    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Visto el informe técnico con propuesta de resolución de día 5 de marzo de 2025, y de acuerdo con el apartado 1 del artículo único del Decreto 5/2024, de 29 de mayo, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVO FORMULAR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;El informe de impacto ambiental del proyecto de una captación de aguas subterráneas (sondeo), para uso de regadío y doméstico, en el polígono 4, parcelas 47, 48 y 49, del TM de Campos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Determinación de sujeción a evaluación ambiental y tramitación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Según se establece en el artículo 7.2.a) de la Ley 21/2013, son objeto de una evaluación de impacto ambiental simplificada los proyectos comprendidos en el anexo II de esta ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Teniendo en cuenta el Real Decreto 445/2023, de 13 de junio de 2023, que modifica los anexos I, II y III de la Ley 21/2013, la actividad proyectada se incluye en el Anexo II, Grupo 3 (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;perforaciones, dragados y otras instalaciones mineras e industriales&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;) letra a)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3º. &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Perforaciones para el abastecimiento de agua.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por tanto, este proyecto debe seguir la tramitación ambiental como Evaluación de Impacto Ambiental Simplificada establecida en el capítulo II sección 2ª de la Ley 21/2013; también debe cumplirse el Decreto legislativo 1/2020, de 28 de agosto, por el que se aprueba el Texto Refundido de la Ley de Evaluación Ambiental de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Ubicación y descripción del proyecto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se prevé ubicar el sondeo (AAS_21938) en el polígono 4, parcelas 47,48 y 49, del TM de Campos, con las siguientes características:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Caudal máximo instantáneo: 5,0 l/s&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Volumen máximo anual: 400 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;/año para uso doméstico y 250 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;/año para riego.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Uso: Regadío y doméstico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Profundidad máxima del sondeo: 64 m&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cabe decir que en un apartado del documento ambiental se sitúa el proyecto en el polígono 4, parcela 330 del término municipal de Santa Maria del Camí. Se considera un error del documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La justificación de la dotación de 250 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3 &lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;/año para el regadío de frutales y huerto de autoconsumo se realiza a través del informe agronómico firmado electrónicamente por Juan Pons Bennasar (ingeniero técnico agrícola, col. 111) en fecha 16 de junio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El sondeo se realizará por el método de roto-percusión; se perforará sin recuperación del testigo y se cimentarán las paredes de los primeros 25 m desde la boca, entubado hasta la zona del acuífero y ranurado hasta el fondo. Alrededor del sondeo se colocará una losa de hormigón de 50 cm. Finalizada la obra, mientras no se instale la bomba eléctrica de elevación, el sondeo se cubrirá con una tapa metálica para impedir el acceso al mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acabada la instalación se bombea hasta encontrar agua limpia y se desinfecta de acuerdo con el anexo 8, punto 2.3.3, del Plan Hidrológico de las Illes Balears 2023 (a partir de ahora PHIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que el sondeo resulte negativo, se procede como en la fase de abandono: se sella el sondeo con el fin de que quede en condiciones de seguridad para las personas y los animales, además de evitar la contaminación imprevista del acuífero ocasionada por vertidos o caídas de elementos contaminantes (según anexo 8).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Alternativas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El documento ambiental contempla las siguientes alternativas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Alternativa 0 (no realizar el sondeo):&lt;/strong&gt; donde se ubica la parcela no existe conexión a la red municipal. La alternativa sería recogida de aguas de lluvia (insuficiente) o camiones de agua y almacenamiento en aljibe (con impactos por la ocupación del suelo y por la emisión de gases de efecto invernadero más elevados que el impacto que puede provocar la alternativa del sondeo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Alternativa 1 (realización del sondeo a otra ubicación): &lt;/strong&gt;no se contempla porque el punto seleccionado es el mejor según los criterios de posibilidad de encontrar agua sin afectar a vegetación o fauna y que permita el acceso de las máquinas para la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Alternativa 2 (realizar el sondeo con otro método de perforación):&lt;/strong&gt; se descarta porque el propuesto es el más rápido y no existen empresas en las Illes Balears que hagan otros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Alternativa 3 (hacer el sondeo proyectado): &lt;/strong&gt;se considera la más factible porque tiene en cuenta todo lo indicado en las dos alternativas anteriores (es más barata, con menos emisiones de gases de efecto invernadero, con menos uso de suelo para un aljibe, con escasa eliminación de vegetación, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Evaluación de los efectos previsibles y medidas correctoras propuestas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los principales impactos ambientales considerados se producirán en la &lt;strong&gt;fase de ejecución&lt;/strong&gt; del proyecto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Contaminación atmosférica&lt;/strong&gt;: durante la fase de ejecución del proyecto se producirá ruido y vibraciones por la utilización de la maquinaria; dada la distancia de las viviendas cercanas (550 m) se consideran molestias poco perceptibles. En cualquier caso, las tareas se realizarán durante horario diurno. Tampoco tendrá un impacto relevante para la fauna. No se produce impacto por emisión de partículas con la perforación con inyección de agua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Cambio climático&lt;/strong&gt;: en cuanto a la emisión de gases de efecto invernadero, se estima la emisión de 208,08 kg de CO &lt;/span&gt;&lt;sub&gt;&lt;span style="background-color:null"&gt;2 &lt;/span&gt;&lt;/sub&gt;&lt;span style="background-color:null"&gt;durante el tiempo de la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Agua&lt;/strong&gt;: sin efectos durante la ejecución si se utilizan espumantes adecuados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Vegetación&lt;/strong&gt;: eliminación en área de trabajo. Sin incidencia en ninguna especie protegida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Patrimonio&lt;/strong&gt;: no se prevé impacto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Paisaje&lt;/strong&gt;: se producirá impacto paisajístico solo los días que dure la perforación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Durante la &lt;strong&gt;fase de funcionamiento&lt;/strong&gt; el impacto más importante será sobre la masa de agua subterránea afectada (MAS 18.21-M1 Marina de Llucmajor). De acuerdo con el PHIB vigente, la masa de agua afectada por el proyecto se encuentra en mal estado cualitativo (contenido elevado en cloruros de 621 mg/l) y buen estado cuantitativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La extracción de agua subterránea puede ser susceptible de impacto si no se respeta el caudal y volumen autorizados por la Dirección General de Recursos Hídricos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El documento ambiental no menciona el consumo eléctrico durante la fase de aprovechamiento por el funcionamiento de la bomba.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El documento ambiental incluye medidas correctoras como cimentar la captación para evitar contaminación del acuífero o el uso de un contador volumétrico para respetar los parámetros de la concesión de extracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Consultas a las administraciones públicas afectadas y personas interesadas.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 30 de julio de 2024, el Servicio de Asesoramiento Ambiental remite consulta y petición de informe a las administraciones previsiblemente afectadas y entidades interesadas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A continuación se exponen las conclusiones de los informes recibidos en la fecha de emisión del presente informe:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe del Servicio de Ordenación del Territorio del Consejo Insular de Mallorca de 6 de agosto de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concluye que «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;desde el punto de vista de la ordenación de territorio y del paisaje, se considera que el proyecto de una captación de aguas subterráneas en el TM de Campos, &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;no tendrá efectos significativos sobre el medio ambiente &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;siempre que sirva a usos legalmente implantados en la parcela&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe del Servicio de Cambio Climático y Atmósfera de 19 de agosto de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se emite&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; informe&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;favorable &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;dado que «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;en relación con la perspectiva climática en la tramitación ambiental, no se prevé que el proyecto pueda tener efectos significativos&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe del Servicio de Reforma y Desarrollo Agrario de 19 de agosto de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Menciona que «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;[...] la parcela no forma parte de ninguna base territorial de ninguna explotación agraria inscrita en el Registro Interinsular Agrario. Tampoco se observa ninguna actividad agraria relevante en la parcela&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por tanto, «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;[...] &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;informa&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;desfavorablemente &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;el objeto del proyecto, desde el punto de vista agrario&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe del Servicio de Salud Ambiental de 19 de septiembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«Se informa &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;favorablemente &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;condicionado al uso de la captación establecido en el proyecto (uso doméstico y regadío).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Esta captación no podrá utilizarse por abastecimiento de agua de consumo si no dispone del informe sanitario favorable correspondiente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Se recomienda al titular de la captación que analice la calidad del agua antes de consumirla y que, en caso de que la calidad no sea la establecida en el Reía decreto 3/2023, de 10 de enero, por el que se establecen los criterios técnico-sanitarios de la calidad del agua de consumo, su control y suministro, tome medidas a efectos de cumplir los valores paramétricos establecidos en esta norma&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;»&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Análisis de los criterios del anexo III de la Ley 21/2013&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se han analizado los criterios del anexo III de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental, y no se prevé que el proyecto pueda tener efectos sobre el medio ambiente, en concreto:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Características del proyecto: perforación y sondeo de agua (AAS_21938) para uso doméstico (400 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;/año) y de regadío (250 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;/año), que ocupará una superficie de unos 60 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; durante&lt;sup&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/sup&gt;la fase de construcción y 0'25 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt; durante&lt;sup&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/sup&gt;la fase de funcionamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Ubicación del proyecto: el sondeo se proyecta en la parcela 47 del polígono 4 de Campos, clasificada como Suelo Rústico General (SGR).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se encuentra afectada por ningún espacio de la Red Natura 2000;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;tampoco se encuentra en ninguna zona definida por la Ley 1/1991, de 30 de enero, de espacios naturales de régimen urbanístico de las áreas de especial protección de las Illes Balears (LEN);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el ámbito del proyecto no se encuentra afectado ni está próximo a ningún hábitat de interés comunitario (HIC) descrita en la Directiva 92/43/CEE;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el área no está afectada por ninguna zona potencial inundable ni ARPSI (Área con Riesgo Potencial Significativo de Inundación);&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;toda la parcela se ubica en una zona con vulnerabilidad a la contaminación de acuíferos moderada;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la parcela no se encuentra afectada directamente por áreas de prevención de riesgos (APR) de inundación, de incendio, erosión o deslizamientos; tampoco presenta riesgo de incendio según el IV Plan Forestal 2015-2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El sondeo se ubica en la MAS 18.21-M1 Marina de Llucmajor; el estado de esta masa, según el Anexo 8 de la Memoria del PHIB vigente, es:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Estado cuantitativo: bueno (índice de explotación inferior al 80% de los recursos disponibles)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Estado cualitativo: malo (contenido elevado en cloruros de 621 mg/l, concentración superior al límite).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Características del potencial impacto: se considera que los efectos sobre el medio ambiente en la fase de ejecución serán mínimos, teniendo en cuenta la corta duración del período de obras. Respecto a la fase de funcionamiento debe indicarse que el consumo anual será de 650 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;/año en una masa que está en estado cuantitativo bueno según el PHIB vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El informe desfavorable del Servicio de Reforma y Desarrollo Agrario de 19 de agosto de 2024 se refiere exclusivamente al uso agrícola actual de la parcela. El artículo 114 del PHIB permite su uso para regadío, aunque el sondeo no se realice a una explotación agrícola (y cuando se ajuste a las condiciones del artículo 54 del Texto refundido de la Ley de Aguas). Así se puede autorizar un volumen de 250 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;3 / &lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;año y se considera que no tiene efectos ambientales significativos siempre que se respete el uso del agua que determina el estudio agronómico y para riego de especies de bajo requisito hídrico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El documento ambiental recoge un apartado de seguimiento, bajo la dirección de un director facultativo, de las medidas preventivas y reductoras propuestas, asignando un presupuesto a su cumplimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Conclusiones del informe de impacto ambiental&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. No sujetar a evaluación de impacto ambiental ordinaria el proyecto de una captación de aguas subterráneas (sondeo), para uso de regadío y doméstico, en el polígono 4, parcelas 47, 48 y 49, en el TM de Campos, promovido por Manuel Román Vidal y Antonia Cantallops Martorell, dado que no se prevé que pueda tener efectos significativos sobre el medio ambiente, de acuerdo con los criterios del anexo III de la Ley 21/2013, siempre que se cumplan las medidas preventivas, correctoras o reductoras propuestas en el documento ambiental firmado electrónicamente, en fecha 27 de junio de 2024, por Jaime Fernández Homar (Ingeniero Superior de Minas), y los siguientes condicionantes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El uso de la captación se limitará a los usos y volúmenes establecidos en el proyecto. En el momento de instalar la bomba definitiva se procederá a la instalación de un contador volumétrico. Para el agua de regadío se respetará lo que determina el estudio agronómico: riego de frutales y huerto de autoconsumo. No se realizará ajardinamiento con especies de elevado requisito hídrico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Dado que el proyecto se ubica en una zona con Vulnerabilidad a la Contaminación de Acuíferos Moderada, durante la ejecución de las obras y el funcionamiento, deben adoptarse las máximas precauciones para evitar el vertido de sustancias contaminantes, incluidas las derivadas del mantenimiento de las maquinarias, en cumplimiento de la Ley 6/1999, de 3 de abril, de las Directrices de Ordenación Territorial de las Illes Balears y de medidas tributarias, y sus modificaciones (Decreto ley 1/2016, de 12 de enero, de medidas urgentes en materia urbanística, y sus modificaciones).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se recomienda que, durante la fase de funcionamiento, se tomen medidas para disminuir el consumo de agua y el consumo energético:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto a la penetración de energías renovables en el proyecto, siempre que sea viable, en caso de que el sondeo sea positivo y se quiera proceder a la instalación de la bomba de extracción, dado que el documento ambiental indica que ésta será eléctrica, sería recomendable incluir la instalación de un sistema de producción de energía renovable, por ejemplo mediante placas fotovoltaicas o paneles solares, que permitan reducir al máximo el consumo energético.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que el sondeo sea positivo y se proceda a la extracción de agua del acuífero, con el objetivo de favorecer un uso responsable, debería preverse la recogida y almacenamiento del agua de lluvia para su posterior aprovechamiento. Asimismo, en caso de instalación de jardines ornamentales, el promotor del proyecto debería incorporar los sistemas de riego eficientes necesarios para reducir el consumo de agua, revisando periódicamente las conducciones a fin de detectar cualquier pérdida de agua, con especies de bajo requisito hídrico. &lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se recuerda que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El titular de la captación deberá cumplir lo recogido en el apartado de otorgamiento de autorizaciones para uso doméstico descrito en el artículo 114 «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Normas para el otorgamiento de autorizaciones&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;» del PHIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Deberá aplicarse el procedimiento recogido en el anexo 8 de «&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Condiciones técnicas para la ejecución, equipamiento y clausura de sondeos y pozos&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;» del PHIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tal y como recuerda el Servicio de Salud Ambiental, la captación no podrá utilizarse por abastecimiento de agua de consumo si no dispone del informe sanitario favorable correspondiente. El titular de la captación debe analizar la calidad del agua antes de consumirla y, en caso de que la calidad no sea la establecida en el Real decreto 3/2023, de 10 enero, por el que se establecen los criterios técnico-sanitarios de la calidad del agua de consumo, debe tomar medidas para cumplir los valores paramétricos establecidos en esta norma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Se publicará el presente informe de impacto ambiental en el Boletín Oficial de las Illes Balears, de acuerdo con lo que dispone el artículo 47.3 de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. El informe de impacto ambiental perderá su vigencia y cesará en la producción de los efectos que le son propios si, una vez publicado en el BOIB, no se hubiera procedido al inicio de la ejecución del proyecto en el plazo máximo de seis años desde su publicación, de acuerdo con lo que dispone el artículo 21 bis del Texto refundido de la Ley de evaluación ambiental de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. El informe de impacto ambiental no será objeto de recurso alguno, sin perjuicio de los que, en su caso, procedan en la vía administrativa o judicial ante el acto, en su caso, de autorización del proyecto, de acuerdo con lo dispuesto en el artículo 47.6 de la Ley 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Esta resolución se emite sin perjuicio de las competencias urbanísticas, de gestión o territoriales de las administraciones competentes y de las autorizaciones o informes necesarios para su aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
