    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Corresponde al Consejo Insular el ejercicio de la actividad de fomento en materia de cultura, de conformidad con el Estatuto de Autonomía de las Illes Balears (artículos 70.18 y 73) y la Ley 6/1994, de atribución de competencias a los consejos insulares en materia de patrimonio histórico, promoción sociocultural, depósito legal de libros y deportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las escuelas de música en los diferentes municipios de Menorca llevan a cabo una importante labor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Departamento de Cultura, Educación, Juventud y Deportes del Consejo Insular de Menorca quiere colaborar en esta labor de iniciación y formación musical que se desarrolla en los pueblos menorquines.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Plan Estratégico de Subvenciones del Presupuesto General del CIM para el ejercicio 2024 prevé, entre los objetivos generales del Departamento de Cultura, Educación, Juventud y Deportes, apoyar la iniciativa educativa de Menorca, con el objetivo específico de colaborar con los ayuntamientos en la labor de la formación musical que se desarrolla en los diferentes municipios de la isla.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las ayudas del curso 2022/2023 quedaron justificadas en el expediente de acuerdo con lo indicado en la base 11ª de las bases correspondientes a aquel curso: la justificación de la aplicación del fondo a percibir, del cumplimiento del resto de condiciones impuestas y de la finalidad que fundamenta la concesión de la subvención, se presentará junto a la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El artículo 17 &lt;em&gt;h &lt;/em&gt;y 17.3 de la Ley 4/2022, de 28 de junio, de consejos insulares, atribuye al Pleno, entre otros, aprobar las bases reguladoras de las subvenciones, atribución que puede delegar en favor del presidente, del Consejo Ejecutivo o de las comisiones reguladas en el artículo 18.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Acuerdo del Pleno del Consejo Insular de Menorca de carácter extraordinario de 31 de julio de 2023 (BOIB núm. 109 de 5 de agosto de 2023) delega en el Consejo Ejecutivo la aprobación del Plan Estratégico y las bases reguladoras de las subvenciones, en el marco de lo que establecen las bases reguladoras del presupuesto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El artículo 28.1 &lt;em&gt;m y &lt;/em&gt;28.2 de la Ley de consejos insulares atribuye al Consejo Ejecutivo, entre otros, la de aprobar las convocatorias de ayudas y subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Dada la propuesta del consejero ejecutivo del Departamento de Cultura, Educación, Juventud y Deportes, en ejercicio de las competencias atribuidas por el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares, en relación con el Decreto de presidencia núm. 91/2023, de 10 de julio, de creación de los departamentos (BOIB núm. 95 de 11 de julio de 2023) y de conformidad con la normativa básica aplicable al Consejo Insular de Menorca en materia de subvenciones y en el marco de lo que establecen las Bases de ejecución del presupuesto de esta administración;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consejo Ejecutivo, por unanimidad y en votación ordinaria, adopta los siguientes acuerdos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero. &lt;/strong&gt;Aprobar la convocatoria para la concesión de ayudas a las escuelas de música, para el curso escolar 2023/2024, que se regirán por las bases aprobadas en el Consejo Ejecutivo del Consejo Insular de Menorca en sesión ordinaria de día 3 de octubre de 2022, publicadas en el BOIB núm. 136 de 20 de octubre de 2022, de acuerdo con las siguientes condiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Importe global máximo de las ayudas y crédito presupuestario. Las ayudas concedidas se atenderán con cargo a la partida presupuestaria del año 2025, por este motivo se somete la resolución definitiva de esta convocatoria a la condición suspensiva de la existencia de crédito adecuado y suficiente en el presupuesto del CIM correspondiente al año 2025, y con los importes máximos que se indican más abajo, sin perjuicio de que los importes puedan ser ampliados en el supuesto de aportaciones expresas de terceros para contribuir a la financiación del objeto de la convocatoria concretados posteriormente a su aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) La ayuda máxima por solicitud será de 15.000 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) El plazo de presentación de solicitudes para acogerse a estas ayudas es de veinte días a partir del día siguiente de la publicación en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo. &lt;/strong&gt;La instrucción de este procedimiento es el técnico de gestión del Departamento de Cultura, Educación, Juventud y Deportes, Aleix Sintes Piris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;Se acuerda constituir la Comisión Evaluadora de estas ayudas, integrada por:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Presidente: El director insular responsable en materia de educación, Jaime Reurer&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Morlà&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto. &lt;/strong&gt;Comunicar esta resolución a la Base de datos nacional de subvenciones previamente a la publicación de la convocatoria en el &lt;em&gt;Boletín Oficial de las Illes Balears &lt;/em&gt;(BOIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra este acuerdo, que no agota la vía administrativa, puede interponerse un recurso de alzada ante la Comisión de Gobierno, por delegación del Pleno del Consejo Insular de Menorca (Acuerdo de 31-7-2023, BOIB núm. 109 de 5-8-2023), en el plazo de un mes a partir del día siguiente en que se haya publicado, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El mencionado recurso se entenderá desestimado, si no se notifica la resolución correspondiente, cuando hayan transcurrido tres meses des de su interposición. Contra la desestimación del recurso de alzada por silencio administrativo se puede interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
