font-size:12px">Resolución del consejero de Hacienda y Función Pública que aprueba la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema excepcional de concurso oposición para el nombramiento como funcionario de carrera de las categorías arquitecto-a del Ayuntamiento de Algaida (EFOEA1/034), TAE arquitecto-a del Ayuntamiento de Andratx (EFOEA1/051), técnico-a de deportes del Ayuntamiento de Artá (EFOEA1/066), arquitecto-a del Ayuntamiento de Capdepera (EFOEA1/139), ingeniero-a industrial del Ayuntamiento de Manacor (EFOEA1/282), arquitecto-a del Ayuntamiento de Pollença (EFOEA1/308) y arquitecto-a del Ayuntamiento de Puigpunyent (EFOEA1/346) del subgrupo A1 de la administración especial y de asignación de puestos de trabajo para su nombramiento como funcionarios de carrera</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública, por delegación del Consejo Ejecutivo, según el acuerdo de 28 de septiembre de 2022, BOIB nº. 128, de 1 de octubre de 2022, de conformidad con lo que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;Por Resolución del consejero ejecutivo de Hacienda y Función Pública, de 2 de diciembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023, de fecha 7 de febrero de 2023 y de fecha 13 de febrero de 2023 (BOIB nº. 13, de 28 de enero de 2023; BOIB nº. 19; de 11 de febrero de 2023 y BOIB nº. 21, de 16 de febrero de 2023, respectivamente) se aprobó la convocatoria del proceso selectivo de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de las escalas, subescalas, clases y categorías (o especialidades) de administración general y especial de los subgrupos A1, A2, C1, C2 y del grupo AP derivada de la oferta de empleo pública de los Ayuntamientos Algaida, Andratx, Artá, Capdepera, Manacor, Pollença y Puigpunyent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.En esta resolución se convocaron, 1 plaza de la categoría arquitecto-a del Ayuntamiento de Algaida (EFOEA1/034), 2 plazas TAE arquitecto-a del Ayuntamiento de Andratx (EFOEA1/051), 1 plaza de técnico-a de deportes del Ayuntamiento de Artá &nbsp;(EFOEA1/066), 1 plaza de arquitecto-a del Ayuntamiento de Capdepera (EFOEA1/139), 1 plaza de ingeniero-a industrial del Ayuntamiento de Manacor (EFOEA1/282), 1 plaza de arquitecto-a del Ayuntamiento de Pollença (EFOEA1/308) y 1 plaza de arquitecto-a del Ayuntamiento de Puigpunyent (EFOEA1/346).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;Por Acuerdo del tribunal calificador competente de este proceso selectivo de estabilización, una vez concluida la revisión y baremación de los méritos de los aspirantes, en fecha 27 de marzo de 2025 se publicó, en el tablón electrónico de anuncios y en la sede electrónica del Consejo Insular de Mallorca, la lista definitiva de puntuaciones obtenidas por las personas aspirantes, con aplicación de los criterios de desempate y la resolución de las alegaciones formuladas a la lista provisional de puntuaciones, así como el listado de puestos correspondientes a las plazas convocadas, dando un plazo de cuatro días hábiles por comunicar el orden de preferencia de los puestos ofrecidos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;En fecha 22 de abril de 2025 el tribunal calificador competente del procedimiento selectivo ha acordado elevar al consejero de Hacienda y Función Pública el Acuerdo de la propuesta de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema excepcional de concurso oposición para el ingreso como funcionario de carrera en la categoría de arquitecto-a del Ayuntamiento de Algaida, de TAE arquitecto-a del Ayuntamiento de Andratx, de técnico-a de deportes del Ayuntamiento de Artá, de arquitecto-a del Ayuntamiento de Capdepera, de ingeniero-a industrial del Ayuntamiento de Manacor, de arquitecto-a del Ayuntamiento de Pollença y de arquitecto-a del Ayuntamiento de Puigpunyent y de asignación de puestos de trabajo, para su nombramiento como funcionario de carrera, de acuerdo con el trámite de manifestación de orden de preferencia efectuado, para su nombramiento como funcionario de carrera, la cual contiene tantas personas aprobadas como el número de plazas convocadas. La Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB nº. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 8 de febrero de 2023 (BOIB nº. 13, de 28 de enero de 2023 y BOIB nº. 19, de fecha 11 de febrero de 2023), por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 13 de febrero de 2023 (BOIB nº. 21, de 16 de febrero de 2023) se aprobó la convocatoria del proceso selectivo de estabilización por el sistema excepcional de concurso de oposición para el ingreso como funcionario del subgrupo A1 de la Administración especial de los Ayuntamientos de Algaida, Andratx, Artá, Capdepera, Manacor, Pollença y Puigpunyent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.&nbsp;&nbsp;APROBAR</strong> la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema excepcional de concurso oposición para el ingreso como funcionario de carrera derivado de la oferta de empleo pública extraordinaria de arquitecto-a del Ayuntamiento de Algaida (EFOEA1/034), de TAE arquitecto-a del Ayuntamiento de Andratx (EFOEA1/051), de técnico-a de deportes del Ayuntamiento de Artá (EFOEA1/066), de arquitecto-a del Ayuntamiento de Capdepera (EFOEA1/139), de ingeniero-a industrial del Ayuntamiento de Manacor (EFOEA1/282), de arquitecto-a del Ayuntamiento de Pollença (EFOEA1/308) y de arquitecto-a del Ayuntamiento de Puigpunyent (EFOEA1/346) del subgrupo A1 especial, de acuerdo con lo que se indica en el Anexo 1 de este documento.&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta lista contiene, como máximo, tantas personas aprobadas como el número de plazas convocadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.&nbsp;ADJUDICAR</strong> el lugar de trabajo correspondiente a la categoría de arquitecto-a del Ayuntamiento de Algaida (EFOEA1/034), de TAE arquitecto-a del Ayuntamiento de Andratx (EFOEA1/051), de técnico-a de deportes del Ayuntamiento de Artá (EFOEA1/066), de arquitecto-a del Ayuntamiento de Capdepera (EFOEA1/139), de ingeniero-a industrial del Ayuntamiento de Manacor (EFOEA1/282), de arquitecto-a del Ayuntamiento de Pollença (EFOEA1/308) y de arquitecto-a del Ayuntamiento de Puigpunyent (EFOEA1/346) del subgrupo A1 especial, a las personas aspirantes que han superado el procedimiento selectivo de estabilización por el sistema excepcional de concurso oposición para la convocatoria de estas plazas, de conformidad con la base 8.8 de la convocatoria y de acuerdo con el trámite de manifestación de orden de preferencias efectuado y la puntuación obtenida en el proceso selectivo. En caso de que no se haya efectuado este trámite por parte de las personas aspirantes, el puesto de trabajo será asignado de oficio. Esta información se recoge en el Anexo 1 de este documento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. INFORMAR</strong> que la adjudicación y adscripción definitiva del lugar de trabajo a las personas aspirantes mencionadas queda acondicionada a la acreditación de estar en posesión de todos los requisitos específicos para la adscripción al puesto de trabajo, en que tendrá que ser requerida por cada ayuntamiento. En caso de no acreditarlos la adscripción del puesto de trabajo sería con carácter provisional.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad en la base específica 14.4 del Anexo II de la convocatoria, de acuerdo con el artículo 22.1 del Decreto ley 6/2022 los lugares de prefecturas orgánicas y lugares singularizados se tienen que adjudicar en adscripción provisional.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.&nbsp;ORDENAR</strong> la publicación de esta Resolución y su Anexo en el tablón de edictos y en la Sede electrónica del Consejo Insular de Mallorca, y en el Boletín Oficial de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra este acto, que no pone fin a la vía administrativa, podéis interponer recurso de alzada en el plazo de un mes, contador a partir del día siguiente de recibir esta notificación. El recurso se puede interponer formalmente ante el Consejo ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimación expresa de este recurso de alzada, podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente de recibir la notificación de la desestimación del recurso de alzada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si han transcurrido tres meses desde la interposición del recurso de alzada y no habéis recibido la notificación de resolución expresa, se entiende desestimado por silencio y podéis interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, contadores a partir del día siguiente de la desestimación presunta.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstante el anterior, podéis interponer, si procede, cualquier otro recurso que consideráis oportuno.
