El 26 de diciembre de 2023, en el BOIB nº. 164, se publicó la Resolución del consejero de Empresa, Empleo y Energía de 22 de diciembre de 2023 por la que por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2024 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Las personas que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. Las personas que figuran en el anexo de esta Resolución no aportaron toda la documentación requerida para la solicitud de ayudas, de acuerdo con el apartado séptimo de la convocatoria de referencia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. La Dirección General de Economía Circular, Transición Energética y Cambio Climático hizo un requerimiento a las personas que figuran en el anexo, en el que se les solicita la presentación de la documentación pendiente y se les concede un plazo de quince días hábiles para presentarla, además de informarles de que, si no presentaban la documentación mencionada, se procedería a la revocación de la subvención.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Una vez agotado el plazo de justificación establecido en el punto anterior, no constaba en el órgano administrativo que los expedientes que figuran en el anexo hubieran presentado la justificación requerida por el pago de la subvención aprobada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Ley 38/2003, de 17 de noviembre, general de subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La Resolución del consejero de Empresa, Empleo y Energía de 22 de diciembre de 2023 por la que por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2024 para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas en el Programa FEDER 2021-2027 (BOIB núm. 174, de 26 de diciembre de 2022).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. Revocar la concesión de las subvenciones para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 detalladas en el anexo de esta resolución, por los importes que en él se indican.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo con cargo a la partida presupuestaria 2023/G/731A01/78000/00/19701/31111.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Declarar concluido el procedimiento y, por tanto, archivar los expedientes indicados en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Publicar esta Resolución en el <em>Boletín Oficial de las Illes Balears.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos&nbsp;123 y 124 de la Ley&nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo&nbsp;57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">También se puede interponer directamente un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.</span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
