdad hacia las mujeres, dispone que: “En todo caso, las modificaciones de los plazos establecidos en la convocatoria se tienen que regir por el que disponen los artículos 49 y 50 de la Ley 30/1992”. La disposición final cuarta de la Ley 39/2015 de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas prevé que las referencias hechas a la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, se entenderán hechas a la Ley del Procedimiento Administrativo Común de las Administraciones Públicas o a la Ley de Régimen Jurídico del Sector Público, según corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El día 28 de abril de 2025 los interesados en presentar las solicitudes de subvenciones para proyectos de fomento y apoyo a la igualdad de oportunidades entre mujeres y hombres, y de prevención y erradicación de las violencias machistas para el año 2025, no pudieron realizar el trámite telemático correspondiente a causa del apagón eléctrico producido en todo el territorio peninsular español y a la consiguiente caída del sistema pasarela de cl@ve del estado y los certificados de la FNMT. Con el fin de no causar un perjuicio a los posibles interesados en solicitar la subvención mencionada es necesario ampliar el plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, de conformidad con el artículo 16 del Texto Refundido de la Ley de subvenciones, aprobado mediante el Decreto Legislativo 2/2005, de 28 de diciembre (BOIB n.º 196, de 31 de diciembre), y el artículo 25.2 de la Orden de bases anteriormente mencionada, propongo a la Directora del Instituto Balear de la Mujer que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Propuesta de Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ampliar el plazo de presentación de solicitudes que establece la Resolución de la directora de IBDONA de 4 de abril de 2025 ( BOIB n.º 43, de 8 de abril de 2025), por la cual se aprueba la convocatoria de subvenciones para proyectos de fomento y apoyo a la igualdad de oportunidades entre mujeres y hombres, y de prevención y erradicación de las violencias machistas para el año 2025 en cinco días naturales a contar desde el día siguiente a vla publicación de esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo esto dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Publicar esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la directora del Instituto Balear de la Mujer o la consejera de Familias y Asuntos Sociales en el plazo de un mes a contar desde el día siguiente que se haya publicado en el Boletín Oficial de las Islas Baleares, de acuerdo con el que disponen el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares (BOIB n.º 44, de 3 de abril), y el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común (BOE n.º 236, de 2 de octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se puede interponer directamente un recurso contencioso- administrativo ante el Juzgado de lo contencioso-administrativo, en el plazo de dos meses a contar desde el día siguiente a haberse publicado en el Boletín Oficial de las Islas Baleares, de acuerdo con el que establece el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa (BOE n.º 167, de 14 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
