En fecha 6 de abril de 2023, se publica en el BOIB núm. 43, la Orden de la consejera de Agricultura, Pesca y Alimentación por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el Desarrollo Rural de las Islas Baleares 2023-2027.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">2. En fecha 15 de abril de 2023, se publica en el BOIB núm. 48, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria de las ayudas destinadas para el fomento de razas autóctonas en peligro de extinción para el año 2023 .</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">3. En fecha 30 de mayo de 2023, se publica en el BOIB nº. 71, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución de la presidenta del FOGAIBA de 27 de febrero de 2023, de convocatoria, para el año 2023, de las ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC), así como otras resoluciones de convocatoria de ayudas que prevén las intervenciones en el desarrollo rural.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">4. Con fecha 30 de junio de 2023, se han recibido un total de 299 solicitudes por la ayuda destinada para el fomento de razas autóctonas en peligro de extinción.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">5. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">6. En fecha 20 de noviembre de 2023 se notifica propuesta de resolución provisional de denegación que se publica en fecha 27 de noviembre de 2023 en la web del FOGAIBA. La denegación es el resultado de la evaluación de las solicitudes de ayuda por los órganos gestores y las certificaciones de las diferentes asociaciones gestoras del libro genealógicos y de los directores de los programas de conservación y mejora de las razas que detectaron el no cumplimiento de el apartado noveno de obligaciones y compromisos de la convocatoria en los puntos 1 c) en lo referente al mantenimiento de la condición de socio de la asociación de ganaderos que tenga por objetivo mejorar y conservar la raza y gestionar el Libro genealógico como tampoco en el punto 1 d) en lo referente a la participación en el Programa de conservación y/o mejora que establezca y apruebe la autoridad competente para cada una de las razas afectadas por la ayuda por el censo de animales de la especie equina de la raza caballo mallorquín. Se otorgaron 10 días hábiles para presentar alegaciones, período durante el cual no se presentó ninguna alegación.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">7. En fecha 7 de febrero de 2024 el vicepresidente del FOGAIBA dicta resolución de denegación de las ayudas destinadas al fomento de razas autóctonas en peligro de extinción al solicitante ADROVER BARCELO MIQUEL con número de expediente 04003904 y DNI ***2132 ** que se publicó en el BOIB núm. 25, de 20 de febrero de 2024.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">8. Posteriormente este expediente ha sido objeto de una revisión de oficio por parte de los órganos gestores y se ha detectado que, a pesar de no cumplir por la especie equina de la raza caballo mallorquín, sí cumplía los requisitos y condiciones necesarias para ser beneficiario de esta línea de ayuda por la especie ovina de la raza oveja mallorquina y un importe de 3.160 € anuales.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">9.Por todo ello, se revocará la resolución de denegación mencionada anteriormente y se procederá a conceder la ayuda correspondiente al censo de la especie ovina de la raza oveja mallorquina. </span></span></span></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">Fundamentos de derecho </span></span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">1.
