&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Carolina Escandell Ferrer, consejera ejecutiva del Departamento de Bienestar Social, Familia e Igualdad del Consejo Insular de Ibiza, de conformidad con el Decreto de Presidencia n.º 2023000472, de 28 de junio de 2023, de nombramiento de las personas miembros del Consejo Ejecutivo y de las Vicepresidencias del Consejo Insular de Ibiza (BOIB núm 88, de 29 de junio de 2023) y en ejercicio de las atribuciones previstas en el artículo 33.y de la Ley 4/2022, de 28 de junio, de Consejos Insulares, y el artículo 72 del Reglamento Orgánico del Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Tomás Alías Aguiló decano del Colegio Oficial de Fisioterapeutas de las Islas Baleares, con domicilio en la calle Camp Redondo nº3b bajos Palma, con NIF número Q-0700396- E, de conformidad con la resolución del BOIB número 155, de 21 de diciembre de 2000, por el cual se publica la composición de la Junta de Gobierno del COFIB a la Consejería de Presidencia, inscrita al Registro de Colegios Profesionales de Baleares el 13 de diciembre de 2000, y actuante en virtud de las atribuciones que le atribuye los Estatutos colegiales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Ambas partes se reconocen mutuamente la capacidad necesaria para formalizar este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;1. El derecho a la protección de la salud está reconocido en el artículo 43 de la Constitución Española de 1978 como uno de los principios rectores de la política social y económica. En el apartado 2 de este artículo se prevé que corresponde a los poderes públicos organizar y tutelar la salud pública por medio de medidas preventivas y las prestaciones y los servicios necesarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2. El Estatuto de Autonomía de las Islas Baleares, según la redacción dada por la Ley Orgánica 1/2007, de 28 de febrero, que reformó el dicho estatuto, establece en el arte. 12 los principios rectores de la actividad pública, y dispone que las instituciones propias de la comunidad autónoma tienen que promover, entre otros, la cohesión social y el derecho a la salud, la educación y la protección social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;3. El Consejo Insular de Ibiza ejerce competencias en materia de servicios sociales, asistencia social y seguridad social, en virtud de las atribuciones que efectuaron la Ley 12/1993, de 20 de diciembre, y la Ley 14/2001, de 29 de octubre, en los términos y en el alcance que se establecen. Así mismo gestiona el Hospital Residencia Asistida de Caso Sierras que es un centro sociosanitario dependiendo de la referida Corporación, con la categoría de hospital, que dispone de un equipo sanitario formado por diferentes profesionales del ámbito sanitario, entre los que se encuentran los fisioterapeutas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;4. El Colegio Oficial de Fisioterapeutas de las Islas Baleares tiene como función en sus Estatutos, entre otros: k) Organizar actividades y servicios comunes de carácter profesional, cultural, asistencial, de previsión y otros análogos, así como de formación y perfeccionamiento de los colegiados (artículo 10.k).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Y, además, contempla concretamente que organizará aquellas actividades que crea oportunas para el perfeccionamiento profesional y científico de los colegiados (artículo 11).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;5. Ambas entidades reconocen expresamente que la formación es un herramienta esencial y necesaria en la promoción de la salud y en el bienestar social para mejorar la atención sanitaria y sociosanitaria de los habitantes de la isla de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;En virtud de todo el expuesto, ambas partes otorgan este convenio con sujeción a las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;Cláusulas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;1. Objeto del convenio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El objeto de este convenio es establecer el marco para regular la colaboración entre el Consejo Insular de Ibiza y el Colegio Oficial de Fisioterapeutas de las Islas Baleares, para el desarrollo de programas/actividades/cursos de formación para que los profesionales con la categoría fisioterapeutas, adquieran competencias específicas propias de su profesión para mejorar la atención sanitaria y sociosanitaria, mostrarse en aprendizaje continuo en beneficio de la calidad en las curas de las personas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;A tal efecto, el Colegio Oficial de Fisioterapeutas de las Islas Baleares destinará un porcentaje de las plazas de los cursos a la formación para el personal del Hospital Residencia Asistida de Cas Serres y el Consejo pone a disposición del Colegio Oficial de Fisioterapeutas de las Islas Baleares la sala de formación/salón de actas ubicada en la cuarta planta del Hospital Residencia Asistida de Cas Serres que se encuentra dotada con: un proyector y pantalla de proyección, un televisor, 30-40 sillas con brazo por escritura y dos tablas de madera rectangular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La utilización de la instalación referida anteriormente se ajustará al que dispone el presente acuerdo de colaboración y, en ningún supuesto se podrá superar la capacidad de aforo de la sala.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Solo se podrán hacer actividades relacionadas con la formación de los profesionales a través de una formación acreditada y las actividades formativas se impartirán en días laborables; si bien, excepcionalmente con la autorización de la dirección del Hospital Residencia Asistida Cas Serres se podrán realizar en fin de semana o día festivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El Colegio Oficial de Fisioterapeutas de las Islas Baleares si es el organizador y el único responsable de las actividades de formación que se lleven a cabo, de tal manera que el Consejo Insular de Ibiza ni dirige las actividades a realizar, ni las encomienda, ni las presta indirectamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Para utilizar la sala, el referido Colegio presentará una solicitud de utilización con una antelación mínima de un mes a la realización de la actividad, donde conste el programa de la actividad formativa a realizar, la fecha y la persona responsable de la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La solicitud de utilización de una fecha determinada no implica necesariamente la obligación por parte del Consejo Insular de acceder a esta petición, siente la decisión de uso una facultad de la Dirección del Hospital Residencia Asistida de Cas Serrres, que en caso de no poder ser utilizada velará para encontrar una solución en beneficio de realización de la actividad formativa prevista.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;2. Compromisos de las partes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;2.1 Por parte del Consejo Insular de Ibiza&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a)Informar al personal del Hospital Residencia Asistida de Cas Serres de la firma del presente convenio para la participación en la formación que organice el Colegio Oficial de Fisioterapeutas de las Islas Baleares en el marco del presente acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) Facilitar la utilización de sus recursos y dispositivos asistenciales/generales del centro para el cumplimiento de los cursos que en cada caso se establezcan, de forma que se pueda realizar adecuadamente la formación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c) Se hará responsable de los servicios de limpieza necesarios previa, durando y posteriormente a la celebración de las formaciones/cursos solicitados. Así mismo será responsable de facilitar el uso de los sistemas de conexión en línea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;d) No se hará responsable de los objetos materiales que la entidad colaboradora deposite a la instalación, ni asumirá, en ningún caso, la condición de depositario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;a) Formalizar un seguro por accidentes de las personas que participen en la formación, así como un seguro por los daños a tercero que se suban producir en el desarrollo de su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;b) Convocar y seleccionar el alumnado que realizará la formación programada por el mismo Colegio, y comunicar con la antelación debida, los contenidos y objetivos de la formación a impartir, y los datos de las personas que como alumnas participarán en la formación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;c) Facilitar a las personas que resulten admitidas a la formación información sobre: la duración, calendario, horario y lugar de la formación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;d) Velar para que la utilización de la sala, no afecte al funcionamiento normal del centro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;e) Asumir la responsabilidad de la utilización correcta, tanto de la sala como del inmueble en el que está ubicada esta sala, como de las equipaciones que se encuentran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;f) Adoptar las medidas necesarias para garantizar que el alumnado conoce las normas propias del Hospital Residencia Asistida Cas Serres, así como que las cumpla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;g)Expedir los certificados acreditativos de la formación a las personas que participen como a los profesionales que impartan la formación. para los profesionales responsables que acudan a la formación planificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;h) Organizar y coordinar actividades de formación para los profesionales del Hospital Residencia Caso Sierras que faciliten el intercambio de experiencias entre otros profesionales otros centros y el profesorado universitario, intensificando canales de colaboración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;y) Facilitar la participación de los profesionales del Hospital Residencia Asistida de Cas Serres en aquellos cursos, congresos, jornadas y otras actividades organizados por el Colegio Oficial de Fisioterapeutas de las Islas Baleares, que supongan una posibilidad de mejora del desarrollo profesional y como parte de su formación continuada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;A tal efecto se reservará un 25% de plazas para poder ser ocupadas bajo las circunstancias anteriores. En caso de no ser posible, queda a disposición de la comisión mixta de seguimiento delimitar las circunstancias y condiciones de las plazas mencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;j) Compromiso de no podrá registrar la actividad ni retransmitirla por/en ningún medio de comunicación audiovisual sin autorización escrita de la dirección del Centro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;k) Se compromete que dentro de su planificación anual formativa a incluir cursos relacionados con la visión y la política de gestión del Hospital Residencia Cas Serres, así como en el modelo de asistencia sociosanitaria centrada en la persona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;l) Se hace responsable de cualquier tipo de reclamación que se pueda formular por parte de las personas que participan en la formación en relación con el objeto de este convenio, y exime expresamente de cualquier tipo de responsabilidad al Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;3. Gastos económicos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;La suscripción del presente convenio no genera ningún compromiso de gasto entre las partes firmantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;4. Protección de datos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;A efectos del que establece la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de derechos digitales, las partes firmantes se comprometen al cumplimiento de su obligación de protección, guarda y secreto de los datos de carácter personal que se utilicen con motivo de este convenio y adoptarán las medidas necesarias para evitar la alteración, la difusión o el acceso no utilizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;5. Comisión de seguimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Se crea una comisión de seguimiento del convenio, que tiene que velar por el cumplimiento de los compromisos que asumen las partes y tiene que resolver cualquier duda o incidencia que surja de la interpretación del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Este comisión estará integrada por los siguientes miembros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;-Uno/a profesional designado/ada por el Consejo Insular de Ibiza&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;-Uno/a profesional designado/ada por el Colegio Oficial de Fisioterapeutas de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;6. Validez, renovación y rescisión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El presente acuerdo de colaboración entrará en vigor a partir de la fecha de su firma y tendrá una validez de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;No obstante la duración inicialmente pactada, el convenio podrá ser prorrogado en cualquier momento antes de la finalización del plazo previsto anteriormente, por acuerdo exprés de las partes por periodos anuales hasta un máximo de cuatro años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;De conformidad con el establecido en al Ley 40/2015 de 1 de octubre, de régimen jurídico del sector público, los convenios se extinguen por el cumplimiento de las actuaciones que constituyen su objeto o para incurrir en causa de resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Son causas de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- El transcurso del plazo de vigencia del convenio sin haber acordado la prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Mutuo acuerdo de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- El incumplimiento por parte de cualquier de las partes de sus obligaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- La imposibilidad legal o material de cumplir con las actividades que constituyen el convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Renuncia de cualquier de las partes, realizada por escrito con una antelación de dos meses antes de la fecha de vencimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Por resolución judicial determinantes la nulidad del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;- Por las causas generales establecidas a la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;7. Normativa aplicable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Este convenio de colaboración tiene naturaleza que prevé el artículo 6.1 de la Ley 9/201, de 8 de noviembre, de contratos del sector público, por la cual se trasponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consejo de Europa 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014, y por tanto está excluido del ámbito de su aplicación, y se tiene que regir por sus cláusulas y por las normas administrativas que estén de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;El contenido del presente convenio de colaboración se encuentra sometido al que prevé los artículos 47 y siguientes de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;&lt;strong&gt;8. Resolución de conflictos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Cualquier controversia que pueda surgir de la aplicación, la interpretación o la ejecución de este acuerdo de colaboración se resolverá de mutua acuerdo entre las partes, y sino es así, se someterán a las decisiones de los juzgados y tribunales de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(51, 51, 51)"&gt;Y en prueba de conformidad, ambas partes firman este convenio de colaboración a la fecha de la firma electrónica&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;]]</env:contingut>
