El vicepresidente del Consorcio Sierra de Tramuntana Patrimonio Mundial, el día 18 de marzo de 2024, resolvió aprobar convocatoria de subvenciones para el año 2024, destinadas a personas físicas, agrupaciones de personas físicas, explotaciones agrarias, comunidades de bienes, comunidades y asociaciones de regantes, entidades sin ánimo de lucro, para la recuperación de elementos etnológicos y arquitectónicos con valores patrimoniales y para la recuperación del paisaje agrícola y su entorno que estén situados dentro del ámbito territorial de la sierra de tramontana (SV 1/2024).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. El extracto de la convocatoria de subvenciones, así como la misma convocatoria, se publicó en el BOIB nº. 40, de día 23 de marzo de 2024.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Durante el periodo de un mes para presentar solicitudes, hasta día 23 de abril de 2024, se presentaron 240 solicitudes de subvenciones para esta convocatoria.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. Las solicitudes se han revisado por el centro gestor y el personal del Servicio de Gestión de Parajes Culturales del Departamento de Presidencia. Servicio que tiene encomendada la función de gestionar el Consorcio Serra de Tramuntana. A raíz de esta revisión, en varias fechas, la sra. Carolina de Pablos Puig, Ingeniera Agrónoma del Consorcio Serra de Tramuntana, y el sr. Gabriel Ordinas Marcè, técnico de Patrimonio Etnológico, han emitido los informes técnicos, en los cuales se fundamenta la viabilidad técnica de los proyectos solicitados y se propone la concesión que se reflejará en el anexo 1.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. Revisada la documentación administrativa y técnica presentada, fecha 25 de noviembre de 2024, la jefa de servicio jurídico del Servicio de Gestión de Parajes Culturales del Departamento de Presidencia, en sus funciones de instructor del expediente, emitió el informe sobre el cumplimiento de los requisitos de la convocatoria por parte de las entidades beneficiarias y ha emitido informe jurídico favorable sobre los aspectos jurídicos de la propuesta de resolución de concesión de las subvenciones que nos ocupa.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">7. La Intervención Delegada ha fiscalizado favorablemente este expediente en fecha 12 de diciembre de 2024.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. El procedimiento de concesión de las subvenciones reguladas por la presente convocatoria pública se ha llevado a término, mediante régimen de concurrencia no competitiva, de acuerdo con el artículo 17,2 de la Ordenanza General de Subvenciones, por orden de entrada en el registro del Consorcio Serra de Tramuntana, en los términos de la base quinta de la convocatoria. De esta manera serán subvencionadas hasta agotar el total del crédito asignado para la convocatoria todas aquellas solicitudes completas que cumplan los requisitos que se establecen, y, por lo tanto, no es necesaria la comparación entre las solicitudes.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Al caso que nos ocupa, atendiendo la orden de prioridad de entrada por registro de las solicitudes presentadas, se ha previsto el crédito adecuado y suficiente para hacer frente a los gastos que se derivan de la línea de subvenciones y queda crédito suficiente para poder llevar a cabo la concesión de todas las subvenciones que aquí se propondrán. Concretamente el crédito total disponible es de 700.000 €, de los cuales, según el perfil de beneficiario, es el siguiente:</span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Personas físicas, entidades sin ánimo de lucro, comunidades de bienes, comunidades de regantes y agrupaciones de personas físicas: 600.000,00 € previstos a la convocatoria</span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px">Explotaciones agrarias: crédito inicial de los 100.000,00€ previstos a la convocatoria.</span></li> </ul> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Este presupuesto de 700.000 € previsto en la convocatoria se puede ver incrementado hasta una cuantía total máxima de 1.700.000,00 € condicionado a la existencia de crédito adecuado y suficiente en el momento de la concesión.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. Para determinar el importe que se propone conceder se ha valorado la solicitud, la documentación aportada y la comprobación de la realidad física en la que se pretende actuar, de acuerdo con las reglas previstas en la base séptima y los límites regulados en la base tercera de la convocatoria.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En cada expediente consta crédito adecuado y suficiente para llevar a cabo el gasto de las concesiones de subvención que se tramitan.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">3. </span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La base undécima de la convocatoria establece las funciones del instructor del expediente, que dice que; </span><em>“La instrucción corresponde al jefe del servicio jurídico del Servicio de Gestión de Parajes Culturales del Departamento de Presidencia, que tiene que llevar a cabo todas las actuaciones o los actos de trámite necesarios para velar por el cumplimiento de los requisitos de la convocatoria, además de ejercer las facultades previstas en el artículo 16 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de subvenciones, y las que se mencionan en la Ordenanza General de Subvenciones del Consell de Mallorca. El órgano instructor puede requerir a las entidades solicitantes los informes o las aclaraciones que considere convenientes. El instructor del expediente podrá asesorarse por cualquier técnico del Consell de Mallorca que considere adecuado.”</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">. Siendo el Consorcio Serra de Tramuntana el centro gestor responsable del seguimiento de las subvenciones.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Con esta finalidad, la instructora del expediente con la colaboración del personal del Consorcio desde un punto de vista administrativo y jurídico, y de los técnicos del Consell de Mallorca, desde un punto de vista técnico, han llevado a cabo toda esta tarea.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. La base segunda regula la condición de beneficiario de estas subvenciones, y establece, entre otros, que no pueden ser beneficiarios los que, en el momento que el órgano instructor de la convocatoria tiene que hacer la propuesta de acuerdo definitiva, no están al corriente en el cumplimiento de las obligaciones tributarias y con la Seguridad Social ante la Administración del Estado y con las obligaciones tributarias con el Consell de Mallorca. Igualmente, la base segunda establece que las mencionadas circunstancias se tienen que acreditar antes de la propuesta de resolución de concesión y en el momento de pago de la subvención.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Revisado este requisito, se ha constatado que los solicitantes no incumplen con las obligaciones tributarias y con la Seguridad Social ante la Administración del Estado y con las obligaciones tributarias con el Consejo de Mallorca y el Consorcio Serra de Tramuntana.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. La propuesta de resolución de concesión será redactada por la instructora del expediente de acuerdo con el apartado 1 de la base undécima de la convocatoria, y se ajusta a lo que establece el artículo 16.4 del Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el texto refundido de la Ley de Subvenciones, en el sentido que tiene que incluir la relación de entidades beneficiarias, dado que incluye la relación de personas beneficiarias, con indicación del beneficiario, el NIF parcial, el concepto, el presupuesto, la cuantía solicitada y el importe concedido. Esta propuesta de resolución es parcial por lo que no se incluyen todas las solicitudes si no únicamente parte de las concedidas.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">6. La competencia para aprobar la resolución de concesión recae en la vicepresidencia del Consorcio Sierra de Tramuntana de acuerdo con el artículo 11 e) de los Estatutos del Consorcio Serra de Tramuntana y de acuerdo con la base undécima de la convocatoria.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por todo lo expuesto y de acuerdo con la base undécima de la convocatoria, dicto la siguiente</span></p> <p style="text-align:center"><strong>Resolución</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.Conceder a los solicitantes que se detallan en el anexo 1 adjunto, la cantidad total cien mil euros (100.000,00 €) y disponer el gasto a su favor.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Esta cuantía va destinada a explotaciones agrarias, y se tiene que imputar a la aplicación presupuestaria 00.33615.77900 del presupuesto de gastos del Consorcio Serra de Tramuntana para el año 2024 y al proyecto con financiación afectada 2024 (En 220240000467). En el anexo 1.A consta el importe que se concede y la operación contable D provisional que va asociada en cada expediente.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. Requerir a los beneficiarios previstos al anexo 1 para que cumplan con las obligaciones previstas en la base decimoquinta de la convocatoria, y también ejecuten y justifiquen la subvención recibida de acuerdo con los plazos previstos en la base decimocuarta. Es decir, las beneficiarias o los beneficiarios, tendrán que haber ejecutado y justificado las actuaciones hasta día 20 de diciembre de 2024. Este plazo ha sido objeto de ampliación por Resolución del vicepresidente del Consorcio Sierra de Tramuntana de día 14 de octubre de 2024 (BOIB nº. 151 de 19 de noviembre de 2024) según la cual se amplía hasta día 31 de marzo de 2025 la justificación de los proyectos de subvención concedidos a los particulares (personas físicas, agrupaciones de personas físicas, comunidades de bienes, entidades sin ánimo de lucro, comunidades de regantes) y a las explotaciones agrarias y la ejecución y justificación de los proyectos de subvención con anticipo solicitado a conceder a los particulares (personas físicas, agrupaciones de personas físicas, comunidades de bienes, entidades sin ánimo de lucro, comunidades de regantes) y a las explotaciones agràries de imputar a la aplicación presupuestaria 00.33615.77900 del presupuesto de gastos del Consorcio Sierra de Tramuntana para el año 2024 y al proyecto con financiación afectada 2024 (En 220240000467).
