806577 CAIB CAIB 300 es 2024-12-05 text/html CAIB 58607 2024-12-10 58589 ![CDATA[Resolución del consejero de Turismo, Cultura y Deportes por la que se convocan ayudas a los clubes deportivos de las Islas Baleares con equipos de deportes individuales y colectivos por su participación en competiciones de categoría nacional]] es 2024-12-10 ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DILIGENCIA: </strong>Expediente de tramitación anticipada de gasto correspondiente al ejercicio 2025 - Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos de las Islas Baleares, de acuerdo con la Resolución del consejero de Turismo, Cultura y Deportes de 4 de noviembre de 2024</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución del consejero de Turismo, Cultura y Deportes por la que se convocan ayudas a los clubes deportivos de las Islas Baleares con equipos de deportes individuales y colectivos por su participación en competiciones de categoría nacional.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">BDNS: 800160</span></span></p> <p><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">Antecedentes</span></strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 8.4.b) de la Ley 2/2023, de 7 de febrero, de la actividad física y el deporte de las Islas Baleares, establece que corresponde a la Administración de la Comunidad Autónoma de las Islas Baleares, en el ejercicio de sus competencias, fomentar y financiar la participación de deportistas y clubes deportivos que, como representantes de las Islas Baleares, participen en competiciones de ámbito estatal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El artículo 2.1.f de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras de la concesión de subvenciones en materia de deportes (BOIB núm. 23, de 16 de febrero), establece que es susceptible de ayudas los desplazamientos para asistir a competiciones oficiales.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otra parte, el artículo 5.1 de la misma Orden establece que las convocatorias que se dicten al amparo de estas bases deben aprobarse por resolución del consejero competente en deportes y deben publicarse en el Boletín Oficial de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Dada la naturaleza de las ayudas para desplazamientos, entrenamientos y manutención, el artículo 17, apartados 2 y 3, del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, y el artículo 6.7 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras de la concesión de subvenciones en materia de deportes permiten que la selección de los colegios de la empresa de la consejera de Deportes de la Universidad de Córdoba (SCJN) y el Instituto Nacional de Estadística (CNMV) y el Instituto Nacional de Estadística (ISSSTE) y el Instituto Nacional de Estadística (ISSSTE) y el Instituto Nacional de Estadística (ISSSTE) y de la Consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras de la concesión de subvenciones en materia de deportes permiten que la selección de los colegios de la empresa de la consejera de Deportes de la Universidad de Córdoba (SCJN) y el Instituto Nacional de Deportes (SCJN) y el Instituto Nacional de Estadística (ISSSTE) y el Instituto Nacional de Estadística (ISSSTE) y de la Consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras de la concesión de subvenciones en materia de deportes permiten que la selección de los colegios de la empresa de la consejera de Deportes de la Universidad de Córdoba (SCJN) y el Instituto Nacional de Estadística (CNMV) y el Instituto Nacional de Deportes (SCJN) beneficiarios se lleve a cabo por procedimientos que no son por sistema de reparto por puntuación cuando no sean necesarias la comparación y la prelación, en un único procedimiento, de todas las solicitudes entre sí. Las solicitudes de subvención se pueden resolver individualmente, aunque no haya terminado el plazo de presentación, a medida que éstas entren en el Registro de la Consejería de Turismo, Cultura y Deportes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Las ayudas susceptibles de ser otorgadas en esta convocatoria no implican ayudas de estado, de acuerdo con la Comunicación de la Comisión relativa al concepto de ayuda estatal conforme a lo dispuesto en el artículo 107, apartado 1, del Tratado de Funcionamiento de la Unión Europea, dado que los clubes deportivos no participan en competiciones deportivas de carácter profesional y por lo que no están ligados a una actividad económica. Quedan excluidas de esta convocatoria las categorías deportivas profesional de fútbol masculino (1ª división y 2ª división), de fútbol femenino (1ª división), de balonmano masculino (ASOBAL) y de baloncesto masculino (ACB).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Consejería de Turismo, Cultura y Deportes, mediante la Dirección General de Deportes, ejerce las competencias en materia de deporte y ocio, en cumplimiento del artículo 30.12 del Estatuto de autonomía de las Islas Baleares, y de acuerdo con lo dispuesto en el Decreto 10/2023, de 10 de julio, de la presidenta de las Islas Baleares, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares, modificado por el Decreto 16/2023, de 20 de julio de 2023.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fundamentos de derecho</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 15 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El artículo 5.1 de la de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021, establece que las convocatorias que se dicten al amparo de estas bases se tienen que aprobar por resolución del consejero competente en materia de deportes y deben publicarse en el Boletín Oficial de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El artículo 2.1.f de la citada Orden, prevé que son susceptibles de subvención los desplazamientos para asistir a competiciones oficiales.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Informe favorable de fecha 29/11/2024 de fiscalización previa limitada de la Intervención General de la comunidad autónoma.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, y en uso de las facultades que me atribuye la Ley 1/2019, de 31 de enero, del Gobierno de las Islas Baleares, dicto la siguiente</span></span></p> <p style="text-align:center"><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Resolución</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprobar la convocatoria de ayudas a los clubes deportivos de las Islas Baleares con equipos de deportes individuales y colectivos que participen en competiciones de categoría nacional, temporada 2024/2025, que figura en el anexo 1 de esta Resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las subvenciones otorgadas por la Consejería de Turismo, Cultura y Deportes, quedan reguladas fundamentalmente, según la legislación básica establecida por la Ley 38/2003, de 17 de noviembre, general de subvenciones, el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y por el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes y por la Instrucción 3/2007 de la Intervención General de la CAIB, de justificación de expedientes de subvenciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Tramitar esta convocatoria por el procedimiento de tramitación anticipada de expedientes de gasto, de conformidad con el artículo 43 y los siguientes del Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Islas Baleares, con lo que queda sometida a la condición suspensiva de existencia de crédito adecuado y suficiente en el presupuesto de la CAIB para el 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. font-size:12px">1.3 Las competiciones deben cumplir las condiciones siguientes:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Competiciones admitidas: </span></span></li> </ul> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Competiciones de categoría nacional absoluta, con un máximo de tres categorías nacionales por modalidad deportiva y sexo(*).</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Competiciones de máxima categoría nacional juvenil de fútbol y fútbol sala.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Circuitos internacionales de categoría absoluta.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">(*) No se contabilizarán las competiciones profesionales reconocidas por el CSD: primera y segunda divisiones de fútbol masculino, primera división de fútbol femenino, primera división de balonmano masculino y primera división de baloncesto masculino.</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fechas: deben tener lugar entre el 1 de agosto de 2024 y el 31 de julio de 2025.</span></span></li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Oficialidad: deben figurar en los calendarios de competiciones oficiales de las federaciones nacionales correspondientes, o federaciones internacionales miembros de la ASOIF, en el caso de los equipos participantes en circuitos internacionales. </span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Características de las competiciones: </span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las competiciones de categoría nacional deben implicar enfrentamientos con equipos de otras comunidades autónomas diferentes en la comunidad autónoma de las Islas Baleares. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso específico de deportes colectivos debe tratarse de ligas regulares, play-off o copas de categoría nacional.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los deportes individuales pueden presentar fases finales de competiciones por equipos, con el requisito de obtener el derecho a participar con una clasificación previa nacional o autonómica.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de los equipos de circuitos internacionales deben enfrentarse con otros equipos españoles o internacionales en territorio español.</span></span></li> </ul> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si durante el transcurso de la temporada deportiva se produce un cambio en el nombre de la competición deportiva, se entenderá que la competición es equivalente a la que aparece en la tabla con el nombre anterior.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si un club con un equipo que participa en una competición nacional o en un circuito internacional de un deporte que no aparece en la tabla anterior quiere solicitar esta subvención, deberá aportar la siguiente documentación:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Reglamento federativo de la competición, que deberá cumplir con las condiciones incluidas en estas bases.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de competición nacional certificado de la federación nacional correspondiente, explicando el proceso mediante el cual el equipo solicitante a adquirido los derechos para participar en la competición correspondiente.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que un club presente la documentación anterior, una comisión técnica será la responsable de determinar emitiendo un informe técnico, si el equipo en cuestión es susceptible de recibir la subvención de ayudas a equipos de categoría nacional o bien a equipos en circuitos internacionales.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Beneficiarios</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.1 Pueden ser beneficiarios de estas subvenciones los clubes deportivos regulados por el título V, sección 2ª, capítulo II, de la Ley 2/2023, de 7 de febrero, de la actividad física y el deporte de las Islas Baleares, y por el Decreto 147/1997, de 21 de noviembre, por el que se regulan la constitución y el funcionamiento de los clubes deportivos, modificado por el Decreto 214/1999, de 1 de octubre, inscritos en el Registro de Entidades Deportivas de las Islas Baleares, que acrediten la participación de alguno de sus equipos en la competición federativa de categoría nacional o la certificación para participar en un circuito internacional, previstas en la tabla del punto anterior.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.2 Quedan excluidos de esta convocatoria aquellos clubes con equipos que el momento de solicitar la subvención sean sociedades anónimas deportivas (SAD).</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Régimen de compatibilidad con otras ayudas</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.1 Como regla general, las ayudas que se concedan son compatibles con otras ayudas o subvenciones, independientemente de su naturaleza y de la entidad que las conceda, siempre que, aislada o conjuntamente, no superen el coste total de la actividad objeto de subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.2 Las entidades deportivas de las Islas Baleares que soliciten subvenciones que tengan por objeto la compensación de gastos de traslados a la Península, Islas Canarias, Ceuta y Melilla a otras administraciones o ente público o privado, nacionales o internacionales no pueden ser beneficiarías de las ayudas previstas en esta convocatoria.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Gastos subvencionables</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.1 Se subvencionan los siguientes gastos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Gastos de traslados del club deportivo para participar en las competiciones fuera de la isla de origen: gastos de desplazamientos a la península, Islas Canarias, Ceuta y Melilla y manutención de los deportistas y del equipo técnico, derivados de la participación del club en las competiciones deportivas objeto de la subvención en el plazo comprendido entre el 1 de agosto de 2024 y el 31 de julio de 2025.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Gastos de desplazamientos por tierra de los miembros del equipo fuera de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Gastos de participación en los entrenamientos oficiales de los deportistas y técnicos por cada una de las jornadas del calendario federativo oficial.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Gastos de inscripción a la competición nacional efectivamente pagados en el periodo comprendido entre el 1 de noviembre de 2024 y el 31 de julio de 2025. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Gastos de licencias deportivas, mutualidades y arbitrajes para la participación en la competición de categoría nacional en la temporada 2024-2025, del periodo comprendido entre el 1 de junio de 2024 y el 31 de julio de 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.2 No son objeto de esta convocatoria de subvenciones:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Los gastos o tasas pagadas a federaciones deportivas y/o ligas profesionales extranjeras, aunque se paguen a través de las federaciones deportivas españolas.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Gastos de alojamiento de los miembros del equipo sin perjuicio de los gastos de manutención por los desplazamientos fuera de la isla de origen.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Gastos de alojamiento, dietas, traslados de los árbitros o jueces deportivos.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Avales o seguros por la participación o inscripción del equipo en la competición deportiva.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Los gastos de desplazamientos entre las islas de la comunidad autónoma de las Islas Baleares, no son objeto de subvención de esta convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.3 Los equipos juveniles no podrán optar a las ayudas para la línea de subvención de traslados y manutención para la participación en play-off, copas y ligas internacionales, ni tampoco a la línea de subvención de gastos de participación en los entrenamientos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.4 Los equipos que participen en play-off de ascenso o copas no podrán optar a las ayudas para la línea de subvención de gastos federativos, ni a las ayudas para entrenamientos correspondientes a estas competiciones.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Importe máximo y crédito presupuestario</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.1. Documentación que hay que presentar</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.1 Documentación general: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Impreso de solicitud cumplimentado y firmado adecuadamente, en el que consten los datos del beneficiario.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Certificados de estar al corriente de las obligaciones tributarias con la Hacienda del Estado y con la Seguridad Social, en caso de que no autoricen la consulta en los términos del punto 6.5.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Declaraciones responsables:</span></span></p> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declaración responsable de la entidad que acredite que no se encuentra incluida en ninguno de los supuestos de prohibición o de incompatibilidad para ser beneficiaria de la subvención de conformidad con la normativa aplicable.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En caso de que no sean perceptores de la Comunidad Autónoma, una declaración responsable de veracidad de los datos bancarios aportados, como prevé el Decreto 6/2013, de 17 de febrero, de medidas de simplificación documental de los procedimientos administrativos; o un documento bancario que acredite la titularidad de la cuenta. El impreso normalizado de declaración responsable se podrá obtener en la sede o en la página web de la Dirección General de Deportes.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declaración responsable de todas las ayudas y subvenciones solicitadas o concedidas por cualquier institución, pública o privada, nacional o extranjera, relacionadas con la solicitud.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declaración responsable referente al cumplimiento de las obligaciones impuestas en el artículo 17 de la Orden de Bases y en el punto 16 de esta convocatoria.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Relación de los deportistas, entrenadores, preparadores físicos y fisioterapeutas del equipo. Este documento debe incluir como mínimo nombre, apellidos, documento oficial de identificación (DNI), tipo de relación laboral, profesional o de voluntariado con el club deportivo.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Declaración responsable de no haber sido sancionadas o condenadas en los últimos tres años por haber ejercido o tolerado prácticas laborales consideradas discriminatorias por razón de sexo o de género, sancionadas por resolución administrativa firme o condenadas por sentencia judicial firme.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.2 Documentación que se debe aportar por las ayudas relativas a los gastos de competición (Traslado en avión o barco, traslado por tierra fuera de las Islas Baleares, manutención y entrenamientos): </span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La documentación prevista en el apartado 14.3 de estas bases.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El calendario federativo de la competición nacional.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tríptico federativo (o documento análogo certificado por la federación) del equipo que presenta la solicitud. Este documento debe incluir como mínimo nombre, apellidos y cargo de los miembros (jugadores y técnicos) con licencia federativa de la plantilla del equipo para el que se presenta la solicitud.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.3 Documentación que se debe aportar por las ayudas de gastos federativas (gastos y tasas a federaciones deportivas, de arbitrajes, licencias y mutualidades de los deportistas y técnicos): </span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Presupuestos de gastos e ingresos relativo a los siguientes conceptos: </span></span></p> <ul style="margin-left:40px"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Gastos previstos de inscripción a la competición en el periodo comprendido entre el 1 de noviembre de 2024 y el 31 de julio de 2025.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Gastos realizados en el periodo comprendido entre el 1 de junio y el 30 de diciembre de 2024, de mutualidades y licencias de los deportistas y equipo técnico, desglosados individualmente, indicando nombre y apellidos, cargo, importe de la licencia e importe de la mutualidad.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Gastos previstos de arbitraje de competiciones oficiales para cada enfrentamiento, agrupadas, o bien indicando las competiciones a las que corresponden, correspondiente al periodo comprendido entre el 1 de junio de 2024 y el 31 de julio de 2025.</span></span></li> </ul> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Reglamento o circular de la federación española correspondiente que ficha las cuantías o importes de inscripción, licencias, mutualidades y arbitrajes, para la temporada 2024/25. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) En el caso de pagos de gastos de inscripción, licencias, mutualidades y arbitrajes, para la temporada 2024/25, a pagar a las federaciones deportivas de las Islas Baleares, se debe aportar el reglamento o circular correspondiente. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.4 En el modelo normalizado de solicitud de subvención que se pone a disposición de los interesados se prevé la autorización al órgano gestor de las ayudas para que lleve a cabo las actuaciones necesarias para la comprobación de los datos relativos al cumplimiento de las obligaciones tributarias con el Estado y con la Seguridad Social.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.5 En caso de que la entidad solicitante deniegue de manera expresa esta autorización, debe presentar, junto con la solicitud, los correspondientes certificados acreditativos de estar al corriente de las obligaciones tributarias con el Estado y con la Seguridad Social.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El órgano instructor incorporará de oficio al expediente el certificado de estar al corriente con las obligaciones tributarias con la comunidad autónoma de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El órgano instructor comprobará de oficio la constitución y la inscripción en el Registro de Entidades Deportivas de las Islas Baleares de los clubes deportivos de las Islas Baleares, así como la acreditación de la representación con la que actúa la persona firmante de la solicitud.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de que la Dirección General de Deportes, por causas ajenas a su voluntad, no pueda conseguir los documentos mencionados, requerirá a la persona o entidad solicitante que los aporte en el plazo de 10 días hábiles, siempre con anterioridad a la propuesta de resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.6 La Dirección General de Deportes, en cualquier momento, puede solicitar a los interesados la documentación y la información complementaria que considere necesaria para resolver el expediente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.7 Si la documentación aportada no cumple los requisitos exigidos, debe requerirse a la entidad interesada que, en el plazo de diez días hábiles, enmiende la carencia o adjunte los documentos preceptivos, con la advertencia de que, en el caso de que no lo haga, se considerará que desiste de la solicitud y se archivará el expediente sin más trámite, previa resolución que debe dictarse en los términos previstos en el artículo 21.1 de la Ley 39/2015, de 1 de octubre.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.9 El incumplimiento de los requisitos o del plazo de presentación de solicitudes establecidos en esta convocatoria comporta la inadmisión de la solicitud.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.10 La inexactitud, falsedad u omisión de carácter esencial en cualquier dato o documento que acompañe estas declaraciones deja sin efecto este trámite, desde el momento en que se conozcan y con audiencia previa a la persona interesada; en consecuencia, comportan la inadmisión de la solicitud de subvención, sin perjuicio de que puedan ser causa de revocación de la subvención, si se conocen con posterioridad a la concesión.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Con la firma de las declaraciones responsables, la persona firmante da su consentimiento para la realización de las verificaciones oportunas, desde la finalización del plazo de presentación de las solicitudes de subvención y hasta el cumplimiento por parte de la persona beneficiaria de la obligación de justificación de manera completa y correcta, y manifiesta, bajo su responsabilidad, que cumple los requisitos establecidos y que dispone de la documentación que lo acredita.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Plazo para presentar las solicitudes</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1 Las personas interesadas deben presentar las solicitudes de forma electrónica mediante el trámite telemático que estará disponible en el procedimiento publicado en la Sede Electrónica de esta Administración, de conformidad con el artículo 66.6 de la Ley 39/2015, se deberá adjuntar la documentación específica del procedimiento que estará disponible en la Sede Electrónica de esta Administración, firmada electrónicamente, en los siguientes plazos:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1.1 Plazos para presentar las solicitudes de los gastos de competición:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1.1.1 Gastos de competición del periodo comprendidos entre el 1 de agosto al 31 de diciembre de 2024: el plazo para presentar las solicitudes empieza día 13 de enero y acaba día 7 de febrero de 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1.1.2 Gastos de competición del periodo comprendidos entre el 1 de enero al 31 de julio de 2025: el plazo para presentar las solicitudes empieza día 2 de mayo y acaba día 15 de agosto de 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1.1.3 En este segundo plazo no se pueden presentar solicitudes de gastos de competición del periodo comprendidos entre el 1 de agosto al 31 de diciembre de 2024.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.1.2 Gastos federativos: el plazo para presentar solicitudes empieza día 11 de diciembre de 2024 y termina día 10 de enero de 2025.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.2 En caso de presentarla de manera presencial, la Administración, conforme a lo establecido en el artículo 68.4 de la Ley 39/2015, los requerirá para que la realicen en la forma indicada anteriormente. A estos efectos, se considerará como fecha de presentación de la solicitud aquella en que se haya llevado a cabo la enmienda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7.3 No se tendrán por presentadas en el registro las solicitudes que se presenten por cualquier otra vía telemática diferente de este trámite telemático.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Competencia y resolución</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.1 La Dirección General de Deportes es el órgano competente para instruir el procedimiento; es el órgano competente para tramitar los expedientes y debe hacer de oficio todas las actuaciones que considere necesarias para determinar, conocer y comprobar los datos. Los servicios técnicos de la Dirección General de Deportes deben emitir un informe que sirva de base para elaborar la propuesta de resolución. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.2 El órgano instructor puede solicitar al solicitante la modificación o la mejora voluntarias de los términos de la solicitud. En este caso debe extenderse un acta sucinta, que debe incorporarse al procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.3 En todo caso, el órgano instructor puede proponer la mejora de la solicitud y, en particular, la modificación del presupuesto presentado por la persona solicitante o las condiciones y la forma de realización de la actividad propuesta por él, siempre que ello no perjudique a terceras personas. En estos casos, debe solicitarse la conformidad de la persona solicitante, la cual debe entenderse otorgada si la propuesta formulada por el órgano instructor explicita claramente las modificaciones correspondientes y la persona solicitante no manifiesta oposición, por escrito, en un plazo de quince días. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cualquier otro caso, la solicitud debe mantenerse en los términos expresados por la persona solicitante en su escrito inicial, sin perjuicio de las correcciones que, en su caso, se desprendan del escrito de oposición que presente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.4 Sin perjuicio de lo previsto en el apartado anterior, la persona solicitante también puede modificar por sí misma la solicitud en los casos y bajo las condiciones establecidas en el artículo 16.3 del Texto refundido de la Ley de subvenciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.5 Si el procedimiento de concesión se paraliza por causa imputable al solicitante de la subvención, por la falta de cumplimiento de algún trámite preceptivo en el plazo otorgado al efecto, se le podrá declarar decaído en su derecho al trámite correspondiente, y la Dirección General de Deportes propondrá al consejero de Turismo, Cultura y Deportes la resolución del procedimiento; no obstante, siempre que no afecte a terceros, se admitirá la actuación del interesado y producirá sus efectos legales, si se produjera antes o dentro de día en que se notifique la resolución en que se tenga por transcurrido el plazo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.6 El director general de Deportes debe emitir las propuestas de resolución de concesión o denegación de las ayudas, las cuales deben contener la relación de los beneficiarios propuestos por los servicios técnicos de la Dirección General de Deportes para otorgar la subvención, así como las solicitudes excluidas con el motivo de la exclusión.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La propuesta de resolución del director general de Deportes contendrá todos los aspectos previstos en el artículo 16.4 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones y en el artículo 13.6 de la Orden de la consejera de Asuntos Social y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.7 De acuerdo con el artículo 45.1.b de la Ley 39/2015, de 1 de octubre, los actos a que se refiere el punto 8.6 anterior deben notificarse a las personas interesadas mediante la publicación, durante el periodo en que esta convocatoria sea vigente, en la página web de la Dirección General de Deportes de Consejería de Turismo, Cultura y Deportes, para que, en el plazo de diez días hábiles, puedan alegar lo que consideren oportuno y/o comunicar al órgano instructor la aceptación o renuncia de la propuesta.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.8 Una vez notificadas las propuestas de resolución, las entidades beneficiarias deben comunicar al órgano instructor la aceptación o renuncia de la propuesta en el plazo de 5 días hábiles. En todo caso, se considera que la persona beneficiaria desiste de la propuesta si no manifiesta la aceptación en el plazo otorgado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.9 La resolución expresa del consejero de Turismo, Cultura y Deportes finaliza el procedimiento de concesión de la subvención. Esta resolución contendrá los aspectos previstos en el artículo 14.1 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB núm. 23, de 16 de febrero de 2021).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las resoluciones dictadas en este procedimiento, que agoten la vía administrativa, deben ser objeto de publicación en el Boletín Oficial de las Islas Baleares, de acuerdo con el artículo 45.1 b) de la Ley 39/2015, de 1 de octubre; deben ser motivadas y deben fijar, en el caso de la concesión, la cuantía individual de la subvención concedida.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">8.10 El plazo máximo para resolver el procedimiento y notificar las resoluciones es de 6 meses desde la finalización del periodo de presentación de las solicitudes.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">​​​​​​​</span></span></strong><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Comisión Evaluadora para la línea de subvenciones de gastos federativos </span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.1 De conformidad al artículo 12 de la Orden de la consejera de Asuntos Social y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB núm. 23, de 16 de febrero de 2021), se constituye la Comisión Evaluadora, compuesta por:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Presidente: el jefe del Servicio de Administración Deportiva de la Dirección General de Deportes.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Secretaria: la jefa de la Sección VI de la Dirección General de Deportes.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Vocales: </span></span></p> </li> <li style="margin: 0px 0px 0px 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Dos técnicos de la Fundación Deporte Balear designados por la Dirección General de Deportes, a propuesta del Gerente de dicha fundación.</span></span></li> <li style="margin: 0px 0px 0px 40px;"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una funcionaria técnica superior de la Dirección General de Deportes nombrada por el director General de Deportes.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">9.2 Las funciones de la Comisión Evaluadora son:</span></span></p> <ul> <li style="margin: 0px;"> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Valorada las solicitudes presentadas.</span></span></p> </li> <li style="margin: 0px;"> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Emitir el informe que debe servir de base para elaborar la propuesta de resolución que debe formular la Dirección General de Deportes.</span></span></p> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las decisiones de la Comisión deben tomarse por mayoría simple y en caso de empate el presidente tiene el derecho de voto de calidad.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Criterios generales para evaluar las solicitudes</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.1. Para determinar si un equipo se evaluará según la categoría nacional en la que participa durante la temporada actual, se tendrá en cuenta la categoría en que estaba compitiendo la temporada anterior, el reglamento correspondiente y el resultado obtenido por el equipo al finalizar la misma.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aplicación del artículo 11.1 de la Ley 11/2016, de 28 de julio, de igualdad de hombres y mujeres, los baremos para evaluar las solicitudes se aplicarán de la misma forma y manera a los equipos masculinos y femeninos con el fin de conseguir una efectiva igualdad de género por parte de las entidades solicitantes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los equipos certificados para participar en circuitos internacionales organizados por federaciones internacionales reconocidas por la ASOIF se valorarán como los equipos de máxima categoría. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">10.2 se evaluará a los equipos de categoría nacional de acuerdo con los criterios establecidos en estas bases, si cumplen alguna de estas condiciones:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) El equipo sube a una categoría nacional por haber obtenido una posición en la clasificación de la categoría inmediatamente inferior (nacional o autonómica), que permite el ascenso directo atendiendo al reglamento vigente.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) El equipo sube a una categoría nacional (con una o varias plazas libres) habiendo quedado hasta tres posiciones por detrás de/s el equipo/s que consigue/en el ascenso directo por reglamento a la categoría inmediatamente inferior. Criterios de reparto y cuantía de las ayudas por gastos de competición</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.1 Las ayudas para la participación en competiciones de categoría nacional durante el plazo comprendido entre el 1 de agosto de 2024 y el 31 de julio de 2025 deben concederse con sujeción a los principios de publicidad, concurrencia y objetividad.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.2 Las ayudas para los gastos de competición, por la naturaleza de estas ayudas, de acuerdo con lo que establece el artículo 17, apartados 2 y 3, del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, y dado que no es necesaria la comparación y la prelación, en un único procedimiento, de todas las solicitudes entre sí, éstas se resolverán individualmente, a medida que entren en el Registro de la Consejería de Turismo, Cultura Sociales y Deportes y hasta que se agoten los créditos destinados a la convocatoria. Si se agotan los créditos destinados a la convocatoria antes de acabar los plazos de presentación, se debe suspender la concesión de nuevas ayudas mediante una resolución publicada en el BOIB.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.3 Las subvenciones se concederán cuando la entidad beneficiaria acredite que cumple los requisitos que establece esta convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">11.4 En caso de anulación del desplazamiento o de la competición, la Dirección General de Deportes únicamente debe asumir los gastos de los desplazamientos cuando la anulación sea a causa de fuerza mayor y se justifique documentalmente. Cálculo de la subvención por gastos federativos</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.1 Para el reparto de subvenciones de gastos federativos, se aplicará un sistema de reparto por puntuación. </span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cálculo de los puntos de cada beneficiario:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se otorgará 1,00 puntos por cada euro de gasto federativo, multiplicado por el factor corrector previsto en el punto 10.5 de esta convocatoria, en el caso de gastos de licencias, mutualidades y arbitrajes. </span></span></p> </li> </ul> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cálculo del valor punto:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para ello, se divide el importe de 310.000,00 €, entre la suma total de puntos obtenidos por todos los solicitantes, que nos dará el valor del punto. </span></span></p> </li> </ul> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cálculo de la subvención por cada beneficiario:</span></span></p> <ul> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La ayuda resultante será la obtenida de multiplicar el valor del punto por el número de puntos de cada solicitud. </span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si, como consecuencia de esta distribución queda un remanente, se repartirá con el mismo sistema entre el resto de entidades beneficiarias.</span></span></p> </li> </ul> </li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.2 Sólo serán objeto de subvención de los gastos federativos de las mutualidades y licencias de los deportistas y técnicos del equipo objeto de subvención que aparecen en el tríptico federativo presentado, hasta el máximo de personas establecido en la tabla 1 – PAX DEPORTES, según el deporte al que se haga referencia.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.3 No se aceptarán gastos de operaciones de "transfer" para traspasar a un jugador internacional de un país a otro.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.4 En caso de que un club presente licencias dobles o triples de algún deportista (para competir en diferentes ligas nacionales de varios países), sólo se tendrá en cuenta, a efectos de evaluación, el importe correspondiente a una licencia simple.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.5 No se aceptarán gastos de licencias que se correspondan con pagos a otros clubes para cubrir los gastos de formación de los deportistas que hayan pasado previamente por sus equipos. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.6 El importe correspondiente a mutualidades y licencias debe estar también certificado por la federación deportiva correspondiente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">13.7 El importe de los arbitrajes no incluye los traslados, dietas y estancias de los árbitros y/o jueces.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14. Justificación de actividades y pago de la ayuda</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.1 El pago de la subvención únicamente se puede hacer efectivo una vez presentada toda la documentación conforme y completa, y una vez dictada la correspondiente resolución de otorgamiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.2 Las subvenciones otorgadas deben justificarse mediante:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Subvenciones por desplazamientos, y participación en los entrenamientos oficiales, por medio de módulos previsto en los artículos 23 y 24 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras para conceder subvenciones en materia de deportes (BOIB núm. 23, de 16 de febrero).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Subvenciones de los gastos federativos (inscripción a la competición, arbitrajes, licencias federativas y mutualidad) mediante la presentación de la cuenta justificativa simplificada, de acuerdo con el artículo 21 de la Orden de la consejera de Asuntos Sociales y Deportes de 12 de febrero de 2021 por la que se establecen las bases reguladoras de la concesión de subvenciones en materia de deportes (BOIB núm. 23, de 16 de febrero), en el momento de presentar la solicitud de la subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.3 La justificación de la subvención para gastos de competición (desplazamientos, manutención y participación en los entrenamientos oficiales), se debe llevar a cabo mediante la presentación de la documentación siguiente, en el momento de presentar la solicitud de la subvención:</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Un informe de actuación justificativo del cumplimiento de las condiciones impuestas para la concesión de la subvención. El informe de la actuación del equipo, que debe incluir como mínimo:</span></span></p> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Nombre, apellidos, núm. de licencia federativa, categoría, edad y nacionalidad de los deportistas del equipo.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Relación de partidos o pruebas: fecha, lugar, equipo contrario y resultado.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para cada desplazamiento:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aeropuerto/puerto de salida y aeropuerto/puerto de llegada.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Localidad destino.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fechas de la competición o competiciones (más de un partido) en el destino.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Día de salida – Día de vuelta.</span></span></p> </li> </ul> </li> </ul> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Un informe económico justificativo, que debe contener los puntos siguientes:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Acreditación o, en su de no, declaración de la persona o entidad beneficiaria sobre el número de unidades físicas consideradas como módulo (deportistas y técnicos que aparecen en el acta del partido o prueba deportiva)</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Cuantía de la subvención calculada en base a las actividades cuantificadas en el informe de actuación y los módulos previstos en la convocatoria (Justificación módulos).</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Acreditación o, en su de no, declaración de la entidad beneficiaria sobre los gastos subvencionables que se han efectuado en el periodo comprendido entre el 1 de agosto de 2024 y el 31 de julio de 2025 y han sido efectivamente pagados en el mismo periodo. Se considerará efectivamente pagado el gasto, a efectos de su calificación como subvencionable, si el pago ha sido practicado mediante papel moneda y la moneda metálica, nacionales o extranjeros, cheques bancarios al portador o nominativo, pagaré, letras de cambio o similares, tarjeta de crédito o transferencia bancaria. No tendrá la consideración de gasto efectivamente pagado el pago practicado mediante la compensación de facturas de traslados o manutención con facturas de publicidad o patrocinio.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Copia del acta de todos los partidos o de las pruebas deportivas o certificado de la federación deportiva correspondiente relativo a la participación o la asistencia del deportista o del club a la competición y a los entrenamientos, así como de la asistencia de personal técnico (entrenadores, delegado de equipo, etc.).</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Sólo tendrá la consideración de gasto efectivamente justificado mediante los módulos de desplazamientos, manutención y entrenamientos los deportistas y técnicos que aparecen en el acta del partido o prueba deportiva, y como máximo el número de deportistas y técnicos previsto en la Tabla 1 – PAX Deporte del punto 12.1.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) En el caso de equipos de primera categoría (según la tabla de categorías del punto 1.4), se podrán añadir hasta dos personas más al número indicado en la Tabla 1 – PAX Deporte del punto 12.1, siempre que éstas no sean deportistas y aparezcan en el acta de la competición. Esto sólo será aplicable a gastos de desplazamientos y manutención. </span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) En el caso de equipos de segunda categoría (según la tabla de categorías del punto 1.4), se podrá añadir una persona más al número indicado en la Tabla 1 – PAX Deporte del punto 12.1, siempre que ésta no sea un/a deportista y aparezca en el acta de la competición. Esto sólo será aplicable a gastos de desplazamientos y manutención.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g) A los efectos de la justificación de la subvención del Consejo Superior de Deportes para los traslados a la península, Islas Canarias, Ceuta y Melilla una copia digitalizada de las facturas de los traslados en avión o barco y del documento acreditativo de su pago.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h) Las entidades beneficiarias están dispensados de la obligación de presentar libros, registros y documentos de trascendencia contable o mercantil, sin perjuicio de los requerimientos que puedan hacer los órganos administrativos competentes para comprobar y controlar la aplicación de la subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.4 Los beneficiarios de las subvenciones relativas a los gastos federativos (de inscripción, de arbitrajes, mutualidades y licencias deportivas) deben presentar la documentación que acredite la realización del gasto mediante una cuenta justificativa, firmada por la persona o la entidad beneficiaria o bien quien la represente, que debe tener el contenido siguiente:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Un informe de actuación justificativo del cumplimiento de las condiciones impuestas a la concesión de la subvención, con indicación de las actividades llevadas a cabo y de los resultados obtenidos.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Un informe económico justificativo del coste de las actividades llevadas a cabo, que debe contener:</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1º. Una relación clasificada de los gastos e inversiones de la actividad, con identificación del acreedor y del documento, el importe, la fecha de emisión y, en su caso, la fecha de pago. En el caso de que la subvención se otorgue de acuerdo con un presupuesto, se deben indicar las desviaciones acaecidas.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2º. La indicación, en su caso, de los criterios de reparto de los costes generales o indirectos incorporados en la relación clasificada de los gastos antes mencionados.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3º. Una relación detallada de otros ingresos o subvenciones que hayan financiado la actividad subvencionada con indicación del importe y la procedencia de los mismos.</span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4º. Los tres presupuestos que, en su caso, y en aplicación del artículo 40.3 del Texto refundido de la Ley de subvenciones, debe haber solicitado la persona o la entidad beneficiaria.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Copias digitalizadas de las facturas o los documentos de valor probatorio equivalente en el tráfico jurídico mercantil o con eficacia administrativa incorporados que justifiquen los gastos incorporados a la relación a que hace referencia la letra b anterior y la documentación acreditativa del pago.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En la justificación se debe indicar claramente a qué actividad de las previstas en el plan de actuación presentado corresponden los justificantes aportados, así como a qué conceptos del presupuesto previsto se refieren, rellenando la casilla correspondiente de la cuenta justificativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Cuando los justificantes de los gastos se imputen parcialmente a otras subvenciones, se deberá indicar la cuantía exacta o porcentaje imputado a cada una.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La justificación que presente la entidad beneficiaria también debe incluir los siguientes documentos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Memoria que justifique la realización del proyecto deportivo presentado, incluyendo como mínimo relación de partidos o campeonatos, fechas y lugar de realización, resultado de la competición y número de componentes del equipo de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Clasificación final de la competición.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Liquidación definitiva del presupuesto con el estado comparativo entre el presupuesto presentado con la solicitud y el finalmente realizado. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.5 La Dirección General de Deportes para comprobar los justificantes que considere desproporcionados en relación con otros justificantes por el mismo concepto de otros clubes deportivos de la misma categoría y deporte, puede requerir a la entidad beneficiaria el envío de los justificantes seleccionados.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.6 Si la documentación aportada por la justificación de la subvención no cumple los requisitos exigidos, debe requerirse a la entidad interesada que, en el plazo de decimoquinto días, enmiende la carencia o adjunte los documentos preceptivos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.7 Con carácter general, el importe de las subvenciones debe abonarse, una vez justificado el cumplimiento de la finalidad para la que se concedieron, a partir de lo que resulte de la liquidación de la justificación de la subvención. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.8 La liquidación de la subvención debe dictarse y notificarse en el plazo de nueve meses a contar desde la presentación de la justificación por la persona interesada o, en su caso, desde el día siguiente del plazo máximo para presentarla, sin perjuicio de que, previamente, deba requerirse a la persona interesada para que la presente en un plazo adicional de quince días improrrogables.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.9 Para el cómputo del plazo de nueve meses a que se refiere el párrafo anterior no se deben tener en cuenta los periodos de interrupción justificada de las actuaciones ni las dilaciones que se puedan producir por causas no imputables a la administración concedente, siempre que se documenten de manera adecuada haciendo constar los datos de inicio y finalización de cada periodo, por días naturales, y el motivo de la interrupción o la dilación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.10 La liquidación de la subvención debe dictarse en el marco de las actuaciones de comprobación, y que constituye un presupuesto de la obligación de pago total que, en su caso, corresponda a favor de la persona interesada y a cargo de la administración concedente, así como, en su caso, del inicio por el órgano competente y a instancia del órgano gestor del procedimiento de revocación o de reintegro total o parcial de la subvención concedida y no justificada. total, o parcialmente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.11 En todo caso, la liquidación de la subvención por el órgano gestor no impide ni afecta a la realización de otras actuaciones ulteriores de control interno o externo previstas en esta ley y en el resto de la legislación aplicable por parte de los órganos competentes en cada caso, con el alcance y las consecuencias jurídicas correspondientes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.12 El transcurso del plazo máximo para dictar y notificar la liquidación no impedirá que el órgano gestor la dicte y la notifique, salvo, si procede, que antes de dictarla se hayan iniciado otras actuaciones de control por los órganos a que se refiere el apartado anterior o se haya iniciado un procedimiento de revocación o de reintegro de la subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.13 En todo caso, no serán exigibles los intereses moratorios que, en su caso, se devenguen entre el día siguiente del transcurso de este plazo máximo y el inicio de un procedimiento de reintegro.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.14 Sin perjuicio del resto de supuestos a que hace referencia el artículo 39.2 de la Ley general de subvenciones, cuando la persona interesada presente la justificación de la subvención en el plazo correspondiente, el cómputo del plazo de prescripción del derecho de la administración concedente a liquidar el eventual reintegro que, en su caso, corresponda se inicia al día siguiente de la notificación de la liquidación de la subvención o del transcurso del plazo máximo para dictarla y notificarla.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.15 Los beneficiarios están dispensados de la obligación de presentar libros, registros y documentos de trascendencia contable o mercantil, sin perjuicio de los requerimientos que puedan hacer los órganos administrativos competentes para comprobar y controlar la aplicación de la subvención.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.16 Si la documentación aportada por la justificación de la subvención no cumple los requisitos exigidos, debe requerirse a la entidad interesada que, en el plazo de quince días hábiles, enmiende la carencia o adjunte los documentos preceptivos.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">14.17 Sin embargo, las resoluciones de concesión pueden establecer condiciones concretas para justificar las subvenciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">15. Plazo de justificar</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">15.1 Ayudas para gastos de competición: dado que la documentación para justificar la ayuda debe presentarse en el momento de la presentación de la solicitud, los plazos para justificar son los mismos que los de solicitud (apartado 7.1.1 de esta convocatoria)</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">15.2 Ayudas para gastos federativos: El último día para justificar es día 27 de junio de 2025. </span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">16. Obligaciones de los beneficiarios</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Son obligaciones de las entidades beneficiarias de las ayudas:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Llevar a cabo la actividad que fundamente la concesión de la subvención en la forma y el plazo establecidos en la convocatoria, así como, en su caso, en la resolución de concesión correspondiente o en las modificaciones que se aprueben.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Destinar el importe de la subvención a la financiación de la actuación para la que se haya solicitado, en la forma y plazo que se indiquen en la convocatoria y, en su caso, en la resolución correspondiente o en las modificaciones que se aprueben.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Comunicar en el plazo de 15 días hábiles al órgano que concede la subvención la modificación de cualquier circunstancia que afecte a alguno de los requisitos exigidos para conceder la subvención.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Adoptar, si procede, de acuerdo con lo que se establezca en las convocatorias correspondientes, las medidas de difusión consistentes en hacer constar en los informes anuales que se redacten, así como en los trabajos, actividades, publicaciones, documentos o actos públicos relacionados con la finalidad de la subvención, la financiación de la Comunidad Autónoma de las Islas Baleares y, en su caso, la cofinanciación con fondos de la Unión Europea, y más concretamente la imagen corporativa de la Dirección General de Deportes de la consejería competente en materia de deportes y, en su caso, la imagen de la Unión Europea. Una copia de las publicaciones debe enviarse a la Dirección General de Deportes.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Someterse a las actuaciones de comprobación y control que correspondan de las administraciones autonómica, estatal y comunitaria, la Sindicatura de Cuentas y otros órganos de control externo, así como facilitar toda la información que éstos les requieran con relación a las ayudas concedidas.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Comunicar a la Dirección General de Deportes la solicitud o la obtención de subvenciones o ayudas para la misma finalidad procedentes de cualquier administración o ente público o privado, nacional o internacional. Esta comunicación debe hacerse dentro del plazo de tres días hábiles desde la solicitud o la obtención de la subvención concurrente y, en todo caso, antes de la justificación de la subvención concedida.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g) Comunicar inmediatamente a la Dirección General de Deportes cualquier eventualidad que altere o dificulte gravemente el desarrollo del proyecto objeto de la ayuda.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h) Comunicar por escrito de manera inmediata a la Dirección General de Deportes el cambio de titularidad de la plaza o cualquier incidencia que afecte a la titularidad de la plaza.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">i) No transmitir a terceros los derechos de la plaza que tiene durante la temporada deportiva en curso y por la que recibe la subvención.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">j) Estar al corriente de las obligaciones tributarias o de cualquier naturaleza, con el Estado, con la Seguridad Social y con la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">k) Conservar los justificantes de los gastos correspondientes a la actividad subvencionada durante 5 años y ponerlos a disposición de la Consejería cuando ésta los solicite.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">l) Durante la temporada 2024-2025, el club se compromete a ofrecer la colaboración necesaria para que todos o algunos de sus deportistas y técnicos, si las obligaciones deportivas y personales se lo permiten, participen en el proyecto de comunicación del Gobierno de las Islas Baleares, la Consejería de Turismo, Cultura y Deportes y la Dirección General de Deportes a recepciones, fiestas, actos benéficos, promociones, etc.</span></span></p> <p>​​​​​​​<strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">​​​​​​​</span></span></strong><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">17. Revocación</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debe revocarse la concesión de la subvención cuando, posteriormente a la concesión válida y ajustada a derecho, la entidad beneficiaria incumple total o parcialmente las obligaciones o los compromisos contraídos a los que está condicionada la eficacia del acto de concesión.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">18. Reintegro</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">18.1 Como consecuencia de la revocación debe reintegrarse total o parcialmente el importe de la ayuda obtenida y, en su caso, la exigencia del interés de demora, en los siguientes casos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) El incumplimiento de la finalidad para la que se concedió la ayuda.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) La obtención de la ayuda sin que se cumplan las condiciones requeridas para ello, o la alteración de las condiciones tenidas en cuenta para concederlo, siempre que sea por causas imputables a la entidad beneficiaria.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) El incumplimiento grave de la obligación de justificar la finalidad de los fondos percibidos en la forma y plazos establecidos.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) La concurrencia de subvenciones incompatibles para la misma actividad.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) La negativa a someterse a las actuaciones de comprobación y control previstas legalmente o la obstrucción injustificada de estas actuaciones.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Otros supuestos establecidos en las bases reguladoras.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">18.2 Para el reintegro, debe aplicarse el procedimiento que determina a tal efecto el artículo 44 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">18.3 Las cantidades reintegrables tienen la consideración de ingresos de derecho público y pueden ser exigidas por la vía de apremio.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">19. Régimen de infracciones y sanciones</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El incumplimiento de los requisitos que determina esta Resolución da lugar a aplicar el régimen de infracciones y sanciones establecidas legalmente.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">20. Inspección</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con lo dispuesto en esta convocatoria, las ayudas que concede la Consejería de Turismo, Cultura y Deportes deben someterse a la inspección correspondiente según la normativa legal vigente de aplicación.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">21. Protección de datos</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el caso de que el objeto de la subvención incluya el tratamiento de datos de carácter personal, los beneficiarios deben cumplir con la normativa correspondiente, adoptando e implementando las medidas de seguridad previstas por la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.</span></span></p> ]] 694389
