&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La convocatoria de ayudas especifica que las comunicaciones y las notificaciones se realizarán a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos e importes correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.El 8 de septiembre de 2022, en el BOIB núm. 118, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, de 10 de septiembre de 2015, en la que se incluye a BERNARDO RAMON TORRES (núm. exp. CEJA2021_1/045), con un importe prima de 55.000,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 14 de septiembre de 2022 (con registro de entrada L95E518550) el beneficiario presenta la solicitud del primer pago parcial de la prima (50 %) por el que se realizó un pago por importe de 27.500,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El 25 de junio de 2024 (registro de entrada GOIBE403561), el beneficiario presenta la solicitud del segundo pago y el servicio de gestión de ayudas al Desarrollo Rural revisa el expediente y se comprueba que la explotación no alcanza el mínimo de 1 UTA por ser beneficiaria del complemento de orientación productiva de horticultura y fruticultura de 10.000,00€.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El 24 de enero de 2025 se notifica a la persona interesada a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones, mediante publicación en la página web del FOGAIBA, el informe Propuesta provisional de resolución de la revocación parcial por no cumplir con el complemento de orientación productiva ganadera de 1 UTA de horticultura y fruticultura que había indicado en el plan empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Una vez transcurridos los 10 días hábiles, la persona interesada no ha presentado ninguna alegación .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Esto implica hacer una revocación parcial de 10.000,00 euros, por tanto, el importe de ayuda auxiliable es de 45.000,00 € y el pago correspondiente al 2º tramo será de una cuantía de 17.500,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumple total o parcialmente las obligaciones o los compromisos contraídos de los que está condicionado la eficacia del acto de concesión de los mismos. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.Se ha considerado el Informe Propuesta provisional de resolución de la revocación parcial/Resolución de revocación parcial de la ayuda concedida a BERNARDO RAMON TORRES con NIF ***5868**, de día 22 de enero de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020 .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propuesta de Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, se informa favorablemente y propongo al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Revocar parcialmente las resoluciones de ayuda concedidas a las personas beneficiarias por el importe y con los plazos detallados en el anexo de esta resolución, que es de 1 expediente y que comienza y termina con BERNARDO RAMON TORRES, que suma un importe total de 10.000,00 euros, relativa a la línea de ayuda «Creación de empresas».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.Finalizar el procedimiento de revocación del expediente CEJA2021_1/045.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
