&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Antecedentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, para el año 2024, subvenciones para inversiones en explotaciones del sector de los frutos secos.&lt;/p&gt;

&lt;p&gt;2. De conformidad con el apartado segundo de la mencionada modificación de Resolución, el plazo de presentación de solicitudes acabó el día 31/05/2024.&lt;/p&gt;

&lt;p&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/p&gt;

&lt;p&gt;4. Corresponde proponer para denegar los expedientes señalados al Anexo Y por los motivos indicados al mencionado anexo.&lt;/p&gt;

&lt;p&gt;5. El día 28 de noviembre de 2023 el Servicio de Ayudas al Desarrollo Rural ha emitido el informe propuesta de resolución de concesión desfavorable y propuesta provisional de denegación de la ayuda a los interesados relacionados al anexo adjunto.&lt;/p&gt;

&lt;p&gt;6. En fecha 3 de diciembre de 2024 se notificó, mediante publicación en la llanura web del FOGAIBA, la mencionada propuesta provisional a los interesados, concediéndolos un plazo de 10 días para presentar las alegaciones oportunas.&lt;/p&gt;

&lt;p&gt;7. Una vez finalizado el plazo por alegaciones, los interesados relacionados en el anexo adjunto no cumplen con algunos de los requisito de la convocatoria.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares&amp;nbsp;(FOGAIBA) por la cual se convocan, para el año 2024, subvenciones para inversiones en explotaciones del sector de los frutos secos.&lt;/p&gt;

&lt;p&gt;2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la cual se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Ba&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;leares 2014-2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Ley 39/2015 de 1 de octubre de régimen jurídico de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Resolución &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Por todo esto, se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/p&gt;

&lt;p&gt;1. Denegar la ayuda solicitada por los interesados que figuran al Anexo I , que son un total de 2 expedientes y que empieza con BARTOLOMÉ ADROVER SALVA y acaba con AL PARICO SL., relativa a la línea de ayudas “ Inversiones a las explotaciones del sector de los frutos secos ”, por no cumplir requisitos que se establecen a la convocatoria y que se especifican al mencionado anexo.&lt;/p&gt;

&lt;p&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo adjunto.&lt;/p&gt;

&lt;p&gt;3. Publicar esta resolución en el Boletín Oficial de las Islas B&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;aleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio natural, en el plazo de un mes, contador desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
