&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Mediante la Resolución de la consejera de Presidencia, Función Pública e Igualdad de 16 de septiembre de 2022, se aprobaron las bases generales que deben regir el proceso excepcional de estabilización por concurso extraordinario de méritos para cubrir las plazas de personal funcionario del Administración general y especial de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 122, de 17 de septiembre de 2022). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. En fecha 17 de diciembre de 2024 se publicó en el BOIB nº. 154, la Resolución de la consejera de Presidencia y Administraciones Públicas por la que se aprobaron las listas de aspirantes que han superado el proceso excepcional de estabilización por concurso extraordinario de méritos para el cuerpo auxiliar facultativo, escala profesional de infraestructuras, especialidad auxiliar facultativo para la isla de Eivissa y se ofrecen los puestos de trabajo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Una vez que las personas aspirantes que han superado el proceso selectivo han presentado la solicitud y se ha comprobado el cumplimiento de los requisitos, deben ser nombradas personal funcionario de carrera de este cuerpo, escala, especialidad de la Administración especial de la Comunidad Autónoma de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. La Ley 3/2007, de 27 de marzo, de la función pública de la comunidad autónoma de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. El Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. El Decreto 27/1994, de 11 de marzo, por el que se aprueba el Reglamento de ingreso del personal al servicio de la comunidad autónoma. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. La Resolución de la consejera de Presidencia, Función Pública e Igualdad, por la que se aprueba la convocatoria del proceso excepcional de estabilización por concurso extraordinario de méritos para cubrir las plazas de personal funcionario de la Administración general y especial de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 122, de 17 de septiembre de 2022). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;6. El Decreto 8/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;7. El Decreto 9/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se dispone el nombramiento de los miembros del Gobierno de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;8. El Decreto 12/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. El artículo 5.2 del anexo del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escola Balear de Administración Pública. &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Por todo ello, dicto la siguiente &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Nombrar personal funcionario de carrera del cuerpo auxiliar facultativo, escala profesional de infraestructuras, especialidad auxiliar facultativo para la isla de Eivissa de la Administración especial de la Comunidad Autónoma de las Illes Balears a las siguientes personas: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. Adjudicar los puestos de trabajo, de acuerdo con lo que se indica en el anexo de esta Resolución, a las personas aspirantes que han superado el concurso extraordinario de méritos del cuerpo auxiliar facultativo de la Administración especial de la Comunidad Autónoma de las Illes Balears, después de haber presentado la documentación pertinente, de acuerdo con su petición efectuada y la puntuación obtenida en el proceso selectivo. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. La toma de posesión debe efectuarse en la consejería correspondiente, en el plazo de tres días hábiles a contar a partir del día siguiente de la publicación de esta Resolución en el Boletín Oficial de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Antes de tomar posesión del puesto adjudicado, las personas interesadas deben hacer constar que no ocupan ningún puesto de trabajo ni que realizan ninguna actividad en el sector público que se comprenden en el artículo 1 de la Ley 53/1984, de 26 de diciembre , de incompatibilidades del personal al servicio de las administraciones públicas. Si lleva a cabo alguna actividad privada, incluidas las de carácter profesional, debe declararlo en el plazo de diez días hábiles a contar a partir del día siguiente de la toma de posesión, para que el órgano competente acuerde la declaración de compatibilidad o incompatibilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. Una vez publicado el nombramiento, para adquirir la condición de funcionario de carrera debe efectuarse el juramento o la promesa de acatar la Constitución, el Estatuto de Autonomía de la Comunidad Autónoma de las Illes Balears y el ordenamiento vigente y tomar posesión en el plazo reglamentario. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Declarar desistidas de su solicitud por caducidad y excluidas del procedimiento, a las personas que no han presentado el escrito de elección de los puestos de trabajo ofrecidos, por orden de preferencia, y la documentación acreditativa del cumplimiento de los requisitos, de acuerdo con la base 12 de la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra esta Resolución, que pone fin a la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Presidencia y Administraciones Públicas en el plazo de un mes, a contar a partir del siguiente a su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses a contar a partir del siguiente a la publicación de la resolución, de acuerdo con los artículos 8.2 y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa. &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
