CAIB 9557 250 9556 es CAIB ![CDATA[Resolución del director general del Servicio de Salud de las Islas Baleares por la que se corrigen los errores de la Resolución del director general del Servicio de Salud de las Islas Baleares por la que se nombra personal estatutario fijo y se adjudican plazas a las personas que han superado el concurso-oposición para cubrir plazas vacantes de la categoría enfermero/enfermera del Servicio de Salud convocado por medio de la Resolución de 12 de diciembre del director general del Servicio de Salud de las Islas Baleares]] es 697231 2025-02-22 CAIB 2025-02-20 text/html 2025-02-22 ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.El 18 de febrero de 2025 se publicó en el BOIB núm. 22 la Resolución del director general del Servicio de Salud de las Islas Baleares de 13 de febrero de 2025 por la que se nombra personal estatutario fijo y se adjudican plazas a las personas que han superado el concurso-oposición para cubrir plazas vacantes de la categoría enfermero/enfermera<strong> </strong>del Servicio de Salud convocado por medio de la Resolución de 12 de diciembre de 2022 del director general del Servicio de Salud de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.Se han advertido diversos errores en la Resolución mencionada de 13 de febrero de 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece que «las Administraciones públicas podrán asimismo, rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos».</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares, dispone que la revocación de los actos de gravamen o desfavorables y la rectificación de los errores materiales, aritméticos y de hecho en actos y disposiciones administrativas corresponde al órgano que ha dictado el acto o disposición.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello dicto la siguiente</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Corregir los errores advertidos en la Resolución del director general del Servicio de Salud de las Islas Baleares de 13 de febrero de 2025 en los términos siguientes:</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) En el punto 5 del apartado «Antecedentes» hay que eliminar el texto siguiente:</span></span></p> <ul> <li style="margin-left: 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sra. González Navarro, María José: Concurre en la misma categoría profesional en la que ya tiene un nombramiento como personal estatutario fijo punto 8.2.j de las bases de la convocatoria.</span></span></li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
