La citada Resolución se modificó en fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016 (BOIB núm. 81) y en fecha 26 de junio de 2018 (BOIB núm. 80).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="background-color:#ffffff">2.&nbsp;Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de ganados san simon, sc. , entre otros, que figuran en el anexo de la Resolución de concesión, RES-1 de fecha 17 de abril de 2023, (BOIB núm. 50, de 20 de abril de 2023) con los datos y los importes correspondientes&nbsp;(con un importe concedido de 2 .682,73 €). </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="background-color:#ffffff">3. Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">4. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, el interesado presenta la solicitud de pago, así como la documentación exigida, pero, una vez revisada ésta, se comprueba que el beneficiario no acredita la condición de explotación prioritaria.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">5. El día 9 de septiembre de 2024 se deniega la solicitud de ratificación de la explotación agraria y se da de baja en el Catálogo de Explotaciones Agrarias Prioritarias de las Illes Balears como explotación prioritaria mediante la Resolución del director gerente del FOGAIBA.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">6. En la resolución de concesión ocupa el nº71 de orden con derecho a ayuda. De su puntuación se desprende que obtiene 25 puntos por titular de explotación prioritaria. obtuvieron derecho a ayuda tenían una puntuación de 50 puntos.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">7. Dado el punto anterior, no mantiene la puntuación obtenida en la concurrencia, siendo actualmente de 42 puntos, por lo que no tiene derecho a ayuda.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">8. El 22 de octubre de 2024 se notifica al interesado mediante publicación en la web del FOGAIBA la propuesta provisional de revocación total de la ayuda y el beneficiario no presenta alegaciones.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">9. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, dispone que “Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”. 10. Finalizar el procedimiento y archivar el expediente INEA2020_1/055.</p> <p>3.
