    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Mediante la presente se publica la resolución de la presidenta de día 2 de abril de 2025, del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«Visto que la gestión de los servicios sociales se puede hacer mediante diversas fórmulas, tal y como indica el artículo 89 de la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares. Entre otros, la acción concertada es la figura de colaboración entre el sector público y el privado que más se adecua a los principios que deben regir el sistema de servicios sociales, especialmente a raíz de la aprobación de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Islas Baleares. El artículo 2 de esta ley prevé que las administraciones competentes de las Islas Baleares, para complementar el sistema público y garantizar una equidad y calidad adecuadas de las prestaciones incluidas en la cartera de servicios, pueden encargar la prestación de estos servicios de su competencia, mediante el sistema de acción concertada, a entidades sin ánimo de lucro del tercer sector social,&amp;nbsp; tal como se definen en los artículos 3 y 4 de la Ley 3/2018, de 29 de mayo, del tercer sector de acción social, o, en su caso, a entidades privadas, preferentemente del tercer sector social, cuando existan análogas condiciones de eficacia, calidad y costes, de acuerdo con los requisitos establecidos por la presente ley y con respeto a los principios de publicidad,&amp;nbsp; transparencia y no discriminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que además, el mismo artículo da una definición del régimen de acción concertada como es la prestación por terceros de servicios sociales incluidos en la Cartera de servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que la Mancomunidad del Plan de Mallorca tiene asignado, en el presupuesto de 2025, un importe de 630.851,25€ euros para la concertación de servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto que esta mancomunidad publicó en el BOIB nº 31 de día 11 de marzo de 2025 la «Aprobación de la previsión de las prestaciones y los servicios que se deben concertar durante el año 2025 de la cartera de servicios de la Mancomunidad del Pla de Mallorca».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De acuerdo con el artículo 5 de la Ley 12/2018 pueden suscribir acuerdos de acción concertada todas las entidades del tercer sector de acción social que presten los servicios objeto del concierto y lo soliciten expresamente en los plazos y la forma que se determinen. No obstante, en los procedimientos de acción concertada de servicios declarados de interés económico general, pueden suscribir conciertos todas las personas físicas o jurídicas de carácter privado, con o sin ánimo de lucro, sea cual sea la forma jurídica que adopten, que presten los servicios objeto del concierto y lo soliciten expresamente en los plazos y la forma que se determinen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;PRIMERO.&lt;/strong&gt; Modificar y enmendar el «ANEXO I Previsión de prestaciones y servicios a concertar» publicado en el BOIB nº 31 de día 11 de marzo de 2025 referente a la «Aprobación de la previsión de las prestaciones y los servicios que se deben concertar durante el año 2025 de la cartera de servicios de la Mancomunidad del Pla de Mallorca» y,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;DONDE DICE:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;«ANEXO I. Previsión de prestaciones y servicios a concertar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Convocatoria por entidades acreditadas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;TERCERO.&amp;nbsp;&lt;/strong&gt; Publicar esta resolución de enmienda en el Boletín Oficial de las Islas Baleares».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
