En fecha 30 de enero de 2024 se publicó, en el Boletín Oficial de las Islas Baleares (BOIB) núm. 15, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 25 de enero de 2024, por la que se aprueba la convocatoria para el año 2024 de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas en las Islas Baleares.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. De conformidad con el apartado sexto de la resolución anterior, modificada por Resolución del presidente del FOGAIBA de 2 de julio de 2024 y publicada en el BOIB núm. 88 de 4 de julio, de determinadas ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC) para el año 2024, el plazo de presentación de solicitudes de determinadas intervenciones en el desarrollo rural se modificó. Este nuevo plazo de presentación terminó el día 15 de junio de 2024 y tuvieron entrada en el registro del FOGAIBA un total de 1298 solicitudes de ayuda de pago compensatorio para zonas con limitaciones específicas en las Islas Baleares.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados que figuran en el Anexo I no cumplen por ejemplo el requisito previsto en el punto 1.b) del apartado Tercero de la convocatoria, cumplir con la condición de agricultor no pluriactivo. </span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Fundamentos de derecho</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 25 de enero de 2024 por la que se aprueba la convocatoria para el año 2024 de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas, publicada en el BOIB núm. 15 de día 30 de enero de 2024. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Denegar las solicitudes presentadas por los interesados relacionados en el Anexo I, por incumplimiento del/os requisito/s indicado/s.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. La presente propuesta provisional de resolución debe comunicarse a las personas interesadas informándoles de que disponen de un plazo máximo de 10 días hábiles, a contar desde el día siguiente de la notificación de esta propuesta para presentar alegaciones y /o aportar documentos. En caso de no hacer uso de su derecho a alegar, en el plazo indicado, o si manifiesta su decisión de no efectuar alegaciones ni aportar nuevos documentos o justificaciones, esta propuesta tendrá carácter definitivo, y se elevará al vicepresidente en materia agraria del FOGAIBA para que dicte la Resolución de denegación correspondiente. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3.
