&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El 24 de octubre de 2022, el promotor solicitó la admisión a trámite y, el 12 de diciembre de 2022, se admitió a trámite la solicitud de autorización administrativa previa del parque fotovoltaico JUNÍPERO SERRA, de 11.800&amp;nbsp;kW, situado en el polígono 13, parcelas 1 y 2, de Sa Pobla, a nombre de RECAP SOLAR MALLORCA, SLU, con NIF B71407456.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El 16 de noviembre de 2022, se notificó al promotor un oficio de deficiencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El 18 de noviembre de 2022, el promotor presentó un escrito para corregir las deficiencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 21 de diciembre de 2022, se dictó la Resolución de admisión a trámite de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El 16 de marzo de 2023, el promotor RECAP SOLAR MALLORCA, SLU, aportó una propuesta de permiso de acceso y conexión para un nuevo parque llamado JUNÍPERO SERRA 2, al mismo polígono y parcela, por una capacidad de 7.500&amp;nbsp;kW. En el mismo escrito solicita la paralización del expediente inicial del parque JUNÍPERO SERRA, de 11.800&amp;nbsp;kW, para hacer un nuevo diseño para incorporarlo como una agrupación fotovoltaica junto con JUNÍPERO SERRA 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El 29 de agosto de 2023, el promotor solicitó la admisión a trámite del parque fotovoltaico JUNÍPERO SERRA 2, de 7.525&amp;nbsp;kW, y aportó, entre otros, una memoria de agrupación de los dos parques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El 15 de septiembre de 2023, y para dar cumplimiento en el artículo 49 de la Ley 10/2019 de cambio climático, en relación con la participación local, el promotor solicitó un cambio de titular de ambos parques a favor de RECAP PV MALLORCA, SL, con NIF B09944224.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El 6 de octubre de 2023, el promotor aportó un nuevo proyecto de la planta y la línea de evacuación, así como un nuevo Estudio de impacto ambiental y arqueológico en sustitución de los anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. El 9 de octubre de 2023, se dictó la Resolución de autorización de la transmisión de titularidad a favor de RECAP PV MALLORCA, SL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. El 17 de octubre de 2023, se dictó la resolución sobre la admisión a trámite de la solicitud de autorización administrativa previa y declaración de proyecto industrial estratégico del parque fotovoltaico JUNÍPERO SERRA 2, de 7.525&amp;nbsp;kW, situado en el polígono 13, parcelas 1 y 2 de Sa Pobla, promovido por RECAP PV MALLORCA, SLU, con NIF B09944224.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El 22 de noviembre de 2023, un particular solicitó la comparecencia al expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. El 19 de diciembre de 2023, el promotor presentó los permisos de acceso y conexión actualizados al nuevo titular RECAP PV MALLORCA, SL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;13. El 21 de diciembre de 2023, el promotor presentó un informe agronómico con un compromiso agrario y solicitó la información pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;14. El 4 de enero de 2024, se notificaron al promotor unas deficiencias que corrigió el 11 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;15. El 30 de enero de 2024, el Grupo Balear de Ornitología y Defensa de la Naturaleza (GOB) solicitó el acceso al expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;16. El 2 de mayo de 2024, se iniciaron las consultas a las administraciones y otras entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;17. El 3 y 4 de mayo de 2024, se publicó, respectivamente, el anuncio en los diarios Ultima Hora y Ahora Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;18. El 7 de mayo de 2024, se publicó en el BOIB n.º 60 el anuncio del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;19. El 21 de mayo de 2024, el Servicio de Cambio Climático y Atmósfera notificó un informe, que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo esto, se considera que el proyecto se alinea con los objetivos de reducción de emisiones y reducción de las emisiones de gases invernadero que marca la Ley 10/2019, de 22 de febrero, de cambio climático y transición energética.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;20. El 24 de mayo de 2024, la Dirección General de Agricultura, Ganadería y Desarrollo Rural emitió un oficio de deficiencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;21. El 31 de mayo de 2024, el Servicio de Protección de Especies de la Dirección General de Medio natural y Gestión Forestal emitió un informe que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Conclusión&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo esto, informo favorablemente sobre la autorización administrativa previa, la declaración de proyecto industrial estratégico y la evaluación de impacto ambiental ordinaria de la agrupación Junípero Serra, ubicada en el polígono 13, parcelas 1 y 2, de Sa Pobla (RE032/22 y RE040/23) con el siguiente CONDICIONANTE:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Para no afectar la reproducción del Milà real, Milvus milvus, especie catalogada En Peligro de Extinción, que nidifica a menos de 500 m del PFV Junípero Serra II, habrá que evitar las tareas generadoras de ruido entre los meses de febrero y junio, ambos incluidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;22. El 3 de junio de 2024, un particular presentó alegaciones al trazado de la línea de evacuación y la implantación del parque.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;23. El 12 de junio de 2024, el promotor aceptó las condiciones del informe del Servicio de Protección de Especies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;24. El 12 de junio de 2024, el promotor aportó documentación para corregir el requerimiento del Servicio de Agricultura de 24 de mayo de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;25. El 17 de junio de 2024, el Servicio de Explotación y Conservación del Consejo de Mallorca notificó un informe que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;[...]&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. De acuerdo con el artículo 31.2 de la Ley 5/1990 de carreteras de la CAIB, será preceptivo el informe del organismo titular de la carretera para la puesta en marcha de cualquier actividad nueva o modificación del existente que surja en el entorno de la carretera y que la pueda afectar directa o indirectamente a las zonas limitadas por unas líneas longitudinales paralelas a las aristas exteriores de la explanación y a una distancia de cincuenta (50) metros en carreteras de dos (2) carriles de las redes primaria y secundaria. Por lo tanto, no es preceptivo informar sobre el parque fotovoltaico Junípero Serra JP1 y parque fotovoltaico Juníper Serra JP1+JP2 para ser más allá de esta distancia de la carretera Mi-3501, así como el trazado de línea de evacuación eléctrica ubicado más allá de esta distancia de las carreteras Mi-3501, Mi-3430 y Mi-3450.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. De acuerdo con el artículo 31.1 de la Ley 5/1990 de carreteras de la CAIB, se define como zona de protección de la carretera la comprendida entre dos líneas longitudinales paralelas a las aristas de explanación y a una distancia de estas de dieciocho (18) metros a las carreteras de dos (2) carriles de las redes primaria y secundaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. De acuerdo con el artículo 33.3.e) de la Ley 5/1990 de carreteras de la CAIB, para la implantación o la construcción de las infraestructuras imprescindibles para la prestación de servicios de interés público como redes de transporte y/o distribución de gas, energía eléctrica, hidráulicas, telecomunicaciones y similares, se pueden autorizar a una distancia no inferior a los TRES (3) metros de la arista de explanación de la carretera, fuera de la zona de dominio público. Por lo tanto, se informa favorablemente del tramo del tendido eléctrico de evacuación paralelo a la carretera Mi-3450 entre PK 2+400 y PK 2+700 por estar fuera de la zona de protección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Según el artículo 33.3.e) de la Ley 5/1990 de carreteras de la CAIB, bajo la calzada, los cruces se tienen que hacer por la solera de las obras de fábrica existentes, en galerías o tubos dispuestos previamente a tal efecto o construidas con medios que no alteren el pavimento; excepcionalmente, se podrán autorizar zanjas en la calzada por razones de urgencia o necesidad, o previamente a una obra de renovación del pavimento existente. Por lo tanto, se informa favorablemente la ejecución de los cruzamientos transversales a las carreteras Mi-3501 PK 1+050 y Mi-3430 PK 2+300 mediante perforación dirigida, no definida completamente a los proyectos presentados, y cumpliendo las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) El trazado en planta tendrá que ser lo más perpendicular posible al tronco de la carretera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) El gálibo mínimo vertical bajo cualquier punto de las diferentes zonas de la plataforma, será de DOS (2) metros medidos desde la clave de la vaina de protección que asegurará mantener el estado tensional del terreno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Los pozos de ataque y recepción, así como arquetas de cambio de dirección, siendo todas ellas no registrables, o hitos delimitadores, se tendrán que situar a una distancia mínima de TRES (3) metros desde la arista exterior de la explanación en carreteras de dos (2) carriles de las redes primaria y secundaria y fuera del dominio público viario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Para profundidades superiores a tres (3) metros se tendrán que alejar los pozos de ataque y recepción, de la arista exterior de la explanación, la misma profundidad excavada o establecer un sistema de contención del terreno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) En ningún caso se afectará otras estructuras e instalaciones existentes, siendo su reposición a cargo del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Finalizados los trabajos, se tendrá que restablecer el terreno en su estado original.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g) A pesar de lo señalado en los puntos anteriores, en caso de producirse un blandón o un peldaño, el Departamento se reserva la potestad durante un plazo de 5 años de exigir la corrección de la anomalía y que se trille un tramo no inferior a 15 metros, extendiéndose una nueva capa de aglomerado asfáltico a toda la anchura de la carretera de las mismas características que el existente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Previamente al inicio de las obras se deberá obtener la pertinente autorización del Departamento de Movilidad e Infraestructuras y tendrán que presentar el correspondiente proyecto constructivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;26. El 17 de junio de 2024, el Ayuntamiento de Sa Pobla&amp;nbsp; informó favorablemente y concluyó:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vistas las consideraciones formuladas en el apartado anterior, conforme a la normativa invocada, se informa favorablemente de la tramitación de la declaración de proyecto industrial estratégico y la evaluación de impacto ambiental encomendera de la agrupación JUNÍPERO SERRA, situada en el polígono 13, parcela 1 y 2, de Sa Pobla; si bien con las observaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sin perjuicio de la normativa de rango superior directamente aplicable, se tendrán que cumplir las condiciones determinadas por las Normas de protección del capítulo 2 de las vigentes NNSS del municipio de Sa Pobla (TR28/09/2006, BOIB núm.173 de 7/12/2006).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Elaboración de un estudio de incidencia paisajística.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sin perjuicio de los informes que determine la tramitación de declaración de proyecto industrial estratégico y evaluación de impacto ambiental, entendemos necesarios los informes sectoriales siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Departamento de Carreteras del Consejo de Mallorca por la afectación de la carretera Ma3430&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicios Ferroviarios de Mallorca por el cruzamiento de las vías del tren con la red eléctrica&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dirección General de Agricultura, Ganadería y desarrollo rural del Gobierno de las Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Departamento de Patrimonio del Consell de Mallorca&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Informe de Medio Ambiente, debido a la afectación de la parcela 2 por APR-incendios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;27. El 17 de junio de 2024, un particular presentó una alegación en relación con la protección de la Cueva de Talapi de Dalt como BIC, y la protección de los encinares. Así mismo, aportó un informe técnico ambiental que analizaba el estudio de impacto ambiental que figuraba en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;28. El 17 de junio de 2024, la Dirección General de Agricultura, Ganadería y Desarrollo Rural emitió un informe favorable condicionado al cumplimiento de las siguientes medidas de compensación y complementariedad:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto todo lo expuesto, y de acuerdo con la Instrucción 1/2023, de 18 de enero de 2023, sobre los criterios para emitir informes para la instalación de parques fotovoltaicos en suelo rústico y vistas las medidas de compensación propuestas, se procede a informar favorablemente para la instalación de la agrupación fotovoltaica Junípero Serra al polígono 13, parcelas 1 y 2 del término municipal de Sa Pobla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;29. El 18 de junio de 2024, un particular presentó una adhesión a las alegaciones presentadas el 17 de junio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;30. El 18 de junio de 2024, la Asociación para la Revitalización de los Centros Antiguos (ARCA) presentó alegaciones al proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;31. El 18 de junio de 2024, se presentaron un total de 1803 firmas contra la instalación del parque fotovoltaico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;32. El 18 de junio de 2024, el Servicio de Transporte y Distribución de esta Dirección General emitió un informe favorable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;33. El 19 de junio de 2024, el promotor contestó a las alegaciones del propietario de la finca situada el polígono 15, parcela 341, de Sa Pobla y aportó unas aclaraciones del perímetro de protección del entorno al paramento/muro II (sector 6) en zona de soterramiento de la línea de evacuación firmado el 12 de junio de 2024 por un arqueólogo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;34. El 21 de junio de 2024, Servicios Ferroviarios de Mallorca (SFM) presentaron un informe favorable que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La situación de la agrupación fotovoltaica respecto a la línea ferroviaria no prevé impactos destacados ni afecciones significativas en relación con su explotación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vistas las competencias de SFM, se informa favorablemente el proyecto del asunto en el marco de la tramitación de la autorización administrativa previa, declaración de proyecto industrial estratégico, y evaluación de impacto ambiental ordinaria que lleva a cabo la Dirección General de Economía Circular, Transición Energética y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Antes de la ejecución de las obras que afectan la zona de dominio público y de protección del ferrocarril, el promotor deberá tramitar la autorización sectorial que otorga la dirección general de Movilidad, presentando la solución de detalle en los puntos de afección al ferrocarril.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;35. El 25 de junio de 2024, el promotor aceptó el informe del Ayuntamiento de Sa Pobla con aclaraciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;36. El 1 de julio de 2024, el Servicio de Ordenación del Territorio del Consejo de Mallorca presentó un informe en qué concluyó:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;[...] no se puede informar del proyecto de agrupación fotovoltaica Junípero Serra dado que falta documentación relevante en cuanto al estudio de incidencia paisajística. No obstante, se pone de manifiesto que desde el punto de vista de la ordenación del territorio y del paisaje, se observan circunstancias y carencias significativas del proyecto y del documento ambiental que suponen que el proyecto pueda resultar de especial incidencia al entorno, dado que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Se tendrá que aportar un estudio de integración paisajística, según la Norma 7 (cuarta) del Plan Territorial Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) En lo referente a la Anejo F del Plan Director Sectorial Energético de las Illes Balears (PDSEIB):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;SOL-B09: el sistema de anclaje tendrá que ser mediante pernos perforadores o sistema equivalente, sin utilización de hormigón.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3) Queda patente que la visibilidad de ambos parques será elevada, así como que la ubicación y orografía de las parcelas propuestas dificulta la efectividad de cualquier posible medida correctora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4) El vallado de los parques tendrán que cumplir las condiciones de integración paisajística de la Norma 22 del Plan Territorial de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5) En relación con los tramos de la línea de evacuación proyectada que transcurren por caminos públicos, se tendrá que dar cumplimiento a la Ley 13/2018, de 28 de diciembre, de caminos públicos y rutas senderistas de Mallorca y Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6) De acuerdo con el puntos 4 y 5 de la disposición adicional decimosexta del PTIM, en lo referente a las afectaciones aeronáuticas, la ejecución de cualquier construcción e instalación requiere un acuerdo favorable previo de la Agencia Estatal de Seguridad Aérea (AESA) en aplicación y en los términos que establezca la normativa vigente de seguridad aeronáutica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7) No se puede emitir ningún pronunciamiento sobre el futuro campo de baterías de almacenamiento debido a la carencia de definición del proyecto sobre este aspecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;37. El 2 de julio de 2024, el promotor presentó un anexo en el Estudio arqueológico firmado el 27 de junio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;38. El 4 de julio de 2024, la Dirección General de Emergencias notificó un informe en qué concluyó:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;[...] se propone informar favorablemente, se recuerda al promotor que tiene que redactar un plan de autoprotección donde recoja e implante medidas de autoprotección de la instalación y definir los accesos y áreas de maniobra de vehículos pesados y tener en cuenta que esta parcela se encuentra colindante a una zona con riesgo de incendio forestal, así como establecer las medidas preventivas según el que prevé el Plan Director Sectorial energético de las Illes Balears (Decreto 33/2015, de 15 de mayo)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;39. El 4 de julio de 2024, el promotor respondió a las alegaciones del 18 de junio de 2024 de particulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;40. El 5 de julio de 2024, se detectó la falta de documentación ambiental que, por error, no se publicó en el web de la Dirección General de Economía Circular, Transición Energética y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;41. El 9 de julio de 2024, el Ayuntamiento de Llubí notificó un informe favorable&amp;nbsp; que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vista la documentación adjunta al archivo facilitado a la carta, proyectos técnicos y documentación relacionada, en cuanto a consideraciones técnicas, quien subscribe informa favorablemente que la Dirección General de referencia continúe con el procedimiento administrativo de autorización administrativa y declaración de utilidad pública, sin perjuicio de las posteriores autorizaciones y permisos necesarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;42. El 26 de julio de 2024, el promotor aportó un anexo al informe agronómico para aclarar que el informe de Agricultura se tiene que modificar para tener en cuenta las modificaciones de superficies y potencias de la agrupación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;43. El 30 de julio de 2024, se notificó en el Ayuntamiento de Sa Pobla una aclaración para que se modifique el informe de 17 de junio de 2024 para que incluyera los dos parques, Junípero Serra y Junípero Serra 2, que forman una agrupación, puesto que en el primer informe solo se mencionaba uno de los dos parques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;44. El 1 de agosto de 2024, el Servicio de Patrimonio Histórico del Consejo de Mallorca emitió un informe favorable que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Consultada la documentación, y sin perjuicio de que se dicten las normas urbanísticas, se propone informar favorablemente el proyecto de referencia con las siguientes prescripciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Además de las medidas implementadas en la memoria de agrupación de los proyectos de referencia, Junípero Serra y Junípero Serra II, se tiene que preservar un corredor de 10 metros paralelo a la valla de pared seca oeste del sector 2, es decir, de la subparcela g, que linda con las parcelas 351, 352 y 354 del polígono 15.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Se tiene que incorporar la solución del topo para la línea de evacuación, aportada por la dirección técnica del proyecto, al proyecto general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Se tiene que llevar a cabo un seguimiento arqueológico en todo lo que haga referencia a excavaciones y movimientos de tierras, tanto en la instalación de la agrupación fotovoltaica como en las líneas de evacuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. En el caso de aparecer restos arqueológicos, se paralizarán las obras y se presentará el correspondiente proyecto de intervención arqueológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cuanto a las consideraciones del arqueólogo director de la prospección, detalla en su informe el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Respetar la era y el antiguo tramo de camino de carro. Dejar un pequeño perímetro de protección (3&amp;nbsp;m de valla con reja).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Dejar un perímetro de protección de unos 3-5&amp;nbsp;m del sector 6, debido a su valor patrimonial, como antigua valla de explotación ganadera y para preservar un entorno ambiental de la cavidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Respetar los tramos de muros de pared seca. En el caso de tener que cruzar canalizaciones, hacerlo por debajo tierra. Si es necesario abrir aperturas para&amp;nbsp; de personal o vehículos, solicitar la autorización pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. A pesar de no localizar ningún yacimiento claro en el área, pero si restos materiales relacionables con el yacimiento 34-02, se considera aconsejable un seguimiento del movimiento de tierras sector 2 (S2) de los trabajos de soterrado de cableados y cimentaciones de los paneles solares para descartar la posibilidad de la existencia de restos sepultados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;45. El 14 de agosto de 2024, el promotor contestó a las alegaciones de ARCA de 18 de junio de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;46. El 3 de septiembre de 2024, el promotor aportó una actualización del proyecto y el Estudio de impacto ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;47. El 11 de septiembre de 2024, el Ayuntamiento de Sa Pobla emitió un nuevo informe que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vistas las consideraciones formuladas en el apartado anterior, conforme a la normativa invocada, se informa favorablemente de la tramitación de la declaración de proyecto industrial estratégico y la evaluación de impacto ambiental encomendera de la agrupación fotovoltaica (AFV), JUNÍPERO SERRA I y II, situada en el polígono 13, parcela 1 y 2 de Sa Pobla; si bien con las observaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sin perjuicio de la normativa de rango superior directamente aplicable, se tendrán que cumplir las condiciones determinadas por las Normas de protección del capítulo 2 de las vigentes NS del municipio de Sa Pobla (TR28/09/2006, BOIB núm.173 de 7/12/2006).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Sin perjuicio de los informes que determine la tramitación de declaración de proyecto industrial estratégico y evaluación de impacto ambiental, entendemos necesarios los informes sectoriales siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servidumbres aeronáuticas – AESA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Departamento de Carreteras del Consejo de Mallorca por la afectación de la carretera Ma3430&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dirección General de Agricultura, Ganadería y desarrollo rural del Gobierno de las Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Departamento de Patrimonio del Consejo de Mallorca&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Servicios Ferroviarios de Mallorca, por el cruzamiento de las vías del tren con la red eléctrica, o Dirección General de Agricultura, Ganadería y Desarrollo Rural del Gobierno de las Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Informe de Medio Ambiente, debido a la afectación de la parcela 2 por APR-incendios&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;48. El 19 de septiembre de 2024, se publicó en lo BOIB n.º 123 de 19 de septiembre de 2024 una ampliación del plazo por el error detectado en la documentación que se expuso en el web de la Dirección General de Economía Circular, Transición Energética y Cambio Climático.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;49. El 20 de septiembre de 2024, se envió a la Dirección General de Armonización Urbanística y Evaluación Ambiental el inicio de la Evaluación de Impacto Ambiental Ordinaria del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;50. El 23 de septiembre de 2024, se detectó un nuevo error en la documentación actualizada expuesta en el web de la Dirección General de Economía Circular, Transición Energética y Cambio Climático, por lo cual se amplió el plazo para que se pudieran formular las alegaciones pertinentes, en el plazo de veinte días contadores a partir del 23 de septiembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;51. El 16 de octubre de 2024, la Dirección General de Agricultura, Ganadería y Desarrollo Rural emitió un segundo informe de aclaración del primero, que concluye:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto todo el expuesto, y de acuerdo con la Instrucción 1/2023, de 18 de enero de 2023, sobre los criterios para emitir informes por la instalación de parques fotovoltaicos en suelo rústico y vista la documentación presentada de acuerdo con la modificación del proyecto inicial y la aneja al informe agronómico, se procede a mantener el informe favorable de 14 de junio de 2024 para la instalación de la agrupación fotovoltaica Junípero Serra al polígono 13, parcelas 1 y 2 del término municipal de Sa Pobla indicando que la nueva superficie ocupada por la agrupación fotovoltaica es de 21,17 ha.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;52. El 17 de octubre de 2024, un particular presentó una alegación a la nueva documentación ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;53. El 6 de noviembre de 2024, un particular presentó una alegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;54. El 11 y el 13 de noviembre de 2024, se reiteró la misma alegación del 17 de octubre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;55. El 14 de noviembre de 2024, el promotor aportó una adenda en el Estudio de impacto ambiental en relación con la actualización del análisis de alternativas de ubicación de la agrupación fotovoltaica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;56. El 10 de diciembre de 2024, la Dirección General de Armonización Urbanística y Evaluación Ambiental envió un informe de deficiencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;57. El 17 de diciembre de 2024, esta Dirección General inició las segundas consultas requeridas por la Dirección General de Armonización Urbanística y Evaluación Ambiental en el informe de deficiencias de 10 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;58. El 16 de enero de 2025, el Servicio de Salud Ambiental de la Dirección General de Salud Pública&amp;nbsp; emitió un informe favorable con las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Cumplimiento de las medidas preventivas y correctoras establecidas en el Estudio de impacto ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Seguimiento de la intensidad de campos electromagnéticos producidos por la instalación (línea de evacuación) y cumplimiento de los valores establecidos en el Real Decreto 1066/2001, de 28 de septiembre, por el cual se aprueba el Reglamento que establece condiciones de protección del dominio público radioeléctrico, restricciones a las emisiones radioeléctricas y medidas de protección sanitaria ante emisiones radioeléctricas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Se tendrá que garantizar que la población más próxima a las instalaciones no esté expuesta en un campo magnético superior a 0,4&amp;nbsp;mT.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Se tendrá que tener un protocolo para el transporte, llenado, mantenimiento y vaciado de equipos que utilicen gas SF6c detección de escapes, actuación en caso de escape accidental y control del consumo anual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;59. El 21 de enero de 2025, el Servicio de Salud Ambiental de la Dirección General de Salud Pública notificó un informe favorable condicionado a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Cumplimiento de las medidas preventivas y correctoras establecidas en el Estudio de Impacto Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Seguimiento de la intensidad de campos electromagnéticos producidos por la instalación (línea de evacuación) y cumplimiento de los valores establecidos en el Real Decreto 1066/2001, de 28 de septiembre, por el cual se aprueba el Reglamento que establece condiciones de protección del dominio público radioeléctrico, restricciones a las emisiones radioeléctricas y medidas de protección sanitaria ante emisiones radioeléctricas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Se tendrá que garantizar que la población más próxima a las instalaciones no esté expuesta en un campo magnético superior a 0,4&amp;nbsp;mT.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Se tendrá que tener un protocolo para el transporte, llenado, mantenimiento y vaciado de equipos que utilicen gas SF6c detección de escapes, actuación en caso de escape accidental y control del consumo anual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;60. El 21 de enero de 2025, el promotor aportó documentación para corregir las deficiencias del 10 de diciembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;61. El 22 de enero de 2025, el promotor solicitó que se formulara la Declaración de impacto ambiental y la continuación del procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;62. El 6 de febrero de 2025, el Servicio de Asesoramiento Ambiental de la Dirección General de Armonización Urbanística y Evaluación Ambiental comunicó la Resolución de inadmisión del recurso administrativo interpuesto por el promotor el 10 de enero de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;63. El 20 de febrero de 2025, el Servicio de Asesoramiento Ambiental de la Dirección General de Armonización Urbanística y Evaluación Ambiental comunicó la solicitud de un informe a la Dirección General de Agricultura sobre la compatibilidad del proyecto con la categoría de suelo rústico (AIA-I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;64. El 5 de marzo de 2025 la Dirección General de Coordinación y Armonización Urbanística de la Consejería de Vivienda, Territorio y Movilidad resolvió formular la declaración de impacto ambiental favorable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;65. Los técnicos del Servicio de Energías Renovables y Eficiencia Energética han examinado la documentación aportada y han emitido un informe favorable, en que se concluye, sin entrar a valorar técnicamente el proyecto, que se han cumplido todos los trámites requeridos en el procedimiento de autorización administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Real Decreto 1183/2020, de 29 de diciembre, de acceso y conexión a las redes de transporte y distribución de energía eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley 2/2020, de 15 de octubre, de medidas urgentes y extraordinarias para el impulso de la actividad económica y la simplificación administrativa en el ámbito de las administraciones públicas de las Illes Balears para paliar los efectos de la crisis ocasionada por la COVID-19.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Real Decreto ley 23/2020, de 23 de junio, por el cual se aprueban medidas en materia de energía y en otros ámbitos para la reactivación económica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El Real Decreto 413/2014, de 6 de junio, por el cual se regula la actividad de producción de energía eléctrica a partir de fuentes de energía renovables, cogeneración y residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El Decreto 96/2005, de 23 de septiembre, de aprobación definitiva de la revisión del Plan Director Sectorial Energético de las Illes Balears, modificado por el Decreto&amp;nbsp;33/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. La Ley 12/2014, de 16 de diciembre, agraria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• 1 centro de maniobra y medida (CMM).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Línea de evacuación soterrada MT de 15&amp;nbsp;kV de 6.449&amp;nbsp;m de longitud y sección 630&amp;nbsp;mm2, hasta la subestación eléctrica SA POBLA, que se sitúa a las coordenadas aproximadas UTM, X: 502.716, Y: 4.401.501, H31).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La instalación se clasifica en el grupo b.1.1 «Instalaciones que únicamente utilizan la radiación solar como energía primaria mediante la tecnología fotovoltaica», de acuerdo con el artículo 2 del Real Decreto 413/2014, de 6 de junio, por el cual se regula la actividad de producción de energía eléctrica a partir de fuentes de energía renovables, cogeneración y residuos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En conformidad con el artículo 130 y los sucesivos del Real Decreto 1955/2000, y en el plazo máximo establecido para cumplir las disposiciones del artículo 1 del Real Decreto ley 23/2020, contador desde la concesión de la autorización administrativa, se deberá presentar un proyecto de ejecución de la agrupación fotovoltaica para que se apruebe, el cual tendrá que cumplir las prescripciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• Cumplimiento de las condiciones de la declaración de impacto ambiental de 5 de marzo de 2025 y las de los informes de las diferentes administraciones consultadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• La validez de esta autorización administrativa previa queda condicionada a la declaración de la agrupación fotovoltaica como proyecto industrial estratégico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de que no se presente el proyecto de ejecución en el plazo establecido, se producirá la caducidad, de acuerdo con el artículo 128 del Real Decreto 1955/2000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este proyecto está sujeto al cumplimiento del artículo 49 de la Ley 10/2019, en lo referente a la oferta de participación local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Informar que esta autorización se concede sin perjuicio de las concesiones y autorizaciones que sean necesarias relativas a las licencias municipales, la ordenación del territorio y el medio ambiente, y a cualesquiera otras motivadas por disposiciones que sean aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Notificar esta resolución al interesado y publicarla en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes contador desde el día siguiente de la publicación, de acuerdo con el artículo&amp;nbsp;124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recurso contencioso-administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de haber recibido la notificación de la Resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
