    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 26 de marzo de 2024, por la cual se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt; de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;La jefe del servicio de Ayudas al Desarrollo Rural, con fecha 24 de abril de 2025, firmó el siguiente:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;2. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se modifica la Resolución del presidente del FOGAIBA de 26 de marzo de 2024, por la cual se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes. BOIB núm. 69 de 25 de mayo del 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;3. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes finalizó el día 31/05/2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;4. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;5. Con fecha 1 de abril de 2025 se notificó, mediante la publicación en el BOIB núm. 40, un trámite de audiencia en el que se concedió a las personas mencionadas en el Anexo I un plazo de 10 días hábiles para aportar la documentación que faltaba para el estudio de los expedientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;6. Los interesados del Anexo I no han aportado la documentación requerida, y se ha constatado que no cumplen el punto 6 del apartado Tercero de la convocatoria, estar al corriente de las obligaciones tributarias con la AEAT, con la ATIB y/o con la Seguridad Social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;8. Corresponde proponer para denegar los expedientes señalados en el Anexo I por los motivos indicados en el citado anexo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;Propuesta provisional de resolución de denegación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;Por todo esto, se informa favorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;1. Denegar las ayudas solicitadas por los interesados que figuran al Anexo I , que son un total de 3 expedientes y que empieza con UNNA ZOE ASTAR HUIJSMAN y acaba con THOMAS FLOHR, relativa a la línea de ayudas “Inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes”, por no cumplir lo indicado en el apartado Tercero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="display:inline-block"&gt;2. Comunicar esta propuesta provisional a los interesados, haciéndoles patente que disponen de un plazo máximo de 10 días hábiles, contadores desde la publicación en el BOIB de esta propuesta, para presentar alegaciones. En el caso de no hacer uso de su derecho para alegar, en el plazo indicado, o si manifiesta su decisión de no efectuar alegaciones ni aportar nuevos documentos o justificaciones, esta propuesta tendrá carácter definitivo, y se elevará al vicepresidente del FOGAIBA para que dicte la Resolución de denegación de la ayuda solicitada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
