    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Gobierno de les Illes Balears quiere dinamizar el comercio local, especialmente el desarrollado por autónomos, microempresas y pequeñas empresas del sector comercial al por menor. En esta línea se establece este programa, con el objetivo de estimular el sector comercial de la comunidad autónoma de les Illes Balears. El programa desarrolla una medida de incentivo y estímulo para la comunidad autónoma mediante bonos de descuento financiados por el Gobierno de les Illes Balears a disposición de la ciudadanía, que se distribuirán con el criterio básico del reparto proporcional entre el número de establecimientos comerciales adheridos al programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones comprendidas en esta convocatoria están incluidas dentro del Plan Estratégico de Subvenciones de la Comunidad Autónoma de les Illes Balears para los ejercicios 2024-2026, aprobado por el Acuerdo del Consejo de Gobierno de 19 de abril de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las convocatorias de subvenciones previstas en el Plan Estratégico de Subvenciones de la Comunidad Autónoma de les Illes Balears adquieren, en este momento, el carácter de indispensables para la protección del interés general, puesto que son necesarias para facilitar la actividad empresarial en les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Plan Estratégico de Subvenciones recoge, entre las líneas de actuación, el fomento de un escenario más competitivo y profesional para el desarrollo del comercio. En concreto, entre otras actuaciones, en el objetivo I, línea 2.2, figura la promoción del tejido comercial, planes de mejora competitiva, planes de marketing y diseño, y actuaciones de mejora de la competitividad y el fomento del tejido comercial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para conseguir los objetivos enumerados en los párrafos anteriores, el Gobierno de les Illes Balears quiere apoyar e impulsar la actividad económica comercial de nuestras islas mediante una serie de actuaciones y medidas para mantener el pulso de la economía balear, y su adaptación a criterios de competitividad, todo ello en el ámbito territorial de les Illes Balears, dado que estos establecimientos son los agentes esenciales en la dinamización comercial de los municipios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 30.42 del Estatuto de Autonomía de les Illes Balears, de acuerdo con la redacción hecha por la Ley Orgánica 1/2007, de 28 de febrero, de reforma del Estatuto, atribuye a esta Comunidad Autónoma la competencia exclusiva en materia de comercio interior, sin perjuicio de lo dispuesto en los artículos 38 y 131 y los números 11 y 13 del apartado 1 del artículo 149 de la Constitución. Esta competencia incluye la ordenación de la actividad comercial; la regulación de los calendarios y horarios comerciales en cuanto al principio de unidad de mercado; las modalidades de venta, sin perjuicio de la legislación mercantil; las condiciones para ejercer la actividad comercial y el establecimiento de las normas de calidad en materia de comercio; la promoción de la competencia en el ámbito autonómico, sin perjuicio de la legislación estatal y europea, y el establecimiento y la regulación de los órganos de defensa de la competencia de la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otro lado, el Reglamento (UE) n.º 2023/2831 de la Comisión, de 13 de diciembre de 2023, relativo a la aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea a las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Diario Oficial de la Unión Europea&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de 15 de diciembre, DOUE-L-2023-2831), establece las condiciones que deben tenerse en consideración a la hora de conceder según qué tipos de ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En virtud de lo establecido en el capítulo III (artículo 26 y siguientes) del Texto refundido de la Ley de Subvenciones de la Comunidad Autónoma de les Illes Balears, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, las bases reguladoras de las subvenciones pueden establecer que la entrega de los fondos públicos a los beneficiarios o la realización de otras funciones de gestión de las subvenciones se lleven a cabo mediante entidades colaboradoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Orden de la consejera de Comercio, Industria y Energía de 8 de abril de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de comercio y servicios (BOIB n.º 52, de 17 de abril) fija las bases para esta convocatoria de ayudas, todo ello de acuerdo con el Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 13 de la mencionada Orden recoge también que las convocatorias pueden prever la colaboración de las entidades que, a estos efectos, señala el artículo 26.2 del Texto refundido de la Ley de Subvenciones, en cuanto a la entrega de los fondos públicos a las personas o entidades beneficiarias de las subvenciones o a la realización de otras funciones de gestión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 2.3 del Decreto 12/2023, de 10 de julio, de la presidenta de les Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, atribuye a la Dirección General de Empresa, Autónomos y Comercio el fomento en materia de comercio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En esta convocatoria se aplican las medidas de simplificación establecidas en el Decreto 6/2013, de 8 de febrero, de medidas de simplificación documental, y en la Ley 2/2012, de 4 de abril, de apoyo a emprendedores, emprendedoras y a la microempresa, pequeña y mediana empresa, en cuanto a la simplificación administrativa a emprendedores y a empresas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 15 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, y con el artículo 5 de la Orden de la consejera de Comercio, Industria y Energía de 8 de abril de 2008, corresponde aprobar la convocatoria de estas ayudas mediante una resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar la convocatoria del programa de estímulo del sector comercial de la comunidad autónoma de les Illes Balears «Baleares bonos de comercio».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aprobar las bases de esta convocatoria pública de subvenciones por la que se regula el programa de estímulo del sector comercial de la comunidad autónoma de les Illes Balears «Baleares bonos de comercio», la relación de los sectores de actividad susceptibles de adhesión a las campañas y el modelo de solicitud de adhesión al programa, que se adjuntan, respectivamente, como anexos 1, 2 y 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes a contar desde el día siguiente de su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y con el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de estas bases es regular el programa de fomento del comercio detallista en la comunidad autónoma de les Illes Balears «Baleares bonos de comercio», desarrollado por autónomos, microempresas y pequeñas empresas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El programa, que se llevará a cabo en una campaña, desde el 26 de mayo hasta el 30 de junio de 2025, tiene los siguientes objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Propiciar el fortalecimiento de los autónomos, de las microempresas y de las pequeñas empresas del sector comercial detallista.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Favorecer tanto a la ciudadanía como al tejido empresarial sobre el que reposa el sector comercial y estimular la demanda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Dinamizar la actividad comercial y promover la repercusión en el ámbito local y comarcal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Beneficiarios y requisitos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Pueden ser beneficiarias de estas ayudas las personas físicas y jurídicas privadas, las agrupaciones de personas físicas o jurídicas privadas y las comunidades de bienes o cualquier otro tipo de unidad económica o patrimonio separado que, aunque no tengan personalidad jurídica, puedan llevar a cabo las acciones que se pretenden fomentar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los beneficiarios tienen que ser titulares de microempresas o de pequeñas empresas del sector del comercio detallista o de determinadas empresas de servicios, y tienen que cumplir los requisitos establecidos en el artículo 4 de la Orden de la consejera de Comercio, Industria y Energía de 8 de abril de 2008. Dentro de la categoría de pyme se considera pequeña empresa la que tenga, en el ejercicio anterior a la presentación de la solicitud de subvención, menos de 50 trabajadores y un volumen de negocio anual o un balance general que no supere los diez millones de euros, y se considera microempresa la que tenga menos de diez trabajadores y un volumen de negocio o un balance general que no supere los dos millones de euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo caso, tienen que cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Tienen que ejercer, en el momento de la publicación de la convocatoria de la subvención, alguna de las actividades incluidas en los epígrafes del impuesto sobre actividades económicas —IAE— (impuesto regulado por los reales decretos legislativos 1175/1990, de 28 de septiembre, y 1259/1991, de 2 de agosto), que se detallan en el anexo 2 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Tienen que ser establecimientos comerciales con sede o razón social ubicada en la comunidad autónoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Tienen que estar al corriente de las obligaciones con la Seguridad Social y de las obligaciones tributarias con el Estado y con la Comunidad Autónoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Sin perjuicio de cualesquiera otras formalidades que puedan estar obligadas a cumplir, la Consejería de Empresa, Empleo y Energía puede solicitar en cualquier momento el documento acreditativo del cumplimiento de estos requisitos mínimos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Así mismo, se entienden como beneficiarias indirectas las personas físicas, que tengan dieciséis años o más, que accedan a los bonos, según los medios y las vías establecidos en esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Entidad colaboradora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La distribución de los fondos subvencionables mediante el canje de los bonos y la comprobación del cumplimiento de las condiciones y los requisitos de cada operación de venta se llevará a cabo con la colaboración de la Cámara Oficial de Comercio, Industria, Servicios y Navegación de Mallorca, que tiene la condición de entidad colaboradora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La colaboración de esta entidad para el desarrollo del programa se establece mediante un convenio de colaboración, que se rige por las normas contenidas en el Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones de la Comunidad Autónoma de las Illes Balears, y en la Ley 38/2003, de 17 de noviembre, General de Subvenciones. Se aplicará a las entidades el régimen jurídico previsto en estas leyes y en sus disposiciones de desarrollo, para las entidades colaboradoras en la gestión de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Actuaciones subvencionables y cuantía de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Se subvencionará la compra de bienes en los establecimientos comerciales detallistas adheridos a las campañas a través de un único tipo de bono de descuento disponible en los mismos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Cada uno de estos bonos tendrá la consideración de bono de descuento por un valor de quince euros sobre una compra mínima de treinta euros en los establecimientos adheridos. La aplicación de los bonos de descuento la realizarán los mismos establecimientos después de la identificación de las personas beneficiarias en el mismo momento de la adquisición de los bienes, por un valor mínimo de treinta euros. En este sentido, la entidad colaboradora tiene que habilitar los mecanismos necesarios para garantizar y comprobar lo indicado en este apartado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Durante la campaña, cada persona puede tener derecho a la aplicación de un máximo de cuatro bonos de descuento por un valor de sesenta euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estos bonos de descuento pueden utilizarlos cada persona beneficiaria en varios o en un único establecimiento, y en una sola compra en la que se puede aplicar un descuento de quince euros por cada treinta euros consumidos en esta compra, o se pueden aplicar en compras diferentes que tengan un valor mínimo de treinta euros. Las personas, en cuanto al derecho a que se aplique el bono o bonos de descuento por haber hecho una compra mínima de treinta euros, no pueden reservarse estos bonos para aplicarlos a compras posteriores, sino que cada bono de descuento al que se tiene derecho tiene que aplicarse en el mismo momento en que se hace la compra mínima de treinta euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que no se haga uso del bono de descuento en el momento en que se obtiene derecho a usarlo, la persona física (que no el establecimiento) perderá la posibilidad de utilizarlo, y para volver a generar este derecho la persona tendrá que volver a realizar una compra mínima de treinta euros en un establecimiento adherido al programa, siempre que no haya agotado el máximo de cuatro bonos por persona y por campaña.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estos bonos de descuento pueden aplicarse también a compras (siempre que sean compras mínimas de treinta euros) de productos que ya tengan aplicados otros descuentos por otras ofertas, promociones o descuentos en general que asuma el comerciante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Los comercios tienen que formalizar, en la plataforma web para gestionar y ejecutar el programa, el bono o los bonos con los datos de la persona física beneficiaria, que servirán para controlar el límite de cuatro bonos por persona, y tienen que adjuntar una copia del tique de la compra mínima de treinta euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Los comercios no pueden reservar ni retener bonos para sus clientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Las ventas bonificadas son las realizadas durante el periodo establecido para la campaña.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Las ayudas que se concedan en el marco de este programa tienen la consideración de subvenciones a fondo perdido no reintegrables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Importe económico de la convocatoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El importe económico de esta convocatoria es de 1.243.574,71 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las ayudas se tienen que conceder con càrrec a la partida presupuestaria 19301 761A01 47000 00 de los presupuestos de la Comunidad Autónoma de las Illes Balears para el ejercicio del año 2024, prorrogados de acuerdo con el artículo 47 de la Ley 14/2014 de Finanzas de la CAIB y la Orden 1/2025 del consejero de Economía, Hacienda e Innovación de 9 de enero de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Siempre y cuando las disponibilidades presupuestarias lo permitan, podrá aumentarse el importe de esta convocatoria. Esto supondrá un incremento de los bonos de descuento, que se distribuirán en iguales condiciones que rigen esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Órgano responsable de la gestión de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El órgano responsable de la tramitación de las ayudas es la Dirección General de Empresa, Autónomos y Comercio, adscrita a la Consejería de Empresa, Empleo y Energía, a la cual corresponde desarrollar las actuaciones de supervisión y control de la ejecución correcta del programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La realización de las tareas de gestión de este programa, así como la distribución de los fondos subvencionales, tiene que llevarse a cabo con la colaboración de la Cámara de Comercio de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La gestión de los fondos públicos asignados a este programa tiene que hacerse de acuerdo con los principios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Publicidad, transparencia, concurrencia, objetividad, igualdad y no discriminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Eficacia en el cumplimiento de los objetivos fijados por la administración otorgante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Eficiencia en la asignación y el uso de los recursos públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proceso de adhesión en el programa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. No se tendrán en cuenta ni se admitirán las solicitudes presentadas por entidades que no cumplan con los requisitos establecidos en el apartado 2 de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;2. Los comercios que quieran adherirse a este programa tendrán que formalizar el formulario de adhesión correspondiente y adjuntar la documentación prevista en esta convocatoria, que se encontrará disponible en la plataforma web habilitada a tal efecto: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;www.bonsillesbalears.com&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En cuanto a la campaña, el plazo para que los establecimientos comerciales puedan adherirse al programa será de quince días naturales a partir del día siguiente de la publicación de esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Para la campaña, la Cámara de Comercio de Mallorca, después de la verificación de la información y documentación aportadas, comunicará la admisión o el rechazo de la solicitud a los comercios que soliciten la adhesión al programa. En caso de rechazo habrá que especificar el motivo, que tendrá que ser a causa del incumplimiento de alguno de los términos previstos en esta Resolución o en la normativa reguladora de subvenciones, y, en su caso, el número de bonos de descuento asignados. En el caso de solicitudes con falta de documentación, o que no cumplan con alguno o algunos de los requisitos previstos o por algún otro defecto que sea subsanable, se les concederá un plazo de diez días naturales para subsanar la deficiencia o deficiencias que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Se facilitará la documentación necesaria y el material promocional del programa a los establecimientos adheridos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Distribución de los bonos de descuento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Para la campaña, el total de bonos de descuento emitidos se distribuirá por igual entre el número de establecimientos que se adhieran al programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El número total de bonos emitidos por el programa será de 82.904.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Así, el número de bonos correspondiente a cada establecimiento adherido tendrá un carácter lineal y estará establecido por la relación existente entre la cantidad de bonos emitidos y el número final de establecimientos adheridos al programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Consejería de Empresa, Empleo y Energía no se hará cargo del acceso a bonos en un número superior a los 82.904.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Dentro del mes siguiente a la formalización del convenio de colaboración entre la Consejería de Empresa, Empleo y Energía y la Cámara de Comercio de Mallorca para ejecutar el programa, se ordenará el pago del 100 % del importe de los fondos en que consisten las ayudas en la cuenta indicada por la Cámara de Comercio de Mallorca. Desde este momento, la Cámara se constituirá en depositaria de los fondos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Noveno&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sistema de funcionamiento y gestión para el canje de los bonos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La gestión del programa subvencional para la campaña se llevará a cabo a través de una plataforma tecnológica específica y de las aplicaciones informáticas técnicamente más idóneas para la puesta en marcha y la ejecución eficaz de la operativa de funcionamiento de los bonos de descuento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A través de esta plataforma se realizarán todos los trámites relacionados con la adhesión al programa subvencional, así como la formalización de toda la operativa de emisión, obtención, aplicación, canje, compensación y verificación aleatoria de los bonos de descuento en los términos especificados en esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Durante la campaña, los comercios adheridos dispondrán de un usuario y una contraseña personalizados para acceder a la plataforma, en la que tendrán disponibles los cupones de descuento que les hayan sido asignados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4, Cada cupón dispondrá de una numeración específica que lo hará único e irá asociado al comercio adherido concreto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El establecimiento adherido puede ofrecer a la clientela los cupones de descuento, siempre que estos cumplan con los requisitos establecidos en esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El comercio adherido tendrá acceso a la información relativa a los cupones utilizados y pendientes, en todo momento, durante la vigencia de la campaña.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Los establecimientos adheridos en el programa podrán hacer efectivos los bonos de descuento aplicados y podrán cobrarlos con carácter quincenal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El comercio tiene que formalizar en la plataforma cada uno de los bonos utilizados y adjuntar como documentación justificativa el número de DNI (en el caso de nacionales) o pasaporte (en el caso de extranjeros) de la persona compradora y el tique de compra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es responsabilidad de los establecimientos comerciales adheridos al programa verificar la identificación de las personas adquirentes para aplicar el descuento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Una vez verificado, a través de un muestreo, el cumplimiento de los requisitos, se llevará a cabo la liquidación y el pago del importe correspondiente a los comercios adheridos en la cuenta bancaria facilitada a tal fin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Décimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Obligaciones de los establecimientos adheridos al programa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Los establecimientos adheridos al programa, a través de la suscripción de la solicitud de adhesión, asumen las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Publicitar en el exterior del establecimiento la adhesión al programa mediante la recepción y la colocación de los materiales publicitarios correspondientes en un lugar visible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. No devolver a las personas compradoras dinero en metálico en ningún caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Posibilitar el ser contactados para verificar el funcionamiento del proceso y la campaña en general, y para dar su opinión. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Conservar, durante un plazo de cuatro años, todos los bonos y los tiques de compra o las facturas justificativas de la aplicación de los fondos percibidos, mientras puedan ser objeto de comprobación y control por parte de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Custodiar con diligencia las claves de acceso a la plataforma con el fin de evitar que puedan ser utilizadas indebidamente, y comprometerse a no facilitarlas a otras personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f. Verificar la identificación de las personas adquirentes para la aplicación del descuento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La ejecución del programa, por parte del comerciante adherido, con fines diferentes y fraudulentos de los establecidos en esta Resolución puede comportar la expulsión definitiva del programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Una vez transcurrido el 50 % de la ejecución del programa de canje de bonos, en el supuesto de que los comerciantes no hayan ejecutado al menos el 50 % de los bonos adjudicados, los bonos que no hayan sido efectivamente ejecutados respecto a estos comerciantes podrán distribuirse a partes iguales entre el resto de comerciantes que hayan llegado a ejecutar el 100 % de los bonos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Los comercios participantes en la campaña, voluntariamente y, hasta llegar a un máximo de 200, pueden adherirse a una plataforma digital de comunicación entre comercios y usuarios, que será gratuita por un periodo de un año. Podrán adherirse en el momento que soliciten la participación en la campaña de bonos, y este número máximo de 200 accesos a la plataforma mencionada se fijará por orden riguroso de registro de entrada de la solicitud de adhesión de los comercios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto de que no se llegue al máximo de 200 comercios, la Cámara de Comercio de Mallorca podrá aceptar nuevos comercios, desde la finalización de la adhesión de la campaña de bonos hasta el 20 de noviembre de 2025. Se habilitará un formulario específico de adhesión a tal efecto, y se mantendrá el criterio de admisión por orden de entrada hasta el máximo de los 200 comercios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta solución digital cuenta con dos aplicaciones móviles multiplataforma (conectadas a un entorno común y que permite diferentes niveles de comunicación entre consumidores y comercios): una para el público en general y otra para la gestión y control de los establecimientos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La aplicación móvil para los establecimientos permite gestionar lo siguiente: los establecimientos, el programa de fidelización, la tarjeta regalo comercio, la publicación de anuncios, las compras, el sistema de mensajería instantánea, así como el usuario multitienda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por su parte, la aplicación móvil para los consumidores permite: mostrar negocios en el mapa, la ficha de negocio, las valoraciones, el desglose del saldo, los favoritos, mensajes, anuncios, la identificación mediante QR, el historial de compras y el perfil del usuario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Undécimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Obligaciones de la entidad colaboradora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La entidad colaboradora se compromete a desarrollar las siguientes acciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Colaborar en la gestión de la campaña y ser vía de relación con los comercios participantes, para articular la adhesión y controlar el desarrollo adecuado de los compromisos adquiridos en virtud de esta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Colaborar en la creación y la edición de los materiales publicitarios, y llevar a cabo la publicidad activa de la campaña en los medios de comunicación propios. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Difundir el programa a través de su página web y otros medios posibles para llegar al mayor número de comercios que sean susceptibles de poder adherirse. Esta difusión también se llevará a cabo con la colaboración de las organizaciones empresariales que representan al sector del comercio de las Illes Balears y a los municipios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Distribuir el material identificativo e informativo del programa a los comercios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Informar a los comercios interesados y asistirles para que formalicen la adhesión a la campaña.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;f. Ser la depositaria y la distribuidora de los fondos, así como coordinar las operaciones de distribución de los bonos a las personas físicas beneficiarias y efectuar el canje de los bonos usados en las operaciones de compraventa bonificadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g. Facilitar a los comercios adheridos y a las personas consumidoras la información necesaria para que tengan un buen conocimiento de las condiciones de adquisición y disfrute de los bonos que tengan que emitirse, y la información sobre los comercios participantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h. Comprobar, mediante un muestreo, el cumplimiento de los requisitos de las compraventas bonificadas, documentadas en uno o varios bonos y en una factura o tique de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i. Abonar a los establecimientos comerciales adheridos al programa los importes correspondientes a los bonos de descuento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j. Llevar a cabo la correcta gestión y ejecución del programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;k. Informar de toda la gestión a través de los informes indicados en el punto 1.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;m)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la cláusula quinta del convenio de colaboración formalizado entre la entidad colaboradora y la Consejería de Empresa, Empleo y Energía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;l. Actualizar en su web la lista de comercios adheridos a la campaña.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;m. Comunicar a la Base general de datos de subvenciones y ayudas públicas de la Administración General del Estado la información requerida por esta, especialmente la referida a la relación de beneficiarios, de las concesiones realizadas, de los pagos efectuados y, si procede, de los reintegros y de las sanciones que puedan derivarse, de acuerdo con el programa. A tal efecto, la Consejería de Empresa, Empleo y Energía solicitará formalmente a la Intervención General el alta del usuario que incluya la Cámara de Comercio de Mallorca en el sistema de información estatal correspondiente con los permisos de edición necesarios. Esta alta del usuario de la Cámara estará en vigor, como máximo, hasta día 31 de mayo de 2026. La Cámara se compromete a no introducir ni modificar ninguna información más que la relacionada con esta convocatoria de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;n. Gestionar, durante un periodo de un año, la plataforma digital de comunicación entre comercios y usuarios, a la que pueden adherirse un máximo de 200 comercios participantes en la campaña. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Además de los compromisos y las obligaciones indicados en las cláusulas anteriores, la Cámara de Comercio de Mallorca asume las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Todas las obligaciones indicadas en el artículo 15 de la Ley General de Subvenciones, así como aceptar todas las comprobaciones que estime oportunas la Consejería de Empresa, Empleo y Energía en relación con el desarrollo y la ejecución de las actuaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Publicitar adecuadamente el carácter público de la financiación y el hecho que este va a cargo de la Consejería de Empresa, Empleo y Energía, con inclusión de los anagramas y logotipos de la imagen corporativa y de los específicos del programa, en la forma más idónea para cada formato. Tiene que difundir el programa e informar sobre el desarrollo a través del portal o página web respectivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En la ejecución de estas actuaciones habrá que observar los deberes de confidencialidad y sigilo en cuanto a los datos de negocio y de personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Queda absolutamente prohibida cualquier discriminación o trato desigual a los comercios, especialmente el basado en el hecho de ser o no establecimiento asociado y de la asociación a la que pertenezca el comercio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Duodécimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Vigencia del programa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Este programa, que se llevará a cabo en una campaña desde el 26 de mayo hasta el 30 de junio de 2025, iniciará su vigencia desde la publicación de esta Resolución y finalizará el 31 de diciembre de 2025 o hasta la liquidación final de las operaciones de reintegro y dación de cuentas que correspondan en aplicación de la legislación sobre subvenciones, de acuerdo con los siguientes plazos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. En cuanto a la campaña, el plazo para que los establecimientos comerciales puedan adherirse al programa será de quince días naturales a partir del día siguiente de la publicación de esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Las personas podrán conseguir la aplicación de los bonos de descuento en el mismo establecimiento para las compras hechas durante el periodo de vigencia de la campaña.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Después de la fecha de finalización de la campaña, los bonos de descuento perderán la validez como medio de descuento, excepto en el caso de prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En el supuesto que se produzca durante la campaña el agotamiento de los fondos públicos vinculados a este programa con anterioridad a la fecha señalada en el párrafo primero, la Consejería de Empresa, Empleo y Energía tendrá que publicitar esta circunstancia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Consejería de Empresa, Empleo y Energía podrá modificar las fechas de vigencia del programa si las circunstancias u otras razones organizativas así lo aconsejan. De todo ello, realizará la publicidad oportuna en la Sede Electrónica de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimotercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Inspección e incumplimientos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Consejería de Empresa, Empleo y Energía, como responsable del programa, se reserva el derecho de llevar a cabo las comprobaciones, las inspecciones y otras medidas de control que estime oportunas para velar por la aplicación correcta de los recursos públicos y para verificar el desarrollo y la aplicación correctas del programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de incumplimiento por parte de los establecimientos adheridos, la Consejería de Empresa, Empleo y Energía podrá cancelar la adhesión al programa y comunicar esta circunstancia a la entidad colaboradora, para mpedir el canje de bonos de descuento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los establecimientos adheridos están obligados a facilitar la información que requiera la Consejería de Empresa, Empleo y Energía, y las actuaciones de control financiero que lleven a cabo la Intervención General de la Comunidad Autónoma, la Sindicatura de Cuentas y otras autoridades de control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimocuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Compatibilidad con otras ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La subvención obtenida al amparo de esta convocatoria será compatible con cualquier otra subvención, ayuda, ingreso o recurso procedente otras administraciones públicas o entidades privadas, locales, nacionales o internacionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimoquinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Régimen&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas concedidas en el marco de esta convocatoria constituyen ayudas de estado sometidos a la norma de las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, por lo que se tiene que aplicar a los beneficiarios de esta convocatoria la norma de las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; que determina que el importe total de las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; a una única empresa no puede ser superior a 300.000 euros durante cualquier periodo de tres ejercicios fiscales —Reglamento (UE) n.º 2023/2831 de la Comisión, de 13 de diciembre de 2023, relativo a la aplicación de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea a las ayudas &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Diario Oficial de la Unión Europea&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de 15 de diciembre, DOUE-L-2023-2831).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimosexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Datos de carácter personal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El tratamiento de los datos personales tiene que llevarse a cabo según lo establecido en la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales, así como el Reglamento (UE) n.º 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en cuanto al tratamiento de datos personales y a la libre circulación de estos datos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La recogida de los datos personales se encomienda a la entidad colaboradora. La Consejería de Empresa, Empleo y Energía es la responsable del tratamiento, y los datos se tratarán con el fin de llevar a cabo la tramitación administrativa que se derive de la gestión de los bonos de descuento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para la entrega del material con la imagen corporativa del programa a los establecimientos adheridos, la información relativa al nombre comercial, la dirección postal del comercio detallista, el nombre de la persona representante y el teléfono móvil pueden ser comunicados a terceros colaboradores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas interesadas pueden solicitar, ante el responsable, acceder, rectificar y suprimir sus datos, así como ejercer otros derechos, a través de la Sede Electrónica de la Consejería de Empresa, Empleo y Energía, o presencialmente en los lugares y registros establecidos en la normativa reguladora del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimoséptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Normativa aplicable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La convocatoria se rige por lo dispuesto en esta Resolución y la Orden de la consejera de Comercio, Industria y Energía de 8 de abril de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de comercio y servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En todo lo que no establecen esta Resolución ni la Orden mencionada, tiene que aplicarse el Texto refundido de la Ley de Subvenciones de la Comunidad Autónoma de las Illes Balears, aprobado por el Decreto Legislativo 2/2005; las normas básicas de la Ley 38/2003; el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, y, en materia de procedimiento, la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6512&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
