    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015 por la que se convocan, subvenciones para la Creación de empresas de Jóvenes agricultores, correspondientes a los años 2015-2019, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Islas Baleares&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresidente en materia agraria del FOGAIBA, con fecha 9 de diciembre de 2024, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54).&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;2. Una vez analizada toda la documentación presentada, el vicepresidente del FOGAIBA resolvió favorablemente la concesión de la ayuda a favor de los interesados que figuran en el anexo de la Resolución con los datos y los importes correspondientes.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;3. El 28 de octubre de 2021, en el BOIB núm. 148, se publicó la Resolución de la concesión a los beneficiarios de las ayudas, REM4 de 20 de octubre de 2021, en la que se incluye MARIA VICTÒRIA CABALLERO RECIO (núm. Exp. CEJA2020_1/075), con un importe prima de 50.000,00€.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;4. El 22 de enero de 2022 (con registro de entrada REGAGE22e00001619890) la beneficiaria presenta la solicitud del primer pago parcial de la prima (50 %), por el que se realizó un pago por importe de 25.000,00 €.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;5. El 9 de octubre de 2023 (registro de entrada REGAGE23e00068254021), la beneficiaria presenta la solicitud del segundo pago y el servicio de gestión de ayudas al desarrollo rural revisa el expediente y se comprueba que las UGM del explotación no llegan a las 25 establecidas por ser beneficiaria del complemento de orientación productiva ganadera de 5.000,00 €.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;6. Este hecho implica realizar una revocación parcial de 5.000,00 €, por tanto, el importe de ayuda auxiliable es de 45.000,00 € y el pago correspondiente al 2º tramo será de una cuantía de 20.000,00 €.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;7. El 14 de noviembre de 2024 se notifica a la persona interesada, a efectos de cumplir con el trámite de audiencia para llevar a cabo las alegaciones, el informe Propuesta provisional de resolución de la revocación parcial por no cumplir con el complemento de orientación productiva ganadera de 25 UGM por importe de 5.000,00 € mediante publicación en la página web del FOGAIBA. Una vez transcurridos los 10 días hábiles, la persona interesada no ha presentado alegación alguna.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;8. Se ha considerado el Informe Propuesta provisional de resolución de la revocación parcial/Resolución de revocación parcial de la ayuda concedida a MARIA VICTÒRIA CABALLERO RECIO con NIF ***1150**, de día 14 de noviembre de 2024.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 10 de septiembre de 2015 por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014-2020 .&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Revocar parcialmente las resoluciones de ayuda concedidas a las personas beneficiarias por el importe y con los plazos detallados en el anexo de esta resolución, que es de 1 expediente y que comienza y termina con MARIA VICTORIA CABALLERO RECIO, que suma un importe total de 5.000,00 euros, relativa a la línea de ayuda “Creación de empresas de jóvenes agricultores”.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Finalizar el procedimiento de revocación del expediente CEJA2020_1/075.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Notificar esta resolución mediante la publicación en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Interposición de recursos &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consellera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/p&gt;
