El 6 de julio de 2024, se publicó en el BOIB núm. 89, la Resolución del consejero de Educación y Universidades, a propuesta de la directora general de Planificación y Gestión Educativas, por la que se convocan las ayudas económicas para el curso 2023-2024 para contribuir al sostenimiento de las escuelas de música y/o danza públicas reconocidas por la Consejería de Educación y Universidades cuyos titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales y de los conservatorios municipales de las Illes Balears.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 27 de septiembre de 2024, se constituyó la Comisión Evaluadora. Tras revisar y evaluar las solicitudes de acuerdo con los criterios y requisitos establecidos en la convocatoria, la comisión advirtió que, aún en esa fecha, el Servicio de las Enseñanzas de Régimen Especial no disponía del acceso al trámite de consulta de los certificados correspondientes de estar al corriente con las obligaciones tributarias con la hacienda autonómica, la hacienda estatal y la Seguridad Social, a través de la Plataforma de Interoperabilidad de las Illes Balears (PINBAL). Por este motivo, debido a que el plazo previsto en la convocatoria para presentar la cuenta justificativa finalizaba el 11 de octubre, la comisión evaluadora acordó proponer a la directora general de Planificación y Gestión Educativas la necesidad de publicar una resolución por la que se ampliara el plazo máximo para presentar la cuenta justificativa fijada en el apartado quinto de la base decimosexta de la convocatoria, en los términos previstos en el artículo 13.3 de la Orden de la Consejería de Educación y Cultura, de 1 de julio de 2009, por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura.</span></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. El 5 de octubre de 2024, se publicó en el BOIB núm. 131, la Resolución del Consejero de Educación y Universidades, a propuesta de la directora general de Planificación y Gestión Educativas, por la que se amplía el plazo máximo para presentar la cuenta justificativa fijada en la Resolución del consejero de Educación y Universidades por la que se convocan las ayudas económicas para el curso 2023-2024 para contribuir al sostenimiento de las escuelas de música y/o danza públicas reconocidas por la Consejería de Educación y Universidades cuyos titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales y de los conservatorios municipales de las Illes Balears. Esta Resolución estableció que </span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">«El plazo para presentar la cuenta justificativa (Anexo 8), firmado por el representante de la entidad beneficiaria, o el informe de veracidad y regularidad de gastos e ingresos imputables a la subvención, firmado por el interventor de la administración beneficiaria (Anexo 9), es de diez días hábiles a contar a partir de la fecha de la publicación de la propuesta de resolución de concesión y denegación de las ayudas, prevista en el apartado duodécimo de este anexo, ambos inclusive».</em></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. El 12 de noviembre de 2024, la comisión evaluadora después de revisar y evaluar las solicitudes de acuerdo con los criterios y requisitos establecidos en la convocatoria, acordó aprobar, por unanimidad de los asistentes, el informe del Servicio de las Enseñanzas de Régimen Especial, junto con su anexo, en el que figura el concreto reparto de los importes de la subvención, para que se eleve a propuesta de resolución de la directora general de Planificación y Gestión Educativas.</span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En este momento ya se ha comprobado que todas las entidades solicitantes se han presentado en el plazo que establece la convocatoria y que cumplen los requisitos de titularidad pública, de una administración pública territorial, corporación local o patronato municipal o conservatorio municipal : sea por tratarse de conservatorio municipal (Manacor, Felanitx, Inca), sea por tratarse de escuela de música reconocida de titularidad pública; y que todas ellas se encuentran al corriente de las obligaciones tributarias y de la Seguridad Social.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto al cálculo del importe de la subvención, éste se ha llevado a cabo siguiendo los criterios de la convocatoria: en cuanto al número de alumnos que dan derecho a la subvención, conforme el número resultante de la comprobación de los datos en el GestIB; en lo que se refiere a las especialidades, se han tenido en cuenta las especialidades instrumentales; finalmente, en lo que se refiere a la cantidad sobrante, se ha efectuado el prorrateo previsto en el punto séptimo.6 de la convocatoria.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="display:none">&nbsp;</span>5. El mismo 12 de noviembre de 2024, se publicó publicado en la web de la Dirección General de Planificación y Gestión Educativas la propuesta de resolución de concesión y denegación de las ayudas económicas para el curso 2023-2024 para contribuir al sostenimiento de las escuelas de música y/o danza públicas reconocidas por la Consejería de Educación y Universidades cuyos titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales y de los conservatorios municipales de las Illes Balears.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El 27 de noviembre ha finalizado el período de diez días hábiles a partir de la publicación de la propuesta de Resolución y concesión de las ayudas para presentar alegaciones y no se registró ninguna alegación. Asimismo, todos los participantes presentaron la cuenta justificativa de acuerdo con lo establecido en la convocatoria y se cumplimentaron todos los requerimientos de subsanación.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El 29 de noviembre de 2024 se ha reunido la Comisión Evaluadora, que ha aprobado y adoptado, por unanimidad, el informe citado en el apartado anterior.</span></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">8 . Dado que dos de las entidades participantes, superan los 30.000 euros –la Escuela de Música y Artes Escénicas Reconocida de Ciutadella ( 36.364,04€ ) y Escuela de Música Reconocida de Palma (35.189,20€)-, se ha solicitado licitado informe a la Intervención General de acuerdo con el artículo 117.2 de la Ley 14/2014, de finanzas de la Comunidad Autónoma de las Illes Balears, para que se comprobaran los extremos recogidos en el Acuerdo del Consejo de Gobierno de 20 de junio de 2022. El 16 de diciembre de 2024, se ha emitido informe de conformidad de fiscalización previa limitada de la Intervención.</span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="display:none">&nbsp;</span>&nbsp;</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. La directora general de Planificación y Gestión Educativas ha emitido, el 16 de diciembre de 2024, propuesta de resolución de concesión y denegación de las ayudas económicas para el curso 2023-2024 para contribuir al sostenimiento de las escuelas de música y/o danza pública reconocidas por la Consejería de Educación y Universidades cuyos titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales y de los conservatorios municipales de las Illes Balears.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Todas las entidades beneficiarias han presentado la cuenta justificativa en el plazo establecido en la convocatoria y, asimismo, todas ellas se encuentran al corriente de sus obligaciones tributarias y con la Seguridad Social.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Resolución del consejero de Educación y Universidades, a propuesta de la directora general de Planificación y Gestión Educativas, por la que se convocan las ayudas económicas para el curso 2023-2024 para contribuir al sostenimiento de las escuelas de música y/o danza públicas reconocidas por la Consejería de Educación y Universidades cuyos titulares sean administraciones públicas territoriales, corporaciones locales o patronatos municipales y de los conservatorios municipales de las Illes Balears (BOIB núm. 89, de 6 de julio de 2024).</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. La Resolución del Consejero de Educación y Universidades, a propuesta de la directora general de Planificación y Gestión Educativas, por la que se amplía el plazo máximo para presentar la cuenta justificativa fijada en la Resolución del consejero de Educación y Universidades por la cual se convocan las ayudas económicas para el curso 2023-2024 para contribuir al sostenimiento de las escuelas de música y/o danza públicas reconocidas por la Consejería de Educación y Universidades los titulares de las cuales sean administraciones públicas territoriales, corporaciones locales o patronatos municipales y de los conservatorios municipales de las Illes Balears (BOIB núm. 131, de 5 de octubre de 2024).</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Ley 14/2014, de finanzas de la Comunidad Autónoma de las Illes Balears; y el Acuerdo del Consejo de Gobierno de 20 de junio de 2022.</span></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprobar la concesión y denegación de las ayudas solicitadas a las entidades que se relacionan en el documento anexo.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Ordenar la publicación de esta Resolución en el <em>Boletín Oficial de las Illes Balears </em>.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null">3. Hacer pública esta resolución en la página web <em>http://dgplacen.caib.es </em>.</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La resolución que se dicte debe indicar el pie de recurso siguiente:</span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
