(Línea 1)]] 694863 832976 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>BDNS: 764312</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes:</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Consejero ejecutivo del Departamento de Medio Ambiente, Medio rural y Deportes, mediante resolución de 22 de marzo de 2024, aprobó el expediente de Convocatoria de subvenciones anuales para llevar a cabo actividades socioambientales en materia cinegética para el año 2024. (BOIB n.º 48 de 11 de abril de 2024).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El órgano instructor ha emitido informe relativo al cumplimiento por parte de las entidades beneficiarias de los requisitos necesarios para acceder a la subvención.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El técnico jurídico ha emitido informe favorable dentro del presente expediente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Esta subvención está incluida en el Plan estratégico de subvenciones del Consell de Mallorca 2024. Resumen de líneas estratégicas. Línea estratégica sostenibilidad medioambiental: conseguir un desarrollo eficaz y en equilibrio con el planeta y sus recursos. CAZA (17226) 1.- Fomentar el aprovechamiento sostenible de los recursos cinegéticos, la gestión agro-cinegética y ambiental de los cotos de las sociedades de cazadores locales de la isla de Mallorca, y la práctica cinegética ordenada.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La convocatoria prevé dos líneas de subvención, de las cuales este documento se refiere a las solicitudes incluidas a la línea L1: Proyectos o actividades de las establecidas al apartado primero de este artículo, en las cuales son subvencionables gastos corrientes de ejecución del listado determinado al apartado 4.1. de la presente convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Consta en el expediente crédito adecuado y suficiente del presupuesto del año 2024. Y se destina para la línea 1 (L1) un importe de ciento-cuarenta mil euros (140.000,00 €), con cargo a la aplicación presupuestaria 50.17226.48900 del presupuesto de 2024 (RC n.º 220240000244)</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Las entidades a las cuales se concede subvención se ha comprobado que se encuentran al corriente de las obligaciones tributarias con la Agencia Estatal de Administración Tributaria, con el Consell de Mallorca y con la Seguridad Social.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El expediente de concesión de subvención ha sido fiscalizado de conformidad en fecha 03/12/2024</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos jurídicos:</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Ley 38/2003, de 17 de noviembre, general de subvenciones (BOE de 18 de noviembre de 2003) y el artículo 88.1 del Real Decreto 887/2006, de 21 de julio, por el cual se aprueba el reglamento de aquella establecen que el abono de la subvención se tiene que efectuar cuando la persona física o jurídica que es beneficiaria haya justificado la realización de la actividad, el proyecto, el&nbsp;objetivo o la adopción del comportamiento por el cual se otorgó, en los términos establecidos en la normativa reguladora de la subvención.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Ordenanza general de subvenciones del Consell de Mallorca aprobada por el Pleno del Consell Insular en sesión de día 23 de diciembre de 2016 (BOIB n.º 21, de 18 de febrero de 2017), en la cual se establece la regulación de las subvenciones que otorgue la corporación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Convocatoria de subvenciones anuales para llevar a cabo actividades socioambientales en materia cinegética para el año 2024. (*BOIB n.º 48 de 11 de abril de 2024), aprobada por resolución del consejero ejecutivo de Medio Ambiente, Medio rural y Deportes de 22 de marzo de 2024.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Acuerdo del Consell Ejecutivo, de día 7 de agosto de 2019, por el cual se acuerda la delegación en las personas titulares de los departamentos para resolver cualquier actuación derivada de la concesión de subvenciones siempre que no se modifique su objeto (BOIB n.º 111, de 13 de agosto de 2019).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Acuerdo del Pleno, de 12 de abril de 2018, por el cual se aprueba inicialmente el Reglamento orgánico del Consell de Mallorca (BOIB n.º 160, de 22 de diciembre de 2018), modificado por corrección de errores materiales por el Acuerdo del Pleno, de 12 de julio de 2018 (BOIB n.º 89, de 19 de julio de 2018), establece en su artículo 39 apartado 2.h):</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">«Los Consejero ejecutivos y las Consejeras ejecutivas, como jefes de sus departamentos, ejercen con carácter genérico las siguientes atribuciones, que incluyen la facultad de dictar actos administrativos que afecten terceros:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h) Autorizar y disponer los gastos propios de los servicios del departamento dentro de los límites de su competencia y del importe de los créditos autorizados; reconocer y liquidar las obligaciones subsiguientes y solicitar al Departamento de Hacienda que ordene los pagos correspondientes.»</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Decreto de Presidencia del Consell Insular de Mallorca por el cual se establecen las competencias de los departamentos del Consell Insular de Mallorca (BOIB n.º 106 de 29 de julio de 2023).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Bases de Ejecución del Presupuesto de 2024 del Consell de Mallorca aprobadas por el Pleno de la Corporación en sesión extraordinaria de día 27 de diciembre de 2023 (BOIB 176, de 30 de diciembre) y modificadas por el Pleno, en sesión ordinaria celebrada día 13 de junio de 2024 (BOIB 91, de 11 de julio).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El Consejo Ejecutivo, en fecha 31 de enero de 2024, ha autorizado al Consejero Ejecutivo de Medio Ambiente, Medio rural y Deportes, para aprobar el gasto del el expediente de la convocatoria de subvenciones por el desarrollo de actividades socioambientales en materia cinegética.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo lo anterior,</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resuelvo</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aprobar y conceder las subvenciones a las entidades siguientes y por las cantidades que se detallan dentro de la Línea 1, según establece la convocatoria:</span></p> <p>1.<span style="font-family:Times New Roman,Times,serif;
