Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes. BOIB núm. 48 de l'11 d'abril del 2024 el la Resolución del presidente del FOGAIBA de 26 de marzo de 2024.</p> <p>2. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se modifica la Resolución del presidente del FOGAIBA de 26 de marzo de 2024, por la cual se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes. BOIB núm. 69 de 25 de mayo del 2024.</p> <p>3. De conformidad con el apartado sexto de la mencionada Resolución, el plazo de presentación de solicitudes acabó el día 31/05/2024.</p> <p>4. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</p> <p>5. A fecha 8 de febrero de 2025 se publicó en el BOIB núm. 18 un informe propuesta provisional de denegación, de 31 de enero de 2025, por incumplimiento de los requisitos de tener la puntuación mínima, es decir, que las solicitudes deben tener 37,5 puntos, o de los que deben ser propietarios o titulares de parcelas forestales ubicadas en una zona declarada de riesgo de incendio forestal alto, muy alto o extremadamente, de acuerdo con el IV Plan de defensa contra incendios forestales de las Illes Balears, donde se emplazaba a las personas interesadas en presentar alegaciones su expediente en el plazo de diez días.</p> <p>6. Una vez finalizado el plazo por alegaciones, los interesados relacionados en el anexo adjunto no cumplen con alguno de los requisitos citados en el apartado anterior.</p> <p>7. Corresponde proponer para denegar los expedientes señalados en el Anexo I por los motivos indicados en el citado anexo.</p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="display:inline-block"><span style="color:#000000">Fundamentos de derecho</span></span></span></span></strong></p> <p>1. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Illes Balears 2014-2020, publicada en el Butlletí Oficial de les Illes Balears núm. 29, de 26 de febrero de 2015.</p> <p>2. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados a los bosques por incendios forestales, desastres naturales y catástrofes. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se modifica la Resolución del presidente del FOGAIBA de 26 de marzo de 2024, por la cual se convocan, para el año 2024, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes. BOIB núm. 69 de 25 de mayo del 2024.</p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="display:inline-block"><span style="color:#000000">Resolución </span></span></span></span></strong></p> <p>Por todo esto, se informa desfavorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:</p> <p>1. Denegar la ayuda solicitada por los interesados que figuran al Anexo I , que son un total de 8 expedientes y que empieza con CAN FARMBER SL y acaba con MIGUEL ANGEL COLOMAR SERRA relativa a la línea de ayudas “Inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes”, por no cumplir requisitos que se establecen en la convocatoria y que se especifican al mencionado anexo.</p> <p>2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo adjunto.</p> <p>3.
