&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;1.&lt;/strong&gt;&amp;nbsp;La Presidencia del Instituto Mallorquín de Asuntos Sociales (en adelante IMAS) mediante Resolución de 13 de enero de 2023, aprobó la convocatoria de la concertación social del servicio de acogida familiar permanente con familia propia, con familia externa (NIU), servicio de seguimiento preadoptivo y postadoptivo (BOIB núm. 9, de 19 de enero de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;2&lt;/strong&gt;. Con fecha 14 de febrero de 2023, la Presidencia del IMAS dictó Resolución de adjudicación de las 560 plazas previstas de dicha concertación en la entidad INSTITUTO DE TRABAJO SOCIAL Y DE SERVICIOS SOCIALES (INTRESS) con CIF núm. G08973224 (BOIB núm.24 de 23 de febrero de 2023)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;3&lt;/strong&gt;. En la misma fecha se formalizó el Acuerdo de acción concertada con la entidad INTRESS, el cual en la cláusula tercera prevé &lt;em&gt;&amp;quot;La vigencia de este concierto será de dos años, con fecha de inicio día 15 de febrero de 2023, y se podrá ampliar y renovar por el mismo plazo.&amp;quot;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;4&lt;/strong&gt;. Por ello, el 14 de febrero de 2025 finaliza la vigencia el Acuerdo de acción concertada firmada. Por este motivo, desde la Dirección Insular de Servicios Sociales, Infancia y Familia, en fecha de 10 de enero de 2025, se ha emitido informe de necesidad (K9AA CE3T M7PU MQDL H22N), solicitando la tramitación de la renovación de la concertación por un plazo de dos anualidades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Este informe ha sido complementado por el informe emitido en fecha de 24 de enero de 2025 por esta Dirección Insular (K9AA CHFH X3QH YXXN NXJR). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;5.&lt;/strong&gt; El 11 de enero de 2025 la Presidencia del IMAS resolvió iniciar el expediente para la renovación de dicha concertación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;6. &lt;/strong&gt;El 15 de enero de 2025 el Servicio de Gestión Económica emitió informe calculando el gasto de esta renovación en 2.600.908,80 €. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;7. &lt;/strong&gt;Dado el carácter plurianual del expediente, el Servicio de Contabilidad y Presupuestos ha emitido informe favorable de autorización al gasto en fecha de 21 de enero de 2025, con cargo a la partida presupuestaria 50.23151.26000.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;8.&lt;/strong&gt; La entidad INTRESS manifestó el 13 de enero de 2025, su conformidad con la renovación de dicho concierto por un periodo de dos anualidades, y que continúa cumpliendo con los requisitos exigidos para la concertación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;9.&lt;/strong&gt; Por parte del Servicio de Autorizaciones, Acreditación, Registro e Inspección de Servicios Sociales, en fecha 18 de enero de 2025 informó que la acreditación para este servicio por parte de INTRESS continúa vigente, así como de la inexistencia de expediente sancionador en materia de servicios sociales por infracciones de las que constan en los artículos 128 y 129 de la Ley 4/2009, de Servicios Sociales de las Islas Baleares durante los últimos 24 meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;10.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; El Servicio Jurídico-Administrativo y la Intervención delegada del IMAS han emitido sendos informes favorables a la renovación de la concertación social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Consideraciones jurídicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En cuanto a la competencia,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOIB núm. 32 ext., de 1 de marzo de 2007; corrección de errores BOIB núm. 29, de 28 de febrero de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;2.&lt;/strong&gt; La Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social (BOIB núm. 135, de 10 de noviembre de 2001 y BOE núm. 284, de 27 de noviembre de 2001).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;3.&lt;/strong&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (&lt;em&gt;BOIB&lt;/em&gt; núm. 89 de 18 de junio de 2009 y BOE núm. 163 de 7 de julio de 2009) prevé en el artículo 27 y en la disposición final cuarta, que cada Consejo Insular, en el marco de sus competencias, debe definir las prestaciones propias de servicios sociales, Complementando la cartera básica de servicios sociales que aprueba el Gobierno de las Islas Baleares, que fue aprobada mediante el Decreto 32/2023, de 26 de mayo, por el que se aprueba la Cartera básica de servicios sociales de las Islas Baleares 2023-2027, se establecen principios generales para las carteras insulares y locales y se modifican diversas normativas del ámbito social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;4. &lt;/strong&gt;Decreto de la Presidencia del Consell de Mallorca, de 10 de julio de 2023, por el que se crean los departamentos que deben estructurar el gobierno (&lt;em&gt;BOIB&lt;/em&gt; núm. 95, de 11 de julio de 2023), entre los que se encuentra el Departamento de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;5. &lt;/strong&gt;Decreto de la Presidencia del Consell de Mallorca por el que se nombran los miembros del Consejo Ejecutivo de 10 de julio de 2023 (&lt;em&gt;BOIB&lt;/em&gt; núm. 95, de 11 de julio de 2023) por el que se nombra al Sr. Guillermo Sánchez Cifre consejero ejecutivo de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;6. &lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; núm. 67, de 18 de mayo de 2019). No obstante, y de acuerdo con el artículo 8.2.1 las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física u otra causa legal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En cuanto al fondo,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;7.&lt;/strong&gt; La Cartera Insular de Servicios Sociales y de los Servicios a Menores y Familia de Mallorca aprobada definitivamente en Pleno del Consell de Mallorca de 13 de julio de 2017 (BOIB núm. 97, de 18 de julio de 2017 y corrección de errores materiales publicada BOIB núm. 161, de 30 de diciembre de 2017) y prorrogada su vigencia hasta el 31 de diciembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;8. &lt;/strong&gt;La Directiva 2014/24/UE del Parlamento Europeo y del Consejo, de 26 de febrero de 2014, sobre contratación pública (DOUE núm. 94, de 28 de marzo de 2014).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;9.&lt;/strong&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares que regula el régimen de concertación en los artículos 89 y siguientes (BOIB núm. 89 de 18 de junio de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;10.&lt;/strong&gt; La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Islas Baleares (BOIB núm. 146 de 22 de noviembre de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;11. &lt;/strong&gt;El Decreto 48/2017, de 27 de octubre, (BOIB número 132 de 28 de octubre de 2017) por el que se establecen los principios generales a los que deben someterse los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;12. &lt;/strong&gt;La Ley 3/2018, de 29 de mayo, del tercer sector de acción social (BOIB núm. 67, de 31 de mayo de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;13. &lt;/strong&gt;Resolución de la Presidencia del IMAS de 13 de enero de 2023, de aprobación de la convocatoria de la concertación social del servicio de acogida familiar permanente con familia propia, con familia externa (NIU), servicio de seguimiento preadoptivo y postadoptivo (BOIB núm. 9, de 19 de enero de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;14.&lt;/strong&gt; Resolución de la Presidencia del IMAS, de 14 de febrero de 2023, por la que se adjudicaron las plazas de la concertación social del servicio de acogida familiar permanente con familia propia, con familia externa (NIU), servicio de seguimiento preadoptivo y postadoptivo (BOIB nº 24 de 23 de febrero de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En cuanto al procedimiento, además de la normativa antes citada,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;15.&lt;/strong&gt; La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (BOE núm. 236, de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;16. &lt;/strong&gt;El artículo 214 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto refundido de la Ley reguladora de las Haciendas Locales, y considerando el acuerdo de aprobación del régimen de fiscalización e intervención limitada previa de requisitos básicos y toma de razón en ingresos del Consell Insular de Mallorca y de las entidades de su sector público sujetas a función interventora de fecha 12 de diciembre de 2019, el expediente debe ser sometido a la Intervención delegada del IMAS para la emisión del preceptivo informe de fiscalización previa ( BOE núm. 59 de 9 de marzo de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Primero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;RENOVAR el Acuerdo de acción concertada del&lt;/span&gt; servicio de acogida familiar permanente con familia propia, con familia externa (NIU), servicio de seguimiento preadoptivo y postadoptivo&lt;span style="background-color: rgb(255, 255, 255)"&gt;, firmado con&lt;/span&gt; la entidad INSTITUTO DE TRABAJO SOCIAL Y DE SERVICIOS SOCIALES (INTRESS) con CIF núm. G08973224&lt;span style="background-color: rgb(255, 255, 255)"&gt;, para el periodo comprendido entre &lt;/span&gt;15 de febrero de 2025 y 14 de febrero de 2027;&lt;span style="background-color: rgb(255, 255, 255)"&gt; así como AUTORIZAR y DISPONER a favor de esta entidad un gasto por importe total máximo de &lt;/span&gt;2.600.908,80 €&lt;span style="background-color: rgb(255, 255, 255)"&gt; (IVA exento) , con cargo a la partida presupuestaria &lt;/span&gt;50.23151.26000&lt;span style="background-color: rgb(255, 255, 255)"&gt; del presupuesto de gasto del IMAS, según el siguiente detalle:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Cuarto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;COMUNICAR esta Resolución a la&lt;/span&gt; Dirección Insular de Servicios Sociales, Infancia y Familia&lt;span style="background-color: rgb(255, 255, 255)"&gt;, a la Intervención delegada y al Servicio de Contabilidad y Presupuestos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, deacuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consell Insular de Mallorca, dentro del plazo de un mes, contador a partir del día siguiente al de la notificación de la presente resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación del citado recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;No obstante, lo anterior, puede ejercitarse, en su caso, cualquier otro recurso que se estime pertinente. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
