es es CAIB ![CDATA[Resolución del consejero de Hacienda y Función Pública que aprueba la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso oposición para el ingreso como personal funcionario en la escala de administración general, subescala auxiliar, categoría auxiliar administrativo-iva del subgrupo C2, derivada de la oferta de ocupación pública del Ayuntamiento de Andratx, y de asignación de puestos de trabajo por turnos de acceso a efectos de su nombramiento como funcionarios de carrera]] 698940 236478 18293 370 CAIB 2025-04-02 2025-04-05 text/html CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública, por delegación del Consejo Ejecutivo, según el Acuerdo de 28 de septiembre de 2022, BOIB n.º 128, de 1 de octubre de 2022, de conformidad con el que dispone el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;En el Boletín oficial de las Islas Baleares n.º 38, de día 27 de marzo de 2025 se publicó la resolución del consejero de Hacienda y Función Pública que aprueba la lista de personas que han superado el proceso selectivo de estabilización por el sistema de concurso oposición para el ingreso como personal funcionario en la escala de administración general, subescala auxiliar, categoría auxiliar administrativo-iva del subgrupo C2, derivada de la oferta de ocupación pública del Ayuntamiento de Andratx, y de asignación de puestos de trabajo por turno de acceso a efectos de su nombramiento como funcionarios de carrera.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;En fecha 27 de marzo de 2025 el Sr. Rafael Antonio Sánchez Vallés, persona interesada en el procedimiento, ha registrado un escrito solicitando la rectificación de la plaza asignada, indicando que no se corresponde con las plazas reservadas para el turno de personas con discapacidad, tal como figuraba en el BOIB 137 de 22 de octubre de 2022, donde se publica la lista de identificación de las plazas afectadas por la Oferta de Ocupación Pública para la estabilización de la ocupación de Funcionarios del Ayuntamiento de Andratx. Una vez comprobado este hecho, se determina que hay un error consistente en la identificación de las plazas nºref/Puesto.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas, establece que las administraciones publicas pueden rectificar en cualquier momento, de oficio o a instancia de las personas interesadas, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.&nbsp;La Ley 3/2007, de 27 de marzo, de la función pública de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.&nbsp;El Decreto Ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en la ocupación pública de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.&nbsp;La Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 2 de diciembre de 2022 (BOIB n.º 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023, de fecha 7 de febrero de 2023 y de fecha 13 de febrero de 2023 (BOIB n.º 13, de 28 de enero de 2023, BOIB n.º 19, de fecha 11 de febrero de 2023 y BOIB n.º 21, de fecha 16 de febrero de 2023), se aprobó la convocatoria del proceso selectivo de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de las escalas, subescalas, clases y categorías (o especialidades) de administración general y especial de los subgrupos A1, A2, C1, C2 y del grupo AP derivada de la oferta de ocupación pública de los Ayuntamientos de Alcudia, Algaida, Andratx, Artà, Capdepera, Felanitx, Inca, Lloseta, Manacor, Pollença, Porreres, Puigpunyent, Sencelles, Ses Salines y Santa Maria del Camí.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo esto, dicto la siguiente</span></p> <p style="text-align:center"><strong>Resolución</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1.&nbsp;Rectificar</strong> los errores observados al anexo 1 de la Resolución del consejero de Hacienda y Función Pública, de día 27 de marzo de 2025, que aprueba la lista de personas que han superado el proceso selectivo de estabilización por el sistema de concurso oposición para el ingreso como personal funcionario en la escala de administración general, subescala auxiliar, categoría auxiliar administrativo-iva del subgrupo C2, derivada de la oferta de ocupación pública del Ayuntamiento de Andratx, y de asignación de puestos de trabajo por turno de acceso a efectos de su nombramiento como funcionarios de carrera.</span></p> <p><strong>Donde dice:</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">“Subgrupo C2, Administración general, Subescala auxiliar</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">ORGANISMO: Ayuntamiento de Andratx. font-size:12px"><strong>3.&nbsp;Aprobar </strong>la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso oposición para el ingreso como personal funcionario en la escala de administración general, subescala auxiliar, categoría auxiliar administrativo-iva del subgrupo C2, derivada de la oferta de ocupación pública del Ayuntamiento de Andratx, y de asignación de puestos de trabajo por turnos de acceso a efectos de su nombramiento como funcionarios de carrera, de acuerdo con el que se indica en el Anexo 1 de este documento.&nbsp; font-size:12px"><strong>4.&nbsp;Asignar los puestos de trabajo</strong> correspondientes a la categoría de auxiliar administrativo del subgrupo C2 del Ayuntamiento de Andratx, a las personas aspirantes que han superado el procedimiento selectivo de estabilización por el sistema de concurso oposición para la convocatoria de estas plazas, de conformidad con la base 8.8 de la convocatoria y de acuerdo con el trámite de manifestación de orden de preferencias efectuado y la puntuación obtenida en el proceso selectivo. En el supuesto de que no se haya efectuado este trámite por parte de la persona aspirante, el puesto de trabajo será asignado de oficio. Esta información se recoge en el Anexo 1 de este documento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.&nbsp;Informar</strong> en el Ayuntamiento que la adjudicación y adscripción definitiva de los puestos de trabajo a las personas aspirantes queda condicionada a la acreditación de estar en posesión de todos los requisitos específicos para la adscripción al puesto de trabajo, que tendrá que ser requerida, si procede, por el Ayuntamiento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.&nbsp;Ordenar </strong>la publicación de esta Resolución y su Anexo en el tablón de edictos y a la Sede electrónica del Consell Insular de Mallorca, y en el Boletín Oficial de las Islas Baleares.</span></p> <p><strong>Interposición de recursos</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra este acto, que no pone fin a la vía administrativa, podéis interponer recurso de alzada en el plazo de un mes, contador a partir del día siguiente a recibir esta notificación.
