&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 23 de diciembre de 2024, firmó la siguiente resolución: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Con fecha 30 de enero de 2024 se publicó, en el BOIB nº. 15, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 25 de enero de 2024, por la que se aprueba la convocatoria para el año 2024 de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas en las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Con fecha 30 de enero de 2024 se publicó, en el BOIB nº. 15, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 25 de enero de 2024, por la que se aprueba la convocatoria para el año 2024 de las ayudas destinadas al pago compensatorio para zonas de montaña en las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. De conformidad con los apartados sexto de ambas resoluciones, y de la Resolución de modificación del Presidente del FOGAIBA de 2 de julio de 2024 publicada en el BOIB 88 de 4 de julio, de determinadas ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC) para el año 2024, se modifica el plazo de presentación de solicitudes de determinadas intervenciones en el desarrollo rural. El nuevo plazo de presentación de solicitudes de las convocatorias terminó el 15 de junio de 2024, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 1298 solicitudes de ayuda de limitaciones específicas y 252 de ayuda de montaña.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de estas ayudas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Con fecha 3 de septiembre de 2024 se notifica, mediante publicación en el BOIB núm. 115 un requerimiento de documentación concediendo un plazo de 10 días para aportar la documentación solicitada, informando que transcurrido este plazo se darán por desistidas las solicitudes de ayuda si no se ha recibido la documentación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6. Con fecha 11 de noviembre de 2024 el vicepresidente del FOGAIBA en materia agraria, dictó propuesta provisional de denegación la cual se publicó en el BOIB núm. 149 de 14 de noviembre de 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7. Con fecha 13 de diciembre de 2024 el vicepresidente del FOGAIBA en materia agraria, dictó resolución de denegación que se publicó en el BOIB núm. 166 de 19 de diciembre de 2024.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8. Con posterioridad, los órganos gestores se dan cuenta de que en fecha 13 de diciembre de 2024, el administrado que figura en el Anexo I habían aportado la documentación requerida y se comprueba que cumplen con el requisito para poder seguir tramitándose las ayudas, o por ser beneficiarios de las mismas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;9. Se aplica por tanto el artículo 109.1 de la Ley 39/2015, de revocación de actas y rectificación de errores, por el que las administraciones públicas pueden revocar, mientras no haya transcurrido el plazo de prescripción, sus actos de gravamen o desfavorables, siempre que esta revocación no constituya dipensa o exención no permitida por las leyes, ni sea contraria al principio de igualdad, al interés público o al ordenamiento. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. &lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. La ley 3/2019, de 31 de enero, agraria de las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6. La ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El resto de normativa de desarrollo y aplicación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Informe, Propuesta de resolución y Resolución de revocación parcial &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Por todo esto, se informa favorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Revocar parcialmente la resolución de denegación del 13 de diciembre del 2024 publicada en el BOIB núm. 166 de 19 de diciembre.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Notificar la resolución al interesado del Anexo I mediante la publicación en el BOIB.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Informar al interesado que su expediente se encuentra a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (carrer de Reina Constança, núm 4 de Palma).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
