INEA 2021_1/386 </strong></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El vicepresidente en materia orgánica del Fogaiba, en fecha 9 de diciembre de 2024, firmó la siguiente resolución.</span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Hechos</span></span></strong></p> <p>1. En fecha de 21 de diciembre de 2021 se publicó, en el Boletín Oficial de las Islas Baleares núm. 174, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante el procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias para el año 2021.</p> <p>2. El 12 de abril de 2024, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 52, del 20 de abril de 2024, en la que figuraba una concesión a favor del interesado señalado en el anexo adjunto.</p> <p>3. El 21 de febrero de 202, el interesado S.A.T SON BURGUES, con NIF V07447451, con registro de entrada núm. GOIBE134999/2023, presentó un nuevo plan empresarial donde se indicaba un cambio de modelo del tractor. La inversión inicial del tractor New Holland T5.115 DC era de 82.137,65€ y la del nuevo modelo New Holland T5.120 es de 82.995,00€.</p> <p>4. El 29 de octubre de 2024 se emite informe favorable de moderación de costes donde el coste elegible del tractor es de 82.995,00 €. de la hileradora Vicon es de 5.470,00 € y la rotoembaladora Vicon es de 42.739,00 €. Resultando un coste elegible total de 131.204,00€.</p> <p>5. El importe aprobado inicialmente para el tractor es de 82.137,65 €, por tanto la ayuda por la nueva inversión no puede superar la cantidad aprobada inicialmente.</p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p>6. Ante todo esto, se propone aceptar la modificación de inversiones como se indica en el anexo adjunto de esta resolución.</p> <p><strong>Fundamentos de derecho</strong></p> <p>1. Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, mediante el procedimiento anticipado de gasto, subvenciones para inversiones en las explotaciones agrarias para el año 2021.</p> <p>2. Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020.</p> <p>3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas</p> <p style="text-align:center"><strong>Propuesta de resolución </strong></p> <p>Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos:</p> <p>1. Aceptar el cambio de inversión en el anexo I adjunto, que es un total de 1 expediente, que comienza y termina por S.A.T SON BURGUES, con NIF V07447451, (exp. INEA2021_1/386).</p> <p>2. Notificar esta resolución a la persona beneficiaria mediante la publicación en el Boletín Oicial de las Islas Baleares.</p> <p><strong>Interposición de recursos</strong></p> <p>Contra esta resolución - que no agota la vía administrativa - se puede interponer recurso de alzada ante el consejero de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución , de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.
