Mediante la Resolución de la consejera de Presidencia, Función Pública e Igualdad de 19 de diciembre de 2022, por la que se aprueban la convocatoria, las bases, los ejercicios y temario y el baremo de méritos de las pruebas selectivas para el ingreso, por el turno libre y por el turno de promoción interna vertical y por el turno de promoción interna cruzada, incluida la reserva para personas con discapacidad, para cubrir las plazas de personal funcionario en la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 165 de 20 de diciembre de 2022).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El punto 8.5 de las bases específicas de la convocatoria mencionada, establece que si algún aspirante es nombrado personal funcionario de carrera del mismo cuerpo, escala o especialidad a la que opta, en su caso, durante el transcurso de este proceso selectivo, o bien ya tiene esta condición, será excluido, con la correspondiente devolución de tasas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Mediante Resoluciones de la consejera de Presidencia y Administraciones Públicas de 12 de diciembre de 2024, se nombraron respectivamente, funcionarios de carrera del proceso de estabilización por concurso oposición del cuerpo auxiliar y del cuerpo subalterno de la Administración de la Comunidad Autónoma de las Illes Balears y se les adjudica un puesto de trabajo (BOIB núm. 164, de 14 de diciembre de 2024). </span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la administración de la Comunidad Autónoma de las Illes Balears. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Ley 3/2007, de 27 de marzo, de la función pública de la comunidad autónoma de las Illes Balears. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decreto 27/1994, de 11 de mayo, por el que se aprueba el Reglamento de ingreso del personal al servicio de la comunidad autónoma de las Illes Balears. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, y posteriores modificaciones por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Mediante las Resoluciones mencionadas en el número 3 de los hechos de esta Resolución, se nombraron funcionarios de carrera del proceso de estabilización por concurso-oposición del cuerpo auxiliar y del cuerpo subalterno de la Administración de la Comunidad Autónoma de las Illes Balears, las personas que figuran en el anexo de esta Resolución para superar respectivamente el correspondiente proceso selectivo, asimismo, están admitidas y participan en las pruebas selectivas para el ingreso, por el turno libre, incluida la reserva para personas con discapacidad, para cubrir las plazas de personal funcionario de la Administración de la Comunidad Autónoma de las Illes Balears convocadas por Resolución de 19 de diciembre de 2022, por lo que, de acuerdo con el punto 8.5 de las bases específicas de la citada convocatoria deben ser excluidas de este proceso. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente </span></span></p> <p style="text-align:center"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Excluir de forma definitiva a las personas aspirantes que figuran en el anexo de esta Resolución de las pruebas selectivas para el ingreso, por el turno libre, incluida la reserva para personas con discapacidad, para cubrir las plazas de personal funcionario del cuerpo auxiliar y cuerpo de subalterno en la Administración general de la Comunidad Autónoma de las Illes Balears, convocadas por Resolución de 19 de diciembre de 2022 (BOIB núm. 165 de 20 de diciembre de 2022), de acuerdo con el punto 8.5 de las bases específicas de la convocatoria mencionada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Modificar, en los términos establecidos en el anexo de esta Resolución, las listas definitivas de admitidos y excluidos del citado proceso, aprobadas por Resolución de 4 de junio de 2024 (BOIB núm. 79, de 13 de junio de 2024). </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Iniciar los trámites necesarios para la devolución de tasas. </span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Interposición de recursos</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer recurso potestativo de reposición ante la consejera de Presidencia y Administraciones Públicas, en el plazo de un mes a contar a partir del día siguiente de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede interponer un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar a partir del día siguiente que se haya publicado esta Resolución, de acuerdo con los artículos 10.1.a y 46 de la Ley 29/1998, de 13 de julio, reguladora de la
