Asimismo, aprobó, simultáneamente, la convocatoria correspondiente al presente ejercicio y que se regirá por las bases señaladas anteriormente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Se podrán consultar las bases y los anexos en la web municipal del Ajuntament de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Bases reguladoras de la convocatoria para la asignación del uso privativo de una parcela de huerto en el huerto urbano Sa Vinyeta, destinada a entidades que tengan por objeto desarrollar acciones de carácter pedagógico, terapéutico, social o medioambiental&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. Normas generales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.1. En fecha 9 de agosto de 2018 y BOIB núm. 98 se publicó la aprobación definitiva de la modificación del Reglamento de régimen de uso de los huertos urbanos de Ciutadella de Menorca. Por tanto, las bases reguladoras se presentan de acuerdo con dicho Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.2. El objeto de estas bases es regular la concesión mediante convocatoria pública del uso temporal de los huertos urbanos de Sa Vinyeta destinados a entidades que cumplan los requisitos que más adelante se detallan y deseen disponer de una parcela de huerto por un período de cuatro años, sin posibilidad de prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.3. En caso de que un huerto quede sin trabajar más de 6 meses sin que exista una comunicación expresa y motivada al Ayuntamiento de Ciutadella de Menorca, éste quedará libre y podrá ser adjudicado nuevamente a otra entidad, en una nueva convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.4. Las licencias municipales otorgadas en virtud de este reglamento tendrán la naturaleza de autorizaciones de uso privativo del dominio público, reguladas en el Reglamento de bienes de las corporaciones locales, aprobado mediante Real Decreto 1372/1986, y en la Ley 33/2003 de patrimonio de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.5. Estas licencias se otorgan salvaguardando el derecho de propiedad y sin perjuicio de otros, por lo que, en ningún caso, supone la transmisión del dominio de la parcela de huerto utilizada, que seguirá siendo propiedad del Ayuntamiento de Ciutadella de Menorca, tanto respecto al terreno como respecto a todas las instalaciones existentes en el momento de otorgamiento de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.6. La entidad adjudicataria solamente tendrá la posesión del huerto municipal que se le asigne, por el plazo que se determine y en los términos previstos en la licencia o el documento de formalización de la adjudicación y los demás artículos del Reglamento vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.7. Las licencias otorgadas tienen carácter personal, y en ningún caso las personas titulares podrán ceder, enajenar, gravar o disponer, a título oneroso o gratuito, de los derechos derivados de la autorización de uso, ni transmitirlos a terceros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.8. La ubicación de los huertos está emplazada en Sa Vinyeta, en el término municipal de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.9. Cada parcela de huerto consta de aproximadamente 40 metros cuadrados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Personas destinatarias de los huertos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Personas jurídicas, públicas o privadas, y sin ánimo de lucro, que tengan por objeto desarrollar acciones de carácter pedagógico, terapéutico, social o medioambiental, con sede social en el municipio de Ciutadella de Menorca, que tengan plena capacidad de obrar, que no incurran en ninguna de las causas de prohibición y que estén legalmente constituidas y registradas en el Registro de Entidades del Ayuntamiento de Ciutadella y en el Registro de Asociaciones del Gobierno Balear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Podrán presentar solicitudes personas jurídicas, públicas o privadas, sin ánimo de lucro, ya sean entidades, asociaciones u organismos legalmente constituidos e inscritos en el Registro de Asociaciones de la Comunidad Autónoma de las Islas Baleares, el Registro Unificado de las Islas Baleares, el Registro de Fundaciones, o cualquier otro registro formal relacionado con los ámbitos de actuación objeto de esta convocatoria, antes de que comience el plazo de presentación de instancias, así como en el Registro Municipal de Entidades del Ayuntamiento de Ciutadella.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Parcelas disponibles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Hay disponibles para esta convocatoria 2 parcelas de aproximadamente 40 metros cuadrados, las núm. 21 y 22.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Requisitos y condiciones de las entidades aspirantes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con un máximo de 30 puntos se valorarán:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El colectivo de personas destinatarias: hasta un máximo de 5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La descripción de la necesidad: hasta un máximo de 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los objetivos generales y específicos: hasta un máximo de 5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los beneficios que se obtendrán con la adjudicación de una parcela: hasta un máximo de 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Presentación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La solicitud y el resto de la documentación, según los modelos normalizados, se presentarán de forma telemática conforme a lo dispuesto en la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las entidades que soliciten una parcela deberán presentar los siguientes documentos acreditativos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Formulario de inscripción para obtener una parcela del Huerto Urbano, firmado por la persona que presida la asociación o entidad, o por quien tenga atribuida su representación (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) DNI de la persona firmante de la solicitud&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Documento que acredite la representatividad con la que actúa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) NIF de la entidad solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e) Estatutos de la entidad o documento que acredite que está legalmente constituida y registrada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f) Certificado que acredite la inscripción en los diferentes registros, según lo indicado en el punto 4.1. (a).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;g) Declaración responsable que acredite que la entidad o asociación no tiene pendiente el reintegro de subvenciones pagadas anteriormente ni justificadas incorrectamente (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;h) Certificado de estar al corriente de las obligaciones con la Seguridad Social, tributarias y fiscales. De oficio, se verificará el cumplimiento con la Hacienda municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;i) Proyecto en el que se especifique el objetivo por el cual se solicita la parcela de huerto, el colectivo destinatario y los beneficios que revertirán en las personas usuarias (anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Plazo de presentación y subsanación de solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.1. El plazo de presentación de solicitudes será de 20 días hábiles, a partir del día siguiente a la publicación de esta convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;6.2. Si tras la revisión de la solicitud y la documentación presentada se determina que ésta es incompleta o defectuosa, el órgano competente requerirá a la persona solicitante para que, en el plazo de diez días, de acuerdo con el artículo 26 de la Ley de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, aporte la documentación necesaria o subsane los defectos observados. En dicho requerimiento se indicará que, si en el plazo establecido no se subsanan las deficiencias, la solicitud será desestimada mediante resolución previa, conforme a lo previsto en el artículo 42 del citado cuerpo legal, y el expediente será archivado conforme al artículo 71 del mismo cuerpo legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Procedimiento de concesión de parcelas en el Huerto Urbano de Sa Vinyeta&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.1. La adjudicación de las licencias de uso privativo del dominio público sobre parcelas municipales se realizará en función de la puntuación obtenida, según lo establecido en el punto 4.2 de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.2. El personal técnico municipal de Servicios Sociales y Medio Ambiente, junto con la Secretaría Municipal, valorará la admisión de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.3. Si se presentan más solicitudes que el número total de parcelas disponibles, se procederá a seleccionar las propuestas presentadas, puntuándolas según los criterios establecidos, para lo cual las entidades deberán presentar un proyecto (anexo VI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.4. En caso de empate en la puntuación resultante y si hay más solicitudes que parcelas disponibles, el orden de adjudicación se determinará por sorteo. La asignación de las parcelas también se realizará mediante este procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;7.5. Una vez aceptada la solicitud, en la fecha y lugar que se comunicarán oportunamente, se celebrará un acto público en el que se llevará a cabo el sorteo. Este acto servirá para aprobar las adjudicaciones de las licencias de uso privativo de las parcelas municipales en caso de empate en puntuación o de exceso de solicitudes respecto al número de parcelas disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Formalización de adjudicaciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El alcalde o la concejalía delegada aprobará las adjudicaciones de las licencias de uso privativo del dominio público de los huertos municipales, tras considerar el informe emitido por el personal técnico y la Secretaría Municipal. Se notificará a todas las entidades participantes el resultado de la licitación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El documento administrativo que formalice las adjudicaciones de las licencias de uso privativo (anexo VII) incluirá:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las entidades adjudicatarias deberán recoger los títulos acreditativos de su derecho otorgados por el Ayuntamiento de Ciutadella en un plazo de 30 días a partir de la notificación de la adjudicación. Si no se formaliza el documento administrativo dentro del plazo indicado, el Ayuntamiento podrá resolver la adjudicación, entendiendo que la misma ha sido renunciada, salvo que la persona adjudicataria justifique las causas que le impidieron formalizar dicho documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
