230 2024-12-30 CAIB 853590 928 ![CDATA[Resolución de modificación de la resolución de la consellera ejecutiva de Promoción Econòmica y Desarrollo Local, de 26 de septiembre de 2024, de concesión de subvenciones a asociaciones, fundaciones y otras entidades sin ánimo de lucro para la promoción y difusión del producto de Mallorca 2024 por estimación parcial del recurso de alzada interpuesto per la Confederación de Asociaciones Empresariales de Baleares (CAEB)]] CAIB es 2025-01-04 text/html CAIB es 695469 2025-01-04 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>BDNS: 766104</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La consellera ejecutiva de Promoción Económica y Desarrollo Local, en data 26 de septiembre de 2024, dicto la siguiente resolución:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Consejo Ejecutiu, en sessión de dia 5 de junio de 2024, aprovó la convocatória de subvenciones a asociaciones, fundaciones y otras entidades sin ánimo de lucro para la promoción y difusión del producto de Mallorca 2024.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La convocatoria y el extracto se publicaron en el nº. 77, de dia 8 de junio de 2024, per conducto de la “Base de Datos Nacional de Subvenciones”.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Dentro del plazo establecido en la convocatoria anterior, se presentaron 39 solicitudes de subvención de las cuales 4 renunciaron.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La Comisión Avaluadora emitió el 'informe que fundamenta la propuesta de resolución de aprovación de la concesión de las subvenciones<strong>.&nbsp; </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El secretario técnico de Promoción Económica y Desarrollo Local, como órgano instructor del procedimiento, informó que les entitades propuestas como beneficiarias de la convocatoria cumplen los requisitos para acceder a las subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. En el presupuesto de gastos del Consejo Insular de Mallorca del 2024 se ha previsto el crédito adecuado y suficiente para atender el gasto que se deriva de la concesión de las presentes subvenciones. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El dia 26 de septiembre de 2024, la Intervención Delegada (Centro La Misericòrdia) emitió informe de fiscalitzación favorable sobre la aprobación de la concesión de las subvenciones (FLP 2024/4721).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El 26 de septiembre de 2024 la consellera ejecutiva de Promoción Económica y Desarrollo Local emitió resolución de concesión de las subvenciones correspondientes a la convocatoria de subvenciones, asociaciones, fundaciones y otras entitades sin ánimo de lucro para la promoción y difusión del producto de Mallorca 2024 y se acordó conceder a la CONFEDERACIÓN DE ASOCIACIONES EMPRESARIALES DE BALEARES (CAEB) con CIF G07057896 una subvención por importe de 14.923,72 €.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. En fecha 30 de septiembre de 2024 la presidenta de la CAEB presenta recurso de alzada ante la resolución de la consellera ejecutiva de Promoció Econòmica y Desarrollo Local, de 26 de septiembre de 2024, de concesión de subvenciones a asociaciones, fundaciones y otras entidades sin ánimo de lucro para la promoción y difusión del producto de Mallorca 2024.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10 . En fecha 30 de octubre de 2024 la consellera ejecutiva del Departamento de Promoción Económica y Desarrollo Local, en uso de las atribuciones que le han sido conferidas por la legislación vigente, eleva al consejo ejecutivo la seguiente: propuesta de resolución de estimación parcial del recurso de alzada presentado por la CONFEDERACIÓN DE ASOCIACIONES EMPRESARIALES DE BALEARES (CAEB) </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. En fecha 13 de noviembre de 2024 el Consejo Ejecutivo aprovó la Propuesta de resolución de estimación parcial del recurso de alzada presentado por la CONFEDERACIÓN DE ASOCIACIONES EMPRESARIALES DE BALEARES (CAEB) ante la resolución de la consellera ejecutiva de Promoción Econòmica y Desarrolo Local, de dia 26 de septiembre de 2024, de la concessión de las subvenciones a asociaciones, fundaciones y otras entidades sin ánimo de lucro para la promoción y difusión del producto de Mallorca 2024</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">12. El dia 17 de diciembre de 2024, la Intervención Delegada (Centro la Misericòrdia) emitió informe de fiscalitzación favorable sobre la modificación de la resolución de la consellera ejecutiva de Promoción Economica y Desarrollo Local, de 26 de septiembre de 2024.(FLP 2024/7717)</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La consellera ejecutiva de Promoción Econòmica y Desarrollo Local es&nbsp; el órgano competente para resolver la convocatoria y disponer el gasto que se deriva, en virtud del articulo 33.2 k) de la Ley 4/2022, de 28&nbsp; de junio de consejos insulares.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las bases reguladoras de la convocatória son las establecidas en la Ordenanza general de subvenciones del Consejo Insular de Mallorca, aprovada por Acuerdo del Pleno de 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017), modificada por Acuerdo del Pleno de 14 de junio de 2018 (BOIB nº. 96, de 04 de agosto de 2018).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">. 3. El punto 13 de la convocatoria establece que “Contra el Acuerdo de aprovación&nbsp; de la convocatoria, que no pone fin a la via administrativa, se puede&nbsp; interponer el recurso de alzada, en el termino de un mes, que se comtará a partir del dia seguiente a la publicación en el Boletin Oficial de las Illes Balears. El recurso se puede interponerar formalmente ante el Consejo Ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El art. 66.4 de la Ley 4/2022, 28 de junio, de Consejos Insulares, establece “Contra los actos dictados por los consejeros ejecutivos y los actos de los órganos directivos del consejo insular y de los entes del sector público instrumental se puede interponer un recuros de alzada ante el consejo ejecutivo,</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El articulo 9 e) de la Ordenanza general de subvenciones del Consejo Insular de Mallorca establece, como obligación de la persona beneficiaria, acreditar, antes de que se dicte la propuesta de resolución de concesión, que está al corriente del cumplimiento de las obligaciones tributarias con el Estado y con el Consejo Insular de Mallorca y los organismos autonomos que depeden, y de las obligaciones con la Seguridad Social. “</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. <strong>La CONFEDERACIÓN DE ASOCIACIONES EMPRESARIALES DE BALEARES (CAEB).</strong> como&nbsp; beneficiaria reune los requisitos para ser beneficiaria de esta convocatoria, de acuerdo con el punto 5 de la convocatoria, en relación con el articulo 8 de la OGS.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El punto 11.4 de la convocatoria en relación con el articulo 18.2.d) de la OGS establece, entre otros, que el órgano instructor ha de formular la propuesta de resolución definitiva a la vista del expediente y el informe del órgano colegiado de valoración.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per todo lo que se ha expuesto, dicto la seguiente:</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.
