    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La convocatoria de ayudas especifica que las comunicaciones y las notificaciones se realizaran a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé la ley 39/2015, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#212121; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 16 de abril de 2025, firmó la siguiente resolución,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Con fecha 30 de enero de 2024 se publicó, en el BOIB nº. 15, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 25 de enero de 2024, por la que se aprueba la convocatoria para el año 2024 de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas en las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. De conformidad con el apartado sexto de la resolución, y de la Resolución de modificación del presidente del FOGAIBA de 2 de julio de 2024 publicada en el BOIB 88 de 4 de julio, de determinadas ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC) para el año 2024, se modifica el plazo de presentación de solicitudes de determinadas intervenciones en el desarrollo rural. El nuevo plazo de presentación de solicitudes de las convocatorias finalizó el 15 de junio de 2024, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 1298 solicitudes de ayuda de limitaciones específicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Con fecha 3 de septiembre de 2024, mediante publicación en el BOIB núm. 115, se notificó al beneficiario Jaume Pou Vicens, entre otros, un requerimiento para la aportación del modelo 100 de 2023 para poder estudiar si la persona interesada cumplía con el requisito de agricutor no pluriactivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Con fecha 30 de septiembre y 14 de octubre de 2024 y núm. de registro GOIB629721/2024 y GOIBE555026/2024, el beneficiario Jaume Pou Vicens aportó el modelo requerido&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural llevaron a cabo el control administrativo de la documentación aportada y se comprobó que no cumplía con la condición de agricultor no pluriactivo, puesto que más del 50% de ingresos totales no eran agrarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. Con fecha 14 de noviembre de 2024 se publicó en el BOIB núm. 149, el informe y propuesta provisional de denegación a causa del motivo mencionado con anterioridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. Con fecha 11 de diciembre de 2024 se dictó Resolución de denegación que se publicó en el BOIB núm. 166 el 19 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. Con fecha 18 de diciembre de 2024 y núm. de registro REGAGE24e00088613858, el beneficiario Jaume Pou Vicens aportó el modelo 100 rectificado y donde se comprobó que sí cumple con el requisito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;10. Los órganos gestor no tuvieron en cuenta las alegaciones presentadas por la persona interesada y con fecha 22 de febrero de 2025 se dicta dictó el Informe. Propuesta y Resolución de revocación parcial de la Resolución de denegación que se publicó en el BOIB núm. 166 el 19 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;11. Ante la incongruencia de todos los modelos presentados por parte de la persona beneficiaria, con fecha 16 de enero de 2025 y en el BOIB núm. 8 se publicó un nuevo requerimiento de documentación para comprobar si se cumplía con la condición de agricultor no pluriactivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;12. Con fecha 4 de febrero de 2025 y núm de registro REGAGE25e00004986131, el beneficiario Jaume Pou Vicens aportó la documentación requerida. Una vez comprobada la documentación aportada, se constata que el beneficiario no cumple con la condición de agricultor no pluriactivo, puesto que los modelos de IRPF habían imputado a la actividad agraria una actividad de servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 25 de enero de 2024 por la que se aprueba la convocatoria para el año 2024 de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas, publicada en el BOIB núm. 15 de día 30 de enero de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 6 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. La ley 3/2019, de 31 de enero, agraria de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El resto de normativa de desarrollo y aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Resolución de denegación&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello, el vicepresidente en Materia Agraria del FOGAIBA dicta una resolución en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Considerar denegada la solicitud presentada por el interesado relacionado en el Anexo I, de la línea de ayuda pago compensatorio para zonas con limitaciones específicas 2024 y de la línea de ayuda pago compensatorio en zonas de montaña, por no cumplir el requisito indicado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;2. Notificar la resolución a los interesados del Anexo I mediante su publicación en el BOIB.&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;3. Informar a los interesados de que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas de Desarrollo Rural del FOGAIBA (calle de Reina Constanza, nº4 de Palma).&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución , de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de el 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/p&gt;
