font-size:12px">&nbsp;</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 19 de diciembre de 2024 (BOIB núm. 169, de 26 de diciembre de 2024) se nombró personal estatutario fijo a las personas que habían superado el concurso-oposición para cubrir plazas vacantes de la categoría técnico medio sanitario / técnica media sanitaria en cuidados auxiliares de enfermería del Servicio de Salud y se adjudicaron las plazas correspondientes.</span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;De conformidad con el punto 23.4 de la Resolución del director general del Servicio de Salud de las Islas Baleares de 1 de diciembre de 2025, por la que se aprueban las bases generales y el baremo de méritos que deben regir las convocatorias de los procesos de selección por medio de la modalidad de concurso-oposición derivados de la oferta de empleo público adicional de estabilidad ordinaria y excepcional de estabilización para el año 2022 del personal estatutario del Servicio de Salud de las Islas Baleares, el 28 de febrero de 2025 se llevó a cabo un acto público en el salón de actos del Hospital Universitario Son Espases para adjudicar las plazas vacantes de la categoría técnico medio sanitario / técnica media sanitaria en cuidados auxiliares de enfermería.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;La Resolución del director general del Servicio de Salud de las Islas Baleares de 1 de diciembre de 2025 por la que se aprueban las bases generales y el baremo de méritos que deben regir las convocatorias de los procesos de selección por medio de la modalidad de concurso oposición derivados de la oferta de empleo público adicional de estabilidad ordinaria y excepcional de estabilización para el año 2022 del personal estatutario del Servicio de Salud de las Islas Baleares.</span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;El artículo 13 y los concordantes del Real decreto ley 1/1999, de 8 de enero, sobre selección de personal estatutario y provisión de plazas a las instituciones sanitarias de la Seguridad Social, vigente con rango reglamentario y sin carácter básico en virtud de la disposición transitoria sexta de la Ley 55/2003.</span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.&nbsp;La disposición transitoria segunda de la Ley 4/2016, de 6 de abril, de medidas de capacitación lingüística para la recuperación del uso del catalán en el ámbito de la función pública, sin perjuicio de la aplicación de la disposición adicional decimotercera del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares, corregido por el Acuerdo del Consejo de Gobierno de 27 de junio de 2022 y modificado por la disposición final sexta de la Ley 4/2023, de 27 de febrero, de prestaciones sociales de carácter económico de las Islas Baleares.</span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello dicto la siguiente</span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>&nbsp;</strong></span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></span><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;Nombrar como personal estatutario fijo de la categoría técnico medio sanitario / técnica media sanitaria en cuidados auxiliares de enfermería del Servicio de Salud de las Islas Baleares a las personas que figuran en el anexo 1 de esta resolución.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Este nombramiento está sujeto al hecho de que las personas que no hayan acreditado el requisito del nivel B1 de conocimientos de catalán y que estén en servicio activo en la fecha de vencimiento del plazo para presentar solicitudes en el Servicio de Salud de las Islas Baleares en esta misma categoría profesional están obligadas a acreditar dicho nivel en el plazo de dos años a contar desde la fecha de la toma de posesión; en caso contrario, serán removidas de la plaza por medio del procedimiento correspondiente y pasarán a estar en la situación de adscripción provisional.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;Adjudicar las plazas, según se indica en el anexo 2, a los candidatos que han superado las pruebas selectivas, después de haber presentado la documentación pertinente, de acuerdo con la petición efectuada por los candidatos y la puntuación obtenida en el proceso selectivo.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;Determinar que la toma de posesión debe efectuarse en el plazo de un mes a contar desde el día siguiente a la fecha de publicación de esta resolución en el <em>Boletín Oficial de las Islas Baleares</em> y que perderán el derecho a tomar posesión de la plaza las personas que no se incorporen al destino correspondiente dentro de dicho plazo, excepto en los casos de imposibilidad acreditada y apreciada por el órgano convocante.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;Establecer que, antes de tomar posesión de la plaza, cada adjudicatario ha de hacer constar que no ocupa ningún puesto de trabajo en el sector público ni que lleva a cabo ninguna actividad de las que comprende el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas. En el caso de que lleve a cabo una segunda actividad<br /> —incluidas las de carácter profesional—, tiene la obligación de declararlo dentro del plazo de diez días hábiles a contar desde el día siguiente a la fecha de la toma de posesión, a fin de que el órgano competente acuerde la declaración de compatibilidad o incompatibilidad.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.&nbsp;Determinar que, de acuerdo con el párrafo segundo de la base 24 de la convocatoria, las personas que hayan obtenido un destino definitivo no pueden participar en ningún concurso de provisión de plazas durante un plazo mínimo de dos años a contar desde el día en que hayan tomado posesión de la plaza, excepto que en una primera convocatoria haya quedado desierta.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Asimismo, durante el mismo periodo de dos años, no podrán concederse a las personas adjudicatarias comisiones de servicios. Excepcionalmente, esta prohibición queda sin efecto cuando haya una necesidad asistencial debidamente acreditada</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.&nbsp;Aplazar el nombramiento de personal estatutario fijo de la señora María Guadalupe Muñoz Pérez (con plaza en el Hospital Universitario Son Espases), que ha superado el concurso-oposición pero está incursa en circunstancias de imposibilidad, acreditadas debidamente.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.&nbsp;Publicar esta resolución en el <em>Boletín Oficial de las Islas Baleares</em>.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución, que agota la vía administrativa, puede interponerse un recurso de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente a la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></span></p> <p><span style="color:#000000"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">También puede interponerse directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses a contar desde el día siguiente a la publicación, de acuerdo con el artículo 8.2.<em>a)</em> —en relación con el artículo 10.1.<em>a)</em>— y el artículo 46 de la Ley 29/1998, de
