    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública, por delegación del Consejo Ejecutivo, según el acuerdo de 28 de septiembre de 2022, BOIB núm.&amp;nbsp;128, de 1 de octubre de 2022, de conformidad con lo dispuesto en el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;"ANTECEDENTES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Por resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 9 de diciembre de 2022 BOIB núm.&amp;nbsp;163, de 15 de diciembre de 2022, BOE núm.&amp;nbsp;305, de 21 de diciembre de 2022), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para cubrir las plazas de personal laboral fijo de las categorías de los subgrupos C1, C2 y grupo E/AP derivada de la oferta de empleo público extraordinaria del Instituto del Deporte Hípico de Mallorca para el año 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. En esta resolución se convocaron, entre otras, 1 plaza de Auxiliar actividades deportivas, correspondientes al grupo C2, personal laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Por acuerdo del tribunal calificador competente de este proceso selectivo de estabilización, una vez concluidas la revisión y baremación de los méritos de los aspirantes, en fecha 28 de febrero de 2025 se publicó, en el tablón electrónico de anuncios y en la sede electrónica del Consell Insular de Mallorca, la resolución de empates, aprobación de la lista definitiva de méritos y ofrecimiento de puestos del proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como&amp;nbsp;personal laboral fijo, subgrupo C2, categoría de Auxiliar actividades deportivas, derivado de la oferta de empleo público extraordinaria del Instituto del Deporte Hípico de Mallorca para el año 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. De conformidad con el punto 8 de las bases específicas de la convocatoria, una vez asignados los puestos de trabajo ofrecidos, el tribunal debe elevar al consejero ejecutivo de Hacienda y Función Pública la propuesta de personas aspirantes que han superado el proceso selectivo de concurso de méritos para el ingreso como personal laboral fijo del subgrupo C2,&amp;nbsp;con asignación de puestos de trabajo.&amp;nbsp;Esta lista debe contener, como máximo, tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. En fecha 20 de marzo de 2025 el tribunal calificador competente del procedimiento selectivo ha acordado elevar al consejero de Hacienda y Función Pública Acuerdo del Tribunal Calificador de la propuesta de las personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del subgrupo C2 del Instituto del Deporte Hípico de Mallorca,&amp;nbsp;categoría/especialidad Auxiliar de actividades deportivas, de nombramiento como laboral fijo y de la adjudicación de puestos de trabajo, de acuerdo con el trámite de manifestación de orden de preferencias efectuado, para su nombramiento como personal laboral fijo, la cual contiene tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En el caso en que no se hubiera efectuado el trámite por parte de la persona aspirante, el puesto de trabajo ha sido asignado de oficio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;FUNDAMENTOS DE DERECHO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El artículo 91.1 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. El artículo 68 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. La ley 20/2021 de 28 de diciembre de medidas urgentes para la reducción de la temporalidad en el empleo público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. La ley 4/2022, de 28 de junio de consejos Insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. El artículo 4 del Decreto-ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 9 de diciembre de 2022 (BOIB núm. 163, de 15 de diciembre de 2022, BOE núm. 305, de 21 de diciembre de 2022), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para cubrir las plazas de personal laboral fijo de las categorías de los subgrupos C1,&amp;nbsp;C2 y grupo E/AP derivada de la oferta de empleo público extraordinaria del Instituto del Deporte Hípico de Mallorca para el año 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1.&amp;nbsp;&lt;strong&gt;APROBAR&lt;/strong&gt;&amp;nbsp;la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del subgrupo C2, categoría/especialidad Auxiliar de actividades deportivas del Instituto del Deporte Hípico de Mallorca, de acuerdo con lo indicado en el Anexo I de esta resolución con indicación de la asignación de los puestos de trabajo correspondientes.&amp;nbsp;De acuerdo con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta lista contiene, como máximo, tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2.&amp;nbsp;&lt;strong&gt;ORDENAR&lt;/strong&gt;&amp;nbsp;la publicación de esta resolución y su anexo en el tablón de edictos y en la Sede electrónica del Consejo Insular de Mallorca, y en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;INTERPOSICIÓN DE RECURSOS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra este acto, que no pone fin a la vía administrativa, se puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de recibir esta notificación.&amp;nbsp;El recurso se puede interponer formalmente ante el Consejo&amp;nbsp;Ejecutivo&amp;nbsp;o ante la Comisión de Gobierno del Consell Insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y se puede interponer el recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de seis meses, contados a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;No obstante lo anterior, puede interponer, en su caso, cualquier otro recurso que considere oportuno.&amp;nbsp;Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
