    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública, por delegación del Consejo Ejecutivo, según el Acuerdo de 28 de septiembre de 2022, BOIB núm. 128, de 1 de octubre de 2022, de conformidad con lo dispuesto en el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el BOIB nº. 119, de 10 de septiembre de 2022 se publicó el convenio firmado con el Ayuntamiento de Pollença, por el que el Consell de Mallorca se encargaba de la aprobación de las bases, la convocatoria y la gestión de los procesos de estabilización de la ocupación temporal que establece la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la por el Ayuntamiento de Pollença (BOIB núm. 65, de 19 de mayo de 2022 y BOIB núm. 68, de 26 de mayo de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el BOIB nº. 133, de 10 de octubre de 2024 se publicó la aprobación de la prórroga por un año de la vigencia del convenio relativo al encargo de gestión del Ayuntamiento de Pollença, a favor del Consell de Mallorca, que ratificó con fecha de finalización de la prórroga de 7 de septiembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB núm. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 7 de febrero de 22 núm.19, de fecha 11 de febrero de 2023), por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 29 de agosto de 2023 (BOIB núm. 2024 (BOIB núm. 130, de 3 de octubre de 2024; BOIB núm. 147, de 9 de noviembre de 2024), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo del subgrupo C1 y ofrecimiento de puestos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En esta resolución se convocó 1 plaza de la categoría/especialidad de Administrativo del Ayuntamiento de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En fecha 13 de noviembre de 2024 el Tribunal calificador, una vez concluidas la revisión y baremación de los méritos de los aspirantes, aprobó la lista definitiva de puntuaciones obtenidas por las personas aspirantes, con aplicación de los criterios de desempates y la resolución de las alegaciones formuladas en la lista provisional de puntuaciones, así como la relación de lugares correspondientes a las plazas convocadas, dando un plazo de siete días hábiles para comunicar el orden de preferencia de los puestos ofrecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. De conformidad con el punto 8.8 de las bases específicas de la convocatoria, una vez asignados los puestos de trabajo ofertados, por Acuerdo de fecha 10 de diciembre de 2024 el Tribunal elevó al consejero ejecutivo de Hacienda y Función pública la propuesta de la persona aspirante que ha superado el proceso selectivo de concurso de méritos para el Pollença, con asignación de puestos de trabajo para su contratación como personal laboral fijo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Mediante Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 11 de diciembre de 2024 (BOIB núm. 164, de 14 de diciembre de 2024), se aprobó la lista definitiva de personas aspirantes que han superado el proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo del subgrupo C1 y ofrecimiento de puestos de trabajo en la categoría/especialidad de Administrativo-va del Ayuntamiento de Pollença, con asignación de puestos de trabajo para su contratación como personal laboral fijo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Una vez se notificó la publicación de la Resolución en el Ayuntamiento de Pollença, sin que la Alcaldía haya dictado la resolución para la contratación como personal laboral fijo, con la correspondiente adjudicación del puesto de trabajo y publicación en el BOIB; en fecha 19 de diciembre de 2024 la señora Joana Estades Siquier, con opción a adjudicación de plaza en esta categoría , renunció a su participación en la convocatoria correspondiente; por lo que el Tribunal calificador debe acordar la adjudicación a la siguiente persona por orden de prelación de la lista definitiva de puntuaciones de méritos del proceso, doña Laura Pons Cifre .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Mediante Resolución del consejero ejecutivo de Hacienda y Función Pública de 24 de enero de 2025 se aprobó que la señora Joana Estades Siquier quedaba excluida para el ingreso como personal laboral fijo de la categoría de Administrativo del subgrupo C1 del Ayuntamiento de Pollença, con indicación de la causa de exclusión&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. De conformidad con la base 8.8 de la convocatoria, con el fin de asegurar que se cubran las plazas convocadas, cuando haya renuncias de aspirantes seleccionados antes del nombramiento o la presa de posesión, el tribunal tiene que elevar al órgano convocando una relación complementaria de los aspirantes que estén situados a continuación de las personas propuestas, por orden de puntuación, para un posible ingreso como personal laboral fijo en sustitución de quienes renuncien.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. En fecha 5 de febrero de 2025 el Tribunal calificador competente del procedimiento selectivo ha acordado elevar al consejero de Hacienda y Función Pública el Acuerdo por el que se modifica la propuesta de las personas aspirantes por orden de prelación que ha superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo de la categoría/especial del Ayuntamiento de Pollença, con asignación del puesto de trabajo para su contratación como personal laboral fijo .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 91.1 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 68 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La ley 20/2021 de 28 de diciembre de medidas urgentes para la reducción de la temporalidad en el empleo público&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La ley 4/2022, de 28 de junio de consells Insulars&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El artículo 4 del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 30 de noviembre de 2022 (BOIB núm. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023 y de fecha 8 de febrero de 22 núm. 19, de fecha 11 de febrero de 2023), por Resolución de la consejera ejecutiva de Hacienda y Función Pública de fecha 29 de agosto de 2023 (BOIB núm. 121, de 31 de agosto de 2023), por Resolución del consejero ejecutivo de Hacienda Función Pública 130, de 3 de octubre de 2024), y por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 7 de noviembre de 2024 (BOIB núm. 147, de 9 de noviembre de 2024), se aprobó la convocatoria del proceso selectivo por el sistema excepcional de concurso de méritos para el ingreso como personal laboral fijo del subgrupo C1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman, Times, serif"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Aprobar &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;la modificación de la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal laboral fijo del subgrupo C1 en la categoría/especialidad de Administrativa del subgrupo C1 del Ayuntamiento de Pollença, de acuerdo con lo que se indica en el &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Anexo 1&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, con indicación de la asignación del puesto de trabajo a la señora Laura Pons Cifre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Asignar &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;el puesto de trabajo correspondiente a la categoría/especialidad de Administrativa del subgrupo C1 del Ayuntamiento de Pollença, a la señora Laura Pons Cifre por el puesto de trabajo L2-10, manteniendo el orden de preferencias efectuado y la puntuación obtenida en el proceso selectivo publicado en el BOIB. De conformidad con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta convocatoria contiene, como máximo, a tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Ordenar &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;la publicación de esta Resolución y su Anexo en el tablón de edictos y en la Sede electrónica del Consell Insular de Mallorca, y en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra este acto, que no pone fin a la vía administrativa, puede interponer recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de recibir esta notificación. El recurso puede interponerse formalmente ante el Consejo ejecutivo o ante la Comisión de gobierno del Consell insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, a contar a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de alzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y puede interponer el recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de seis meses, a contar a partir del día siguiente de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante lo anterior, puede interponer, si procede, cualquier otro recurso que considere oportuno. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
