2024-11-21 es CAIB CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 19 de junio de 2023, tuvo entrada en la Dirección General de Economía Circular, Transición Energética y Cambio Climático un escrito del INSTITUTO BALEAR DE LA ENERGÍA, <span style="color:black">con NIF Q0700740D, </span>en que solicita la tramitación de la autorización administrativa, la autorización del proyecto ejecutivo y el reconocimiento de utilidad pública a efectos de la declaración de interés general.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 27 de julio de 2023, la Dirección General de Economía Circular, Transición Energética y Cambio Climático admitió a trámite la solicitud.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El 3 de octubre de 2023, se iniciaron las consultas a las administraciones y a las personas interesadas en el expediente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El 7 de octubre de 2023, se publicó en el BOIB número 137 el inicio de la información pública de la tramitación del proyecto por un plazo de treinta días.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 15 de diciembre de 2023, el Servicio Jurídico de Urbanismo del Consejo Insular de Mallorca requirió aclaración sobre el alcance del informe solicitado.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. El 19 de febrero de 2024, el Servicio de Tramitación de Licencias de Obras del Ayuntamiento de Palma emitió un informe desfavorable.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El 23 de octubre de 2024, el promotor aporta por correo electrónico el Acuerdo del Consejo de Gobierno, con fecha 31 de mayo de 2024, por el que se autoriza el proyecto de instalación de pérgolas con placas fotovoltaicas en 5 de las 6 parcelas de aparcamiento del Parc Bit.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. El 14 de noviembre de 2024, el promotor aporta por correo electrónico la autorización para el proyecto ejecutivo de la Dirección General de Recursos Hídricos (09/05/2024).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Real Decreto 1183/2020, de 29 de diciembre, de acceso y conexión a las redes de transporte y distribución de energía eléctrica.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. font-size:12px">La instalación se clasifica en el grupo b.1.1, «Instalaciones que únicamente utilizan la radiación solar como energía primaria mediante la tecnología fotovoltaica», de acuerdo con el artículo 2 del Real Decreto 413/2014, de 6 de junio, por el que se regula la actividad de producción de energía eléctrica a partir de fuentes de energía renovables, cogeneración y residuos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Aprobar el proyecto de ejecución del parque fotovoltaico, firmado el 9 de diciembre de 2022 por Albert Juan Casademont y Jordi Manich Codina, sin incluir la zona 6 de aparcamiento y sin entrar a valorar técnicamente su contenido.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Indicar que, una vez ejecutadas las instalaciones objeto de esta autorización, el titular tiene que presentar la solicitud de puesta en servicio, a la cual tiene que adjuntar un certificado de final de obra subscrito por personal técnico facultativo, así como las pruebas reglamentarias y el resto de documentación que exige la reglamentación vigente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La ejecución de estas obras está prevista en cuatro meses desde su inicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Informar de que esta autorización se concede sin perjuicio de las concesiones y autorizaciones que sean necesarias relativas a las licencias municipales, la ordenación del territorio y el medio ambiente, y a cualesquiera otras motivadas por disposiciones que sean de aplicación. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6.
