    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La relevancia del diálogo social como instrumento que contribuye a mejorar la gobernabilidad económica y social se reconoce en instancias internacionales, como por ejemplo el Convenio de la Organización Internacional del Trabajo n.º 150 (1978) y la Comunicación de 12 de agosto de 2004 sobre el diálogo social europeo; y nacionales, como ocurre en la Constitución española de 1978, que reconoce el deber de los poderes públicos de promover la participación de la ciudadanía en la vida política, económica, cultural y social, y la trascendencia política de las organizaciones sindicales y empresariales. De este modo, la interlocución de los agentes sociales en el marco de la participación institucional supera la defensa de la clase trabajadora y empresarial comoquiera que se los debe tener en cuenta para adoptar decisiones que afectan a la ciudadanía. Por su parte, el Estatuto de autonomía de las Illes Balears declara igualmente el valor de la concertación social y la participación de los interlocutores sociales más representativos en la vida administrativa pública y su contribución a la satisfacción de los intereses generales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este marco, y vista la importancia de la función que se otorga a los interlocutores sociales más representativos, la Ley 2/2011, de 22 de marzo, por la que se regula la participación institucional de las organizaciones empresariales y sindicales más representativas de la comunidad autónoma de las Illes Balears, regula los criterios con los que tienen que compensarse los costes que les supone la participación institucional y dedica el título II al fomento y la evaluación de esta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así, el artículo 6 de la Ley 2/2011 reconoce el derecho de las organizaciones empresariales y sindicales más representativas a percibir una subvención económica para compensar los gastos derivados de la participación institucional. Además, el artículo 7 prevé la consignación de una partida presupuestaria en la ley de presupuestos generales de la Comunidad Autónoma destinada a compensar económicamente el ejercicio de las funciones y cometidos derivados de la participación institucional. Finalmente, la disposición adicional quinta de la misma Ley regula la distribución de las ayudas en atención a criterios de representatividad y en proporción a la representación de las organizaciones sindicales y empresariales más representativas en la Mesa Social Tripartita de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En base a esta previsión legal, se aprueba esta convocatoria informativa, que tiene por objeto fomentar la participación institucional de las organizaciones empresariales y sindicales más representativas de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Orden del consejero de Trabajo y Formación de 4 de mayo de 2005, modificada por la Orden de la consejera de Trabajo y Formación de 16 de julio de 2008, y por la orden&amp;nbsp;del consejero de Empresa, Empleo y Energía&amp;nbsp;de 11&amp;nbsp;de noviembre de 2024, establece las bases reguladoras en materia de trabajo y formación, que resulta aplicable en todo lo que no sea incompatible con las ayudas concedidas y, en los apartados 2.2 y 2.3 del artículo 1, incluye el fomento del hecho sindical y la participación institucional de las organizaciones empresariales más representativas. Estos apartados, en relación con las previsiones realizadas en la Ley 2/2011, constituyen la normativa reguladora de la subvención destinada al fomento de la participación institucional de las organizaciones empresariales y sindicales más representativas, las cuales son el objeto de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 37.2 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre, se puede autorizar el pago anticipado de la subvención hasta un máximo del 75 % del importe con las garantías que correspondan siempre que la entidad beneficiaria acredite que no dispone de recursos suficientes para financiar transitoriamente la ejecución de la actividad que se subvenciona. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 14.3 y 4 del Texto refundido de la Ley de Subvenciones, aprobado por medio del Decreto Legislativo 2/2005, de 28 de diciembre:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;[...] en los casos a que se refiere la letra b) del apartado 1 del artículo 7 en los cuales la norma de rango legal no haga una delimitación precisa de los beneficiarios, el procedimiento también debe iniciarse a solicitud de las personas interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En los casos a que se refiere el apartado anterior de este artículo, el órgano competente para la concesión de la subvención puede dictar un acto de convocatoria informativa, el cual tendrá el carácter de simple presupuesto de los procedimientos que, en su caso, se inicien posteriormente con las solicitudes que se presenten.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otro lado, el artículo 3 de la Orden de bases antes mencionada establece que las convocatorias correspondientes deben aprobarse por medio de una resolución de la consejera o el consejero competente en materia de trabajo y formación, y deben publicarse en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. En el caso de esta convocatoria informativa, también se aprobará y publicará en los mismos plazos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estas ayudas se han incluido en el objetivo II.5.2 del Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2024-2026, aprobado por Acuerdo del Consejo de Gobierno de 19 de abril de 2024 (BOIB n.º 52, de 20 de abril). Esta convocatoria se dirige a un beneficiario que no ejerce ninguna actividad económica y, por lo tanto, no se considera como una ayuda de estado en los términos de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea (TFUE). Así, esta ayuda no está sujeta a ningún régimen de ayudas de la UE.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 56.2 del Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley de General de Subvenciones, se hace constar expresamente que la concesión de las subvenciones queda condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de concesión. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, de acuerdo con los preceptos indicados, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprobar la convocatoria para conceder ayudas destinadas a fomentar la participación institucional de las organizaciones empresariales y sindicales más representativas de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aprobar los términos de esta convocatoria que constan en el anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Aprobar el modelo de solicitud y de declaración responsable que se adjuntan, respectivamente, como anexo 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;y comunicarla a la Base de datos nacional de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas a conceder se rigen por la Ley 2/2011, de 22 de marzo, por la que se regula la participación institucional de las organizaciones empresariales y sindicales más representativas de la comunidad autónoma de las Illes Balears, el Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre y la Orden del consejero de Trabajo y Formación de 4 de mayo de 2005 por la que se establecen las bases reguladoras de las subvenciones en materia de trabajo y formación, modificada por la Orden de la consejera de Trabajo y Formación de 16 de julio de 2008 y por la orden&amp;nbsp;del consejero de Empresa, Empleo y Energía&amp;nbsp;de 11&amp;nbsp;de noviembre de 2024. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Importe económico de la convocatoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las ayudas concedidas tienen que abonarse con cargo a la partida presupuestaria 19601 322B01 48003.00 de los presupuestos generales de la Comunidad Autónoma de las Illes Balears para el año 2024, vigentes mientras no entren en vigor los presupuestos del ejercicio 2025, por un importe total de quinientos setenta y dos mil euros (572.000 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La concesión de las ayudas previstas en esta convocatoria está condicionada a las disponibilidades presupuestarias del punto anterior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Ámbito temporal &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las actividades objeto de subvención tienen que llevarse a cabo entre el 1 de noviembre de 2024 y el 31 de octubre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Beneficiarios y causas de exclusión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las entidades beneficiarias son las organizaciones sindicales y empresariales más representativas de las Illes Balears en los términos establecidos en el artículo 3.1 de la Ley 2/2011.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los requisitos que tienen que acreditar las entidades solicitantes son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;No estar sometidas a ninguna de las prohibiciones para ser beneficiarias de las ayudas establecidas en el artículo 10 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Estar al corriente de las obligaciones con la Seguridad Social antes de dictar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Estar al corriente de las obligaciones tributarias con el Estado y con la Comunidad Autónoma de las Illes Balears antes de dictar la propuesta de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;No haber sido sancionadas o condenadas en los tres últimos años por ejercer o tolerar prácticas laborales consideradas discriminatorias por razón de sexo o de género, sancionadas por resolución administrativa firme o condenadas por sentencia judicial firme, de acuerdo con el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, ni haber sido sancionada o condenada por resolución administrativa firme con pena accesoria de prohibición de recibir ayudas o subvenciones públicas por el periodo estipulado en el artículo 37 de la Ley 8/2016, de 30 de mayo, para garantizar los derechos de lesbianas, gays, trans, bisexuales e intersexuales y para erradicar el LGTBI-fobia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Acción subvencionable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La acción subvencionable consiste en la participación de las organizaciones empresariales y sindicales más representativas en las mesas, los consejos y el resto de foros de participación de la Consejería de Empresa, Empleo y Energía y del Servicio de Empleo de las Illes Balears (SOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuantía de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. De acuerdo con la disposición adicional quinta de la Ley 2/2011, la distribución de la cuantía asignada tiene que dividirse en dos mitades iguales, que tienen que destinarse, respectivamente, a la representación empresarial y a la representación sindical.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La cuantía resultante debe repartirse en proporción al número de componentes que se asignan a cada una de las organizaciones sindicales y empresariales más representativas en la Mesa Social Tripartita de las Illes Balears, regulada por el Decreto 47/2012, de 8 de junio, por el que se crea y regula la Mesa Social Tripartita de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Presentación de las solicitudes y plazo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El plazo para presentar las solicitudes es de un mes a contar desde el día siguiente de la publicación de esta convocatoria en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las personas interesadas tienen que presentar las solicitudes de forma electrónica mediante el trámite telemático que estará disponible en el procedimiento publicado en la Sede Electrónica de esta Administración, al cual, de conformidad con el artículo 66.6 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, se tendrá que adjuntar la solicitud específica del procedimiento que estará disponible en la Sede Electrónica de esta Administración, firmada electrónicamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de presentarla de manera presencial, la Administración, conforme a lo establecido en el artículo 68.4 de la Ley 39/2015, los requerirá para que la realicen en la forma indicada anteriormente. A tal efecto, se considerará como fecha de presentación de la solicitud aquella en que se haya llevado a cabo la subsanación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se tendrán por presentadas en el registro las solicitudes que se presenten por cualquier otra vía telemática diferente de este trámite telemático.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 14.2 de la Ley 39/2015, están obligados a relacionarse a través de medios electrónicos con las administraciones públicas para efectuar cualquier trámite de este procedimiento administrativo, al menos, los siguientes sujetos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Las personas jurídicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Las entidades sin personalidad jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; Quienes representen a un interesado que esté obligado a relacionarse electrónicamente con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 68.4 de la Ley 39/2015, si alguno de los sujetos a que hace referencia el artículo 14.2 presenta la solicitud presencialmente, las administraciones públicas tienen que requerir el interesado para que lo subsane a través de la presentación electrónica. A tal efecto, se considera como fecha de presentación de la solicitud aquella en que se haya llevado a cabo la subsanación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las entidades solicitantes tienen que realizar la petición de la ayuda por medio de quien las represente legalmente, con la acreditación adecuada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Si la solicitud no cumple los requisitos legales y los que exigen la Orden de bases reguladoras y esta convocatoria, tiene que requerirse a la entidad interesada para que, en el plazo de diez días, subsane la deficiencia o aporte los documentos preceptivos, con la indicación que, si así no lo hace, se considerará que desiste en su petición, con la resolución previa que tiene que dictarse en los términos previstos en el artículo 21 de la Ley 39/2015 antes mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Noveno&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Documentación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Junto con la solicitud, se tienen que adjuntar los siguientes documentos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Solicitud específica de la convocatoria, según el modelo normalizado de la solicitud y declaración responsable (anexo 2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Documento fehaciente que acredite la representación de la persona que actúa en nombre de la entidad solicitante. La representación se puede acreditar por cualquier forma válida en derecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de representación mediante inscripción en el Registro electrónico de apoderamientos (REA) será suficiente el número de registro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Copia del documento constitutivo de la entidad o de los estatutos sociales debidamente inscritos en el registro correspondiente, o certificado de inscripción registral de los documentos mencionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Justificación&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;mediante una declaración responsable, de que la entidad solicitante no dispone de recursos suficientes para financiar la ejecución de la actividad que se subvenciona, en el supuesto de que la entidad solicite el pago anticipado del 75 % del importe de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Justificación&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;mediante declaración responsable, de las circunstancias excepcionales que permiten hacer el pago anticipado sin exigencia previa de ninguna garantía, en el supuesto de que así lo solicite la entidad interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En cuanto a los requisitos establecidos en los apartados &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;y &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del punto 2 del apartado quinto de esta convocatoria, la firma de la solicitud de ayudas implica la autorización para que la Consejería de Empresa, Empleo y Energía pueda obtener información relativa al cumplimiento de las obligaciones con la Seguridad Social y de las obligaciones tributarias con el Estado y con la Comunidad Autónoma de las Illes Balears, excepto en el supuesto de que deniegue expresamente el consentimiento, supuesto en que tiene que aportar los certificados correspondientes junto con la solicitud de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En el supuesto que alguno de los documentos requeridos para tramitar la subvención ya se haya presentado ante la Administración actuante con ocasión de la tramitación otros expedientes, no es necesario aportarlo de nuevo, siempre que se hagan constar la fecha y el órgano o dependencia en que se presentaron o, si procede, el órgano que los emitió, siempre que no hayan transcurrido más de cinco años desde el acabado del procedimiento correspondiente y no hayan sufrido modificaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Décimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Régimen de concesión de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 5.5 de la Orden de bases reguladoras en relación con la disposición adicional quinta de la Ley 2/2011, la concesión de las ayudas tiene que hacerse en régimen de concesión directa, dado que no son necesarias la comparación y la prelación de todas las solicitudes entre sí, y están regulados los criterios de reparto de las ayudas en la misma Ley 2/2011. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Undécimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Instrucción y resolución del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El órgano competente para instruir el procedimiento de tramitación de solicitudes es la Dirección General de Trabajo y Salud Laboral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De conformidad con el artículo 7 de las bases reguladoras, las solicitudes de ayudas tiene que resolverlas motivadamente el consejero de Empresa, Empleo y Energía, con la propuesta previa de la directora general de Trabajo y Salud Laboral, y tiene que fijarse con carácter definitivo la cuantía individual de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El plazo máximo para dictar y notificar la resolución es de tres meses a contar desde que acabe el periodo de presentación de solicitudes. Si transcurre este plazo y no se dicta una resolución expresa, la solicitud tiene que entenderse desestimada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La notificación de la resolución se tiene que hacer de acuerdo con las exigencias y en la forma que establecen los artículos 40 y siguientes de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Doceavo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Concurrencia de ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La percepción de las ayudas que establece esta convocatoria es compatible con otras ayudas o subvenciones que reciba la entidad beneficiaria de cualquier Administración pública u otras entidades públicas o privadas que, aisladamente o en concurrencia con estas, sean destinadas a las mismas acciones que son objeto de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En todo caso, cuando las ayudas que establece esta convocatoria se tengan que compatibilizar con otras subvenciones y ambas se concedan a una misma entidad beneficiaria para una finalidad idéntica, el importe no puede alcanzar una cuantía que, aislada o conjuntamente con subvenciones o ayudas de la misma Administración o de otra de diferente o bien otras entidades públicas o privadas, supere el coste de la actividad que el beneficiario tiene que llevar a cabo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimotercero&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Justificación y pago&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. De acuerdo con el artículo 37.2 del Texto refundido de la Ley de Subvenciones, se puede abonar el 75 % de la subvención concedida, una vez que las personas que ocupan las secretarías de los varios órganos de participación institucional de la Consejería de Empresa, Empleo y Energía y del Servicio de Empleo de las Illes Balears certifiquen que se han iniciado las actuaciones que se subvencionan y siempre que la entidad solicitante acredite ante la Consejería de Empresa, Empleo y Energía que no dispone de recursos suficientes para financiar transitoriamente la ejecución de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. De conformidad con el artículo 25.3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;del Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de Finanzas y de las leyes de&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;presupuestos generales de la Comunidad Autónoma de las Illes Balears, en relación con el artículo 37.2 del Texto refundido de la Ley de Subvenciones antes mencionado, el consejero de Empresa, Empleo y Energía puede eximir a la entidad beneficiaria de presentar garantía siempre que concurran circunstancias excepcionales que así lo aconsejen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El 25 % restante del importe de la subvención concedida, o el 100 % en el supuesto de que no se haya concedido el pago anticipado, se abonará a la entidad beneficiaria una vez que esta haya justificado la aplicación de los fondos a la finalidad de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La justificación tiene que realizarse con la aportación de los correspondientes certificados de las personas titulares de las secretarías de los órganos de participación institucional de la Consejería de Empresa, Empleo y Energía y del Servicio de Empleo de las Illes Balears que a continuación se enumeran, que acrediten que las entidades beneficiarias han participado en los órganos indicados, con indicación de las reuniones convocadas y de la asistencia de cada organización empresarial y sindical:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Mesa Social Tripartita de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Comisión Consultiva de la Inspección de Trabajo y Seguridad Social de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Comisión Consultiva de Convenios Colectivos de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Comisión de Seguimiento de las Cláusulas Sociales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Consejo de Salud Laboral de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Consejo de Dirección del Servicio de Empleo de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Comisión Asesora del Servicio de Empleo de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Consejo de Formación Profesional de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Comisión Permanente del Consejo de Formación Profesional de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Consejo de Dirección del Consorcio de la Escuela de Hoteleria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Mesa de Coordinación y Seguimiento del Pacto por la Competitividad y el Empleo de Calidad y el Progreso Social de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Mesa Técnica de Economía, Ocupación y Formación del Pacto por la Competitividad y el Empleo de Calidad y el Progreso Social de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— O cualquier otro órgano que tenga la obligación de asistir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Se puede requerir la entidad beneficiaria para que aporte cualquier otra documentación que se considere necesaria para justificar la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El plazo para justificar el importe de la subvención concedida acaba el día 10 de noviembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimocuarto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son obligaciones de los beneficiarios de las ayudas las establecidas en el artículo 9 de la Orden de bases reguladoras de 4 de mayo de 2005 en relación con el artículo 11 del Texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimoquinto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Revocación, reintegro y devolución voluntaria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El ocultamiento o falseamiento de los datos que sirvieron de base para la concesión de la ayuda por parte del solicitante da lugar a su revocación, al reintegro de las cantidades percibidas y a la exigencia del interés de demora correspondiente, que se meritará desde el momento del pago de la subvención hasta la fecha en que se acuerde la procedencia del reintegro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Igualmente, tienen que reintegrarse las cantidades percibidas y se exigirá el interés de demora meritado en caso de que el beneficiario incurra en alguna de las causas previstas en los artículos&amp;nbsp;36 y 37 de la Ley&amp;nbsp;38/2003 o incumpla las obligaciones y compromisos que establece esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En los procedimientos de reintegro es de aplicación la regulación prevista en los artículos&amp;nbsp;41 y siguientes de la Ley&amp;nbsp;38/2003, y en los artículos&amp;nbsp;94 y siguientes del Real Decreto&amp;nbsp;887/2006.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Así mismo, una vez producidas las circunstancias que provocan un reintegro se puede realizar la devolución voluntaria por parte de beneficiario, sin el previo requerimiento de la Administración, de conformidad con lo establecido en el artículo&amp;nbsp;90 del Reglamento de despliegue de la Ley&amp;nbsp;38/2003, de acuerdo con el modelo de autoliquidación 046 que, a tal efecto, facilite la Agencia Tributaria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Cuando se produzca la devolución voluntaria, la Administración tiene que calcular los intereses de demora de acuerdo con lo previsto en el artículo&amp;nbsp;38 de la Ley&amp;nbsp;38/2003 y hasta el momento en que se produjo la devolución efectiva por parte del beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimosexto&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interpretación y ejecución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El consejero de Empresa, Empleo y Energía puede dictar las resoluciones, circulares e instrucciones que sean necesarias para interpretar y ejecutar esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decimoséptimo&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Publicación de la convocatoria y efectos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Previa a la publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, se comunica el texto de la convocatoria a la Base de datos nacional de subvenciones, con el resto de la información que se requiera, de conformidad con el artículo 29 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre y 20 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta convocatoria empieza a producir efectos a partir del día siguiente de su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
