19853 CAIB CAIB 120 ![CDATA[<p><span style="line-height:100%"><strong>Hechos</strong></span></p> <p><span style="line-height:100%">1. Mediante la Resolución de la consejera de Presidencia, Función Pública e Igualdad de 19 de diciembre de 2022, se aprobó la convocatoria, bases, ejercicios y temario y baremo de méritos de las pruebas selectivas para el ingreso, por el turno libre y por el turno de promoción interna vertical y por el turno de promoción interna cruzada, incluida la reserva para personas con discapacidad, para cubrir las plazas de personal funcionario en la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 165, de 20 de diciembre de 2022).</span></p> <p><span style="line-height:100%">2. El punto 8.5 de las bases específicas de la convocatoria mencionada, establece que si algún aspirante es nombrado personal funcionario de carrera del mismo cuerpo, escala o especialidad a la que opta, en su caso, durante el transcurso de este proceso selectivo, o bien ya tiene esta condición, será excluido, con la correspondiente devolución de tasas.</span></p> <p><span style="line-height:100%">3. Mediante la Resolución de la consejera de Presidencia y Administraciones Públicas de 18 de junio de 2024, se aprueban las listas definitivas de personas admitidas y excluidas, con expresión de la causa de exclusión, de las pruebas selectivas para el ingreso, por el turno libre, en los cuerpos facultativos de la Administración de la Administración especial de la Administración especial de 2022. </span></p> <p><span style="line-height:100%">4. En fecha 14 de diciembre de 2024, se publicó en el BOIB nº. 164 la Resolución de la consejera de Presidencia y Administraciones Públicas por la que se nombraron funcionarios de carrera del proceso de estabilización por concurso oposición del cuerpo facultativo técnico, excepto la especialidad de ingeniería técnica agrícola, de la Administración especial de la Comunidad Autónoma de las Illes Balears y se les adjudicó un puesto de trabajo. <span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="line-height:100%">5. En fecha 31 de diciembre de 2024, se publicó en el BOIB nº. 172 la Resolución de la consejera de Presidencia y Administraciones Públicas por la que se nombraron funcionarios de carrera del proceso de estabilización por concurso oposición del cuerpo facultativo superior de la Administración especial de la Comunidad Autónoma de las Illes Balears y se les adjudicó un puesto de trabajo. </span></p> <p><span style="line-height:100%"><strong>Fundamentos de derecho</strong></span></p> <p><span style="line-height:100%">1. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas </span></p> <p><span style="line-height:100%">2. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la administración de la Comunidad Autónoma de las Illes Balears. </span></p> <p><span style="line-height:100%">3. La Ley 3/2007, de 27 de marzo, de la función pública de la comunidad autónoma de las Illes Balears. </span></p> <p><span style="line-height:100%">4. El Decreto 27/1994, de 11 de mayo, por el que se aprueba el Reglamento de ingreso del personal al servicio de la comunidad autónoma de las Illes Balears. </span></p> <p><span style="line-height:100%">5. El Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, y posteriores modificaciones por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears. </span></p> <p><span style="line-height:100%">6. Mediante las Resoluciones mencionadas en los números 4 y 5 de los hechos de esta Resolución, se nombraron funcionarios de carrera de la Administración especial, a las personas que figuran en el anexo de esta Resolución para superar, respectivamente, el correspondiente proceso selectivo, asimismo, fueron admitidas en las pruebas selectivas para el ingreso, por el turno libre, en los cuerpos de la Administración especial de la Comunidad Autónoma de las Illes Balears convocadas por Resolución de 19 de diciembre de 2022, por lo que, de acuerdo con el punto 8.5 de las bases específicas de la citada convocatoria deben ser excluidas de este proceso. </span></p> <p><span style="line-height:100%">Por todo ello, dicto la siguiente </span></p> <p style="text-align:center"><span style="line-height:100%"><strong>Resolución</strong></span></p> <p><span style="line-height:100%">1. Excluir de forma definitiva a las personas aspirantes que figuran en el anexo de esta Resolución de las pruebas selectivas para el ingreso, por el turno libre, en los cuerpos de la Administración especial de la Comunidad Autónoma de las Illes Balears (BOIB núm. 165, de 20 de diciembre de 2022) de acuerdo con el punto 8.5 de las bases específicas de la citada convocatoria.</span></p> <p><span style="line-height:100%"><span style="background-color:#ffffff">2. Modificar, en los términos establecidos en el anexo de esta Resolución, las listas definitivas de admitidos y excluidos del citado proceso, aprobadas por Resolución de 18 de junio de 2024.</span> </span></p> <p><span style="line-height:100%">3.
