    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se publica la resolución del consejero ejecutivo de Hacienda y Función Pública, por delegación del Consejo Ejecutivo, según acuerdo de 28 de septiembre de 2022, BOIB núm. 128, de 1 de octubre de 2022, de conformidad con lo dispuesto en el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el BOIB nº. 105, de 9 de agosto de 2022, se publicó el convenio firmado con el Ayuntamiento de Artà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 2 de diciembre de 2022 (BOIB núm. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023, de fecha 7 de febrero de 2023 y de fecha 13 de febrero de 2023 (BOIB núm. 13, de 28 de enero de 2023, BOIB núm. 19, de fecha 11 de febrero de 2023 y BOIB núm. 21, de 16 de febrero de 2023), se aprobó la convocatoria del proceso selectivo por el sistema de concurso oposición para el ingreso como personal funcionario en la escala de administración general, subescala auxiliar, auxiliar administrativo-a del subgrupo C2, derivada de la oferta de empleo público del Ayuntamiento de Artà.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En esta resolución se convocaron 2 plazas de la categoría de auxiliar administrativo-iva (Ayuntamiento de Artà).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Por Acuerdo del Tribunal calificador competente de este proceso selectivo de estabilización, una vez concluidas la revisión y baremación de los méritos de los aspirantes, en fecha 26 de noviembre de 2024 se publicó, en el tablón electrónico de anuncios y en la Sede electrónica del Consejo Insular de Mallorca, la lista definitiva de puntuaciones obtenidas por las personas aspirantes, con aplicación de los criterios de desempates y la resolución de las alegaciones formuladas en la lista provisional de puntuaciones, así como el listado de puestos correspondientes a las plazas convocadas, dando un plazo de 7 días hábiles para comunicar el orden de preferencia de los puestos ofrecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. De conformidad con la base 14.1 de las bases específicas de la convocatoria, una vez asignados los puestos de trabajo ofrecidos, el tribunal debe elevar al consejero ejecutivo de Hacienda y Función pública la propuesta de personas aspirantes que han superado el proceso selectivo de concurso oposición, con asignación de puestos de trabajo, desglosada, en su caso, por turnos de acceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En fecha 17 de diciembre de 2024, el Tribunal calificador competente del procedimiento selectivo ha acordado elevar al consejero ejecutivo de Hacienda y Función Pública el Acuerdo de la propuesta de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso-oposición para el ingreso como personal funcionario en la escala de administración general, subescala auxiliar, auxiliar administrativo-a del subgrupo C2, derivada de la oferta de empleo público del Ayuntamiento de Artà, y de asignación de puestos de trabajo, por turno de acceso, de acuerdo con el trámite de manifestación de orden de preferencias efectuado , para su nombramiento como a funcionarios de carrera, la cual contiene a tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 91.1 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El artículo 68 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 20/2021 de 28 de diciembre de medidas urgentes para la reducción de la temporalidad en el empleo público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Ley 4/2022, de 28 de junio, de consejos insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El artículo 4 del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 2 de diciembre de 2022 (BOIB núm. 158, de 6 de diciembre de 2022), modificada por Resolución del consejero ejecutivo de Hacienda y Función Pública de fecha 24 de enero de 2023, de fecha 7 de febrero de 2023 y de fecha 13 de febrero de 2023 (BOIB núm. 13, de 28 de enero de 2023, BOIB núm. 19, de fecha 11 de febrero de 2023 y BOIB núm. 21, de fecha 16 de febrero de 2023), se aprobó la convocatoria del proceso selectivo de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de las escalas, subescalas, clases y categorías (o especialidades) de administración general y especial de los subgrupos A1, A2, C1, C2 y del grupo AP derivada de la oferta de empleo público de los Ayuntamientos de Alcúdia, Algaida, Andratx, Artà, Capdepera, Felanitx, Inca, Lloseta, Manacor, Pollença, Porreres, Puigpunyent , Sencelles, Ses Salines y Santa Maria del Camí .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;APROBAR &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso oposición para el ingreso como personal funcionario de la escala de administración general, subescala auxiliar, auxiliar administrativo-a del subgrupo C2, derivada de la oferta de empleo público del Ayuntamiento de Artà, de acuerdo con lo que se indica en el anexo 1 de este documento con indicación de la asignación de los puestos de trabajo correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;INFORMAR &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;al ayuntamiento que la adjudicación y adscripción definitiva de los puestos de trabajo a las personas aspirantes queda condicionada a la acreditación de estar en posesión de todos los requisitos específicos para la adscripción al puesto de trabajo, que deberá ser requerida, en su caso, por cada ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con lo establecido en la base 14.4 de las bases específicas de la convocatoria, los puestos de jefaturas orgánicas y puestos singularizados deben adjudicarse en adscripción provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ORDENAR &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;la publicación de esta resolución y su anexo en el tablón de edictos y en la Sede electrónica del Consejo Insular de Mallorca, y en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra este acto, que no pone fin a la vía administrativa, puede interponer el recurso de alzada en el plazo de un mes, a contar a partir del día siguiente de recibir esta notificación. El recurso puede interponerse formalmente ante este Consejo Ejecutivo o ante la Comisión de Gobierno del Consejo Insular de Mallorca, que es el órgano competente para resolverlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimación expresa de este recurso de alzada, se puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, a contar a partir del día siguiente de recibir la notificación de la desestimación de dicho recurso de altura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si han transcurrido tres meses desde la interposición del recurso de alzada y no ha recibido la notificación de resolución expresa, se entiende desestimado por silencio y puede interponer el recurso contencioso administrativo ante el Juzgado Contencioso Administrativo, en el plazo de seis meses, a contar a partir del día siguiente de la presunta desestimación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante lo anterior, se puede interponer, si procede, cualquier otro recurso que considere oportuno. Todo ello de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa y la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
