    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Visto el informe técnico con propuesta de resolución de día 30 de julio de 2024, y de acuerdo con el apartado 1 del artículo único del Decreto 5/2024, de 29 de mayo, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, y la disposición transitoria primera del Decreto ley 3/2024, de 24 de mayo,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESUELVO FORMULAR:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;El informe ambiental estratégico la modificación puntual de las normas subsidiarias de Campos por la clasificación como suelo urbano de una zona de servicios industriales y de equipamiento docente y cambio de calificación de una parcela de equipamiento recreativo a servicios industriales , en los siguientes términos:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. Determinación de sujeción a evaluación ambiental y tramitación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La modificación puntual de las normas subsidiarias de Campos por la clasificación como suelo urbano de una zona de servicios industriales y de equipamiento docente y cambio de calificación de una parcela de equipamiento recreativo en servicios industriales se tramita como una evaluación ambiental estratégica simplificada ya que se encuentra incluida dentro de los supuestos establecidos en el apartado 2 del artículo 6 de la Ley 21/2013, de 9 de diciembre, de Evaluación Ambiental y en la letra a) del apartado 3 del artículo 12 del Decreto legislativo 1/2020, de 28 de agosto, por el que se aprueba el Texto Refundido de la Ley de evaluación ambiental de las Islas Baleares. La tramitación a seguir es la que se establece en el artículo 29 y siguientes de la Ley 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. Descripción y ubicación de la modificación puntual&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Las vigentes Normas Subsidiarias de Campos fueron aprobadas definitivamente el 26 de marzo de 1991. Desde entonces se han llevado a cabo diversas modificaciones puntuales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Modificación de los artículos 32, 93 y 101 relativos a las condiciones de altura generales y de las zonificaciones del casco antiguo I) y zona intensiva del núcleo de Campos (BOIB n. 69, de 06.05.2010).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La revisión del planeamiento vigente se encuentra actualmente en trámite mediante la formulación de un Plan general municipal y Plan de ordenación pormenorizada, cuyo avance fue aprobado el 28 de enero de 2021 (BOIB n, 17, de 09.02.21 ).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El objeto de esta modificación es:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- La clasificación como suelo urbano de servicios industriales de las parcelas así clasificadas por la modificación de las Normas Subsidiarias de 1998, que fueron anuladas por sentencia del TSJ de 2006, que determinó la consideración de estos terrenos como suelo urbanizable industrial (NS de 1993) y que, posteriormente, quedaron clasificadas como suelo rústico a consecuencia de la disposición adicional 16 de la LUIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El cambio de calificación urbanística de una parcela “de equipamiento recreativo” a “servicios industriales”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Modificación de los artículos 113 y 114 para su adaptación a la Ley 10/2019, de 22 de febrero, de cambio climático y transición energética, y al Plan director sectorial de equipamientos comerciales de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Incorporar en el suelo urbano el suelo destinado al equipamiento docente existente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Calificar de área de transición una zona de suelo rústico&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El ámbito de esta modificación puntual es el configurado por las siguientes parcelas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- La clasificación del suelo urbano, es el comprendido por las siguientes parcelas catastrales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0353405ED0605S0001ZU (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0353406ED0605S0001UU (parcela de la vacante).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0353407ED0605S0001HU (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0552301ED0605S0002UI (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0552302ED0605S0001GU (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0552303ED0605S0001QU (parcela de la vacante).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0652901ED0605S0001XU (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0652904ED0605S0001EU (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0652905ED0605S0001SU (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Siendo la superficie de este ámbito, según Catastro, lo siguiente: 39.748 m2 de suelo lucrativo privado, más la parcela de equipamiento docente público (07013A005001080001WF) de 10.067 m2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- La calificación como Servicios Industriales (SI) de la parcela actualmente calificada como Equipamiento Recreativo comprende el siguiente ámbito:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- 0754302ED0605N0001OX (parcela de la edificada).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Siendo la superficie de este ámbito, según Catastro, la siguiente: 14.209 m2.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Esta modificación se justifica, no sólo por el tiempo transcurrido desde el planeamiento del 91, sino por la necesidad de regularizar una situación urbanística respecto de unas parcelas que dan a acceso público y cuentan, con vial rodado, además, de todos los servicios urbanos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cuanto al cambio de calificación urbanística, éste responde al sentido actual de no permitir un uso recreativo privado en un polígono industrial y que esta parcela se destine a “Servicios Industriales” que es el uso prioritario en este sector.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. Evaluación de los efectos previsibles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Según el documento ambiental estratégico, la modificación puntual de las NNSS de Campos no tiene efectos significativos hacia el medio ambiente. Las conclusiones del documento han sido las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- No supone un nuevo crecimiento de zonas edificadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- No existe ninguna interferencia con la normativa supramunicipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- No existe afección directa ni indirecta sobre espacios de la Red Natura 2000 ni hacia otras figuras o especies protegidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- No se detecta flora protegida en los ámbitos afectados por ser un entorno urbano.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El incremento del consumo de agua no es relevante, aunque el acuífero no está en buen estado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- No se contempla un efecto significativo respecto al paisaje (incidencia visual)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- La extensión del proyecto no excede de los límites de las edificaciones ya existentes donde se quiere desarrollar. No se considera que se genere ningún impacto con carácter transfronterizo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como aspectos positivos se han destacado los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Otorga seguridad jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Mujer coherencia jurídica y territorial en la zona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Nula incidencia paisajista del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las afecciones más destacables en materia ambiental son:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fase de construcción:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Consumo de combustible, emisión de partículas contaminantes a la atmósfera; por tanto, contribución al cambio climático, de forma puntual en la fase de construcción, respecto a esta afección hay medidas preventivas que merman la afección.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Ruidos y vibraciones en la fase de construcción, de forma puntual y de menor impacto debido a ser pequeñas herramientas (taladros, etc).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Consumo energético y de agua muy puntual y escaso, necesario para el desarrollo de las obras.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se han tenido en cuenta los impactos asociados a la fase de explotación o uso aunque no se modifican porque no existen actuaciones:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Consumo de agua y aguas residuales: se considera muy limitado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Consumo energético. Se considera reducido, principalmente por la aportación de las placas solares que contribuyen de forma positiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Generación de residuos: se considera reducido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Hay que tener en cuenta que los efectos derivados están sujetos a las características actuales de la tecnología y, por tanto, escasamente el impacto puede disminuir.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se incorporan medidas preventivas y correctivas que minimizan los impactos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se pretende trabajar en un polígono sostenible e implicar a las diferentes partes interesadas desde la perspectiva de la economía circular y el ahorro – huella de carbono e hídrica; de forma colaborativa entre el Ayuntamiento y las empresas que ocupan el espacio que nos ocupa en el presente documento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Se propone por parte del Ayuntamiento realizar supervisiones sobre las medidas ambientales implementadas en cada proyecto y orientar previamente a la fase de planificación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) Se supervisará la correcta ejecución de las obras a nivel de afección en la zona pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3) Se revisará o solicitará periódicamente a las actividades en uso las medidas ambientales implementadas y los cambios o inversiones ambientales desarrollados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4) En las nuevas ejecuciones, se solicitará la correcta gestión de residuos según marca legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Junto con el documento ambiental estratégico se genera un estudio de evaluación de la movilidad generada, donde señala que la accesibilidad y movilidad de esta zona se concentra en el Camino Viejo de Ciudad que es el eje urbano de conexión de todas las parcelas del polígono y que no plantea problemas de circulación dada su anchura actual, si bien, como ha indicado el PMUS, cuando se desarrolle todo el polígono será necesario disponer de un aparcamiento disuasivo que sirva, además , en el resto de población del núcleo y visitantes, dado que el aparcamiento a lo largo del vial público será insuficiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4. Consultas en las administraciones públicas afectadas y personas interesadas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En fecha 27, 28, 29 de mayo de 2024 tienen salida los oficios de consulta y petición de informe en relación con el asunto según los artículos 29 y siguientes de la Ley 21/2013, de 9 de diciembre, de evaluación ambiental dirigidos a las administraciones y personas afectadas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Amigos de la Tierra (RS GOIBS302092/2024).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Consejo de Mallorca, Departamento de Territorio, Dirección Insular de Territorio y Paisaje (RS GOIBS302344/2024).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;En todas las edificaciones e instalaciones, cualquiera que sea su titularidad, debe implantarse progresivamente el consumo de energía renovables&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;Modificación del artículo 51.1 Ley 10/2019 con el Decreto 3/2024:&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;Las nuevas edificaciones o las que tengan un cambio de uso en suelo rústico deben cubrir la totalidad o parte del consumo anual eléctrico previsto mediante la instalación de generación renovable de autoconsumo. La instalación de autoconsumo puede ser aislada o conectada a la red, y en este último caso la potencia mínima de generación a instalar será la que determinen dos horas de uso diario de la potencia prevista calculada según lo establecido en el Reglamento electrónico para baja tensión, aprobado por Real Decreto 842 /2002, de 2 de agosto.&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;Mediante resolución del consejero competente en materia de energía, dictada en el marco del título IV de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, se puede modificar la potencia mínima de generación renovable a instalar.&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;Artículo 59.1 Ley 10/2019&lt;/span&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;Las nuevas instalaciones térmicas deben utilizar preferentemente la energía de origen renovables&lt;/span&gt;&lt;/p&gt;
			&lt;/td&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;MOVILIDAD SOSTENIBLE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;De acuerdo con la Ley 4/2014, de 20 de junio, de transportes terrestres y movilidad&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;sostenible de las Islas Baleares, debe llevarse a cabo un Estudio de movilidad, valorando el número de vehículos actual y el posible aumento debido a las intervenciones previstas en el proyecto, las plazas previstas y la movilidad inducida y/o reducida y el afección a la contaminación atmosférica y al cambio climático. Igualmente de acuerdo con el artículo 59.4 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las IllesBalears (LUIB) también debe incorporarse. De acuerdo con el artículo 60 de la Ley 10/2019 de Cambio Climático, dice que las administraciones públicas deben promover la movilidad sostenible, sin perjuicio de las determinaciones y competencias de la Ley 4/2014, de 20 de junio, de transportes terrestres y movilidad sostenible de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;PROPUESTA DE MOVILIDAD&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Como resultado de lo anterior, se han elaborado una serie de planos de justificación de&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;la accesibilidad y movilidad de esta zona se concentra en el Camino Viejo de Ciudad que es el eje urbano de conexión de todas las parcelas del polígono y que no plantea problemas de circulación dada su anchura actual, si bien, como ha indicado el PMUS, cuando se desarrolle todo el polígono será necesario disponer de un aparcamiento disuasorio que sirva, además, al resto de población del núcleo y visitantes, dado que el aparcamiento a lo largo del vial público será insuficiente.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por eso, una medida adicional, es eliminar la línea de aparcamiento cercana al vial para ampliar la zona peatonal con un carril para bicicletas con arbolado mediterráneo de bajo requerimiento hídrico para conseguir sombra peatonal y personas con movilidad de vehículos de uso individual sin emisiones, como pueden ser bicicletas y patinetes. Actualmente, los negocios que desarrollan su actividad tienen un espacio exterior para aparcamiento para clientes. Los futuros negocios deberían contemplarlo en caso de nueva construcción.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Vulnerabilidad frente al cambio climático y medidas destinadas a reducirla&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la siguiente tabla se identifican los impactos, y se añaden medidas adicionales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Cálculo de la huella de carbono de la modificación puntual&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Especificación de la reserva de suelo para dar cumplimiento al apartado 2 de el artículo 20 del Decreto 3/2024.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Se solicita que en la tramitación ordinaria se considere incluir:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;1. Reservar un área de suelo (o cubierta de las edificaciones) destinado a la generación de energías renovables.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. Crear medidas de compensación, tales como, una conexión de las nuevas parcelas destinadas a suelo industrial con el núcleo del pueblo mediante un carril destinado a bicicletas, patinetes y peatones. Esta vía de conexión debe de tener sombra con vegetación arbórea mediterránea de bajo requerimiento hídrico.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Si se realiza un aparcamiento disuasorio, deberá cumplirse con la ley 10/2019: reserva de aparcamiento para vehículos libre de emisiones e instalación de puntos de recarga. Además, instalar placas fotovoltaicas en toda la cubierta del aparcamiento; se recomienda crear una comunidad energética por los residentes de la localidad y las empresas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. Desarrollar las acciones afectadas por la Modificación puntual del PACES de Campos.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;5. Todas aquellas medidas adicionales mencionadas en los apartados 2 y 3 de las consideraciones técnicas.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Consejería de Agricultura, Pesca y Medio Natural&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- El Servicio de Protección de Especies de la Dirección General de Medio Natural y Gestión Forestal, el 26 de junio de 2024, informó:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;«Consideraciones técnicas&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;(...)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• &lt;em&gt;De acuerdo con el informe de evaluación estratégica simplificada no existe presencia de vegetación con protección. En cuanto a la fauna, identifica algunas especies cercanas a los sectores afectados, citando especies como Bufotes baliaricus (Calàpet), Burhinus oedicneumus (Sebelino), Milvus milvus (Milán real), Galerida theklae (Cucullada), Cisticola juncidis (bolsillo).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• &lt;em&gt;El informe de evaluación estratégica simplificada describe y evalúa los posibles efectos significativos de la modificación, considerando que la modificación no tiene ninguna afección sobre la fauna y la flora de la zona.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• &lt;em&gt;Según la información disponible en el Servicio de Protección de Especies, no existe constancia de la presencia de especies catalogadas o amenazadas en la zona donde se ubica la modificación. Ni hay conola presencia de nidos de rapaces a menos de 1000 m de distancia de las parcelas afectadas por la modificación.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;• &lt;em&gt;Según el criterio del Servicio de Protección de Especies, no es de esperar que la modificación pueda suponer un efecto negativo sobre las especies catalogadas o amenazadas presentes en la zona, siempre que se lleven a cabo las medidas preventivas y correctoras propuestas, así como el Programa de vigilancia ambiental.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, informe favorablemente sobre la EP de las NNSS de Planeamiento.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Clasificación en urbano zona servicios y una parcela de equipamiento recreativos a servicios industriales T. M. Campos.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5. Análisis de los criterios del anexo V de la Ley 21/2013&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez analizados los criterios del anexo V de la Ley 21/2013 de Evaluación ambiental, no se prevé que la modificación puntual pueda tener efectos significativos sobre el medio ambiente, ya que afecta a un ámbito de reducida extensión mayoritariamente consolidado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cualquier caso, se consideran correctas las medidas ambientales incorporadas al DAE para minimizar estos impactos, que se incluirán en el plan de vigilancia ambiental así como su seguimiento ambiental. Asimismo, se tendrá en cuenta las medidas propuestas por las administraciones consultadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Conclusiones del Informe ambiental estratégico&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Primero&lt;/strong&gt;. No sujetar a evaluación ambiental estratégica ordinaria, la Modificación Puntual de las Normas Subsidiarias de planeamiento de Campos en lo referente a la clasificación como suelo urbano de una zona de servicios industriales y de equipamiento docente y cambio de calificación de una parcela de equipamiento recreativo a servicios industriales, dado que no se prevé que pueda tener efectos significativos sobre el medio ambiente, de acuerdo con los criterios del anexo V de la ley 21/2013, siempre y cuando se cumplan las medidas propuestas que figuran en el documento ambiental estratégico, y en sus anexos, redactado por MªPilar Ramírez Roig (geógrafa) firmado en fecha 29 de abril de 2024, y la memoria informativa y justificativa redactado y firmado por Antonio Ramis Ramos y Jose Maria Mayol Comas en fecha 30 de abril de 2024 y los siguientes condicionantes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. De acuerdo con el informe del Servicio de Cambio Climático y Atmósfera, el Ayuntamiento de Campos deberá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Reservar un área de suelo (o cubierta de las edificaciones) destinada a la generación de energías renovables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Desarrollar las acciones afectadas por la Modificación puntual del PACES de Campos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Incluir todas aquellas medidas adicionales mencionadas en los apartados 2 y 3 del informe del Servicio de Cambio Climático y Atmósfera: 2)Evaluación de las necesidades energéticas y el impacto derivado del consumo energético y medidas destinadas a minimizar la huella de carbono o compensar la, y 3)Vulnerabilidad ante el cambio climático y medidas destinadas a reducirla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segundo. &lt;/strong&gt;Se publicará el presente informe ambiental en el Boletín Oficial de las Islas Baleares, de acuerdo con lo que dispone el artículo 31.3 de la Ley 21/2013, de 9 de diciembre, de Evaluación Ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; El informe ambiental estratégico perderá su vigencia y cesará en la producción de los efectos que le son propios si, una vez publicado en el BOIB, no se hubiera procedido a la aprobación del plan o programa en el plazo máximo de seis años desde de la publicación, de acuerdo con lo que dispone el artículo 21 bis del Texto refundido de la Ley de evaluación ambiental de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; El informe ambiental estratégico no será objeto de ningún recurso, sin perjuicio de lo que, en su caso, proceda en vía administrativa o judicial ante el acto de aprobación del plan o programa, de acuerdo con lo dispuesto en el artículo 31.5 de la Ley 21/2013.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quinto.&lt;/strong&gt; Esta resolución se emite sin perjuicio de las competencias urbanísticas, de gestión o territoriales de las administraciones competentes y de las autorizaciones o informes necesarios para su aprobación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
