![CDATA[<div class="WordSection1"> <p><strong>Hechos</strong></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">1. El 26 de diciembre de 2023, en el BOIB núm. 164, se publicó la Resolución del consejero de Empresa, Empleo y Energía de 22 de diciembre de 2023 </span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2024 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a</span><strong> </strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">personas físicas dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR 2024).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. En el BOIB nº. 8, de 16 de enero de 2025, se publicó la Resolución del consejero de Empresa, Empleo y Energía de 14 de enero de 2025, por la que se revocan las subvenciones en el marco de la convocatoria pública de subvenciones para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR2024). La causa de la revocación fue no haber presentado, en el plazo establecido, la justificación requerida para el pago de la subvención aprobada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. Con posterioridad, se ha detectado un error en el anexo de la citada Resolución con respecto a que no constan en la publicación las columnas de importe subvención y CONCE.</span></span></p> <p><strong>Fundamentos de derecho</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas establece que las administraciones públicas pueden rectificar en cualquier momento, de oficio a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, dispone que la rectificación de los errores materiales, aritméticos y de hecho en actas y disposiciones administrativas corresponde al órgano que ha dictado el acto o disposición. Asimismo, la rectificación de errores debe especificar, si procede, los efectos jurídicos que se derivan y debe notificarse o publicarse preceptivamente cuando haga referencia a actos que han sido notificados o publicados</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.
