&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Hechos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El 3 de julio de 2021 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 202, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB núm. 103, de 6 de agosto de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Las personas o entidades que figuran en el Anexo de esta Propuesta presentaron una solicitud de subvención en el marco de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático han examinado las solicitudes y han emitido informe desfavorable sobre las solicitudes de subvención descritas en el anexo con la motivación que figura en este anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El 2 de octubre de 2024 se emitió la propuesta de resolución provisional del director general de Economía Circular, Transición Energética y Cambio Climático por la cual se conceden las subvenciones en el marco de la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) (BOIB n.º 132, de 8 de octubre de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En fecha 11 de octubre de 2024 JAIME LLULL RODRIGUEZ (MOVESIII-5640/2021) presentó un documento de alegaciones a la propuesta de resolución aportando el documento 4 de declaración de ayudas de mínimis, indicando que tiene concedidas dos ayudas de RED.ES, M.P. por Kit digital en fechas 09/07/2023 y 19/07/2024 Vista la documentación se comprueba que se notificó una ayuda concedida en régimen de mínimis, en fecha anterior a la declaración firmada en fecha 30/05/2024.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático, denegaron para la adquisición de un vehículo eléctrico, por el siguiente motivo: « &lt;em&gt;tiene concedidas ayudas de mínimis en fecha 09/06/2023 y declara que no tiene concedidas en el ejercicio fiscal corriente y en los dos ejercicios fiscales anteriores, firmado en fecha 30/05/2024.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En fecha 14 de octubre de 2024, los técnicos de la Dirección General de Economía Circular, Transición Energética y Cambio Climático han informado DESFAVORABLEMENTE la alegación de la solicitud de la subvención y se propone la denegación de la ayuda para la adquisición de un vehículo eléctrico Renault Megane E-TECH 100% eléctrico EV60 220 cv .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de les Illes Balears (BOIB núm. 122, de 2 de septiembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB núm. 72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Real Decreto 266/2021, de 13 de abril, por el que se aprueba la concesión directa de ayudas a las comunidades autónomas ya las ciudades de Ceuta y Melilla para la ejecución de programas de incentivos ligados a la movilidad eléctrica (MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia Europeo. (BOE núm. 89, de 14 de abril de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia Europeo -BOIB núm. 88, de 3 de julio de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 por la que se modifica y amplía el crédito de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la cual se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo financiado por la Unión Europea – NextGenerationEU –BOIB núm. 103, de 6 de agosto de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. La Resolución del consejero de Empresa, Empleo y Energía por la que se modifica la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo financiado por la Unión Europea – NextGenerationEU (BOIB núm.174, de 26 de diciembre) de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8. La Resolución del consejero de Empresa, Empleo y Energía por la que se modifica la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo financiado por la Unión Europea – NextGenerationEU (BOIB núm.100, de 30 de julio de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Propuesta de resolución definitiva&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Propongo al consejero de Empresa, Empleo y Energía que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Denegar la concesión de una subvención a los beneficiarios que figuran en el Anexo, de acuerdo con el motivo que figura en el Anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformidad con la propuesta de resolución y dictar resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Empresa, Empleo y Energía en el plazo de un mes contando desde el día siguiente al de su publicación, de acuerdo con los artículos&amp;nbsp;123 y 124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
