    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aprobación de la convocatoria y las bases para la selección, por turno libre, para la provisión como personal funcionario de carrera de una plaza de arquitecto/a, mediante el sistema de concurso-oposición, incluida en la oferta pública de empleo del año 2022.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por Acuerdo de la Junta de Gobierno del día 15 de Noviembre de 2024, se han aprobado la convocatoria y las bases que tienen que regir las pruebas selectivas para cubrir, mediante concurso-oposición, con carácter de personal funcionario de carrera, una (1) plaza correspondiente a la escala de Administración Especial, subescala Técnica, clase Técnico Superior, especialidad Arquitectura, del grupo A y subgrupo A1 incluida en la oferta pública de empleo del año 2022 del Ajuntament de Santa Maria del Camí, la parte dispositiva de la cual es la siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;PRIMERO.-&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Aprobar la convocatoria del proceso selectivo, mediante concurso-oposición, con carácter de personal funcionario de carrera, una (1) plaza correspondiente a la escala de Administración Especial, subescala Técnica, clase Superior, especialidad Arquitectura, del grupo A y subgrupo A1 incluida en la oferta pública de empleo del año 2022 del Ajuntament de Santa Maria del Camí.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;SEGUNDO.-&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Aprobar las bases que tienen que regir esta convocatoria, que se dan por reproducidas tal como figuran en el respectivo expediente.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;“BASES DE LA CONVOCATORIA PARA LA SELECCIÓN, POR TURNO LIBRE, PARA LA PROVISIÓN COMO PERSONAL FUNCIONARIO DE CARRERA DE UNA PLAZA DE ARQUITECTO/A, MEDIANTE EL SISTEMA DE CONCURSO OPOSICIÓN, INCLUÍDA EN LA OFERTA PÚBLICA DE OCUPACIÓN DEL AÑO 2022”&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;PRIMERA.- OBJETO DE LA CONVOCATORIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El objeto de la presente convocatoria es regular el procedimiento selectivo para cubrir en propiedad, como funcionario/a de carrera, una plaza de Arquitecto/a, adscrito en el área de Urbanismo, vacante en la plantilla municipal de este Ayuntamiento, incluida en la oferta pública de empleo del ejercicio 2022 por turno libre y mediante el sistema de Concurso-oposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En el presente caso se hace necesaria su cobertura para el desarrollo de las tareas urgentes de emisión de informes de licencias de obras, la revisión del planeamiento municipal (que data de 1988 y de 1996 su texto refundido), así como del desarrollo de obras y proyectos municipales del departamento de urbanismo de este Ayuntamiento, delante, entre otros, las crecientes demandas debidas al incremento poblacional acontecido en los últimos años (se ha pasado de los 4.000 habitantes del año 1988 y 4.400 habitantes del año 1996 a más de 7.500 en 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Esta plaza se encuentra dentro de los sectores prioritarios o que afectan el funcionamiento de los servicios públicos esenciales para la gestión eficaz de las competencias fundamentales asignadas a esta Entidad Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;SEGUNDA.- PROCEDIMIENTO SELECTIVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El sistema de selección será el de concurso-oposición, garantizando el cumplimiento de los principios de igualdad, mérito y capacidad, así como la normativa de aplicación pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;TERCERA.- REQUISITOS Y CONDICIONES DE LOS/LAS ASPIRANTES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Para tomar parte en la presente convocatoria y ser admitidos/se los/las aspirantes tendrán que reunir los requisitos siguientes en la fecha de expiración del plazo de admisión de solicitudes y mantenerlos durante todo el proceso selectivo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Nacionalidad: Poseer nacionalidad española o la de un país miembro de la Unión Europea o la de cualquier de aquellos Estados que en virtud de tratados internacionales celebrados por aquellos y ratificados por España se aplique la libre circulación de trabajadores en los términos en que esta se encuentra definida en el tratado constitutivo de la Unión Europea y en los términos que prevén los artículos 56 y 57 del TRLEBEP. Los aspirantes de nacionalidad no española tendrán que acreditar mediante declaración responsable u otro medio admitido en derecho, tener un conocimiento adecuado del idioma español, pudiendo exigirlos, si procede, la superación de pruebas con cuyo objeto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Edad: Tener cumplidos dieciséis años y no haber llegado a la edad de jubilación forzosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Titulación: Estar en posesión o en condiciones de obtenerlo dentro del plazo de presentación de instancias, del título de Arquitecto/a Superior o título de Grado en Arquitectura más el máster universitario que habilite para ejercer la profesión de Arquitecto/en Superior, de acuerdo con el Real Decreto 1393/2007, de 29 de octubre, modificado por el Real Decreto 861/2010, de 2 de julio, por el cual se establece la ordenación de la enseñanza universitaria oficial o titulación análoga equivalente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En el supuesto en que se hubiera presentado un título equivalente al exigido, se tendrá que acreditar mediante certificado expedido por el órgano competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En el casos de titulaciones obtenidas al extranjero se tendrá que estar en posesión de la credencial que acredite su homologación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) Compatibilidad Funcional: No sufrir enfermedad o defecto físico que impida el ejercicio de las correspondientes funciones propias de su Escala y Categoría.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) Habilitación: No haber sido separado o sancionado con despido procedente mediante expediente disciplinario del servicio de cualquier Administración Pública ni encontrarse inhabilidad para el ejercicio de funciones públicas por sentencia firme. Se adjuntará declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los aspirantes la nacionalidad de los cuales no sea la española tendrán que estar, igualmente, no sometidos a sanción disciplinaria a condena penal que impida, en su Estado, el acceso a la Función Pública. Se adjuntará declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;f) No encontrarse incurso en algunas de las causas de incompatibilidad previstas en la Ley 531/1984, de 26 de septiembre, de incompatibilidades del personal al servicio de las Administraciones Públicas (se tendrá que presentar declaración responsable).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;g) Acreditar el conocimiento avanzado de la lengua catalana de nivel C1 (antes C) mediante certificado homologado de la Junta Evaluadora de Català, de la Escuela Balear de Administración Pública u otro organismo reconocido a estos efectos en la legislación vigente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;h) Abonar la tasa de 10€ por los derechos de examen dentro del plazo para presentar las solicitudes, sin que pueda ser abonada en otro momento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;i) Firmar la declaración responsable relativa al cumplimiento de los requisitos de participación. Se entenderá firmada esta declaración responsable cuando se presente y finalice el proceso de inscripción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;j) Previamente al acto de la toma de posesión, la persona interesada tendrá que hacer constar la manifestación de cumplir los requisitos señalados en los apartados d), e) y f).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La acreditación del nivel C1 de catalán guarda relación objetiva y proporcionada con las funciones asumidas y las tareas a ejercer y su valoración en función del lugar que viene condicionado a la atención al público que tiene que prestar en parte de la jornada de trabajo y en la necesidad de comprender la documentación remitida por varios organismos autónomos oficiales, así como en la emisión hacia ellos desde la corporación municipal.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Para las personas que tengan la condición legal de discapacitadas que lo soliciten, el tribunal calificador tiene que establecer las adaptaciones posibles de tiempos y de medios que considere pertinentes para llevar a cabo las pruebas selectivas. Los aspirantes tienen que efectuar la petición de las adaptaciones en la solicitud de participación, y tendrán que adjuntar a la instancia el certificado del equipo multiprofesional correspondiente de la Dirección General de Atención a la Dependencia o del organismo equivalente que acredite la mencionada condición, la compatibilidad con el ejercicio de las tareas y funciones correspondientes al lugar de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Todos los requisitos a que se refiere esta Base tendrán que estar cumplidos el último día de presentación de instancias, no admitiéndose ninguna excepción respecto de esto, ni incluso en los supuestos de fuerza mayor, y disfrutar durante todo el proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El hecho de constar en la lista de personas admitidas no implica el reconocimiento a las personas interesadas que se cumplen los requisitos para participar en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;CUARTA.- FUNCIONES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) Informar y dictaminar verbalmente o por escrito de aquellos asuntos relacionados con las funciones técnicas que le son propias, especialmente en cuanto a licencias, planeamiento y obras públicas, así como otros tipos de expedientes de acuerdo con la normativa aplicable en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) Redactar la documentación técnica necesaria para proyectos y/o trabajos de su competencia técnica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Supervisar los proyectos públicos que tengan que ser objeto de tramitación por parte del Ayuntamiento, así como hacer el seguimiento, control y coordinación de las obras de los mismos cuando se determine, incluidas las obras otras Administraciones en el Término Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) Asumir las funciones de dirección y/o coordinación técnica municipal que le sean encomendadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) Informar las licencias de obras de terceros y la supervisión municipal final de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;f) Llevar a cabo valoraciones urbanísticas e inmobiliarias que le sean encomendadas por parte de la corporación municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;g) Redactar y revisar el planeamiento municipal, cualquiera que sea su ámbito y/o fase.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;h) Acompañar a las visitas que sean necesarias realizar a los varios organismos públicos y actuar en representación del Ayuntamiento cuando así se determine.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;i) Facilitar la atención al público necesaria para consultas técnicas relacionadas con las tareas asignadas en el departamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;j) Cualquier tarea encomendada por la Corporación Municipal en el ámbito de sus competencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se establece la incompatibilidad entre el servicio de Arquitecto Municipal y realizar las funciones profesionales de arquitecto con terceros en el municipio de Santa Maria del Camí.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;QUINTA.- PUBLICACIÓN DE LAS BASES Y PRESENTACIÓN DE INSTANCIAS&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;PUBLICACIÓN.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las Bases se publicarán en el B.O.I.B de conformidad al que establece el artículo 55 del Real decreto legislativo 5/2015, de 30 de octubre, por el cual se aprueba el Texto Refundido de la Ley del Estatuto Básico del Empleado Público. El resto de publicaciones se harán en la página web de la Corporación Municipal (www.ajsantamariadelcami.org).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;PRESENTACIÓN DE INSTANCIAS.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las persones aspirantes a tomar parte en esta convocatoria tendrán que declarar, a sus solicitudes y bajo su responsabilidad, que reúnen todos y cada una de los requisitos exigidos a la Base Tercera según modelo Anexo I de la presente convocatoria. Las solicitudes se dirigirán al Sr. Alcalde y se presentarán en el Registro General de este Ayuntamiento en horas de oficina o a través de la sede electrónica de este Ayuntamiento (ajsantamariadelcami.sedeelectronica.es).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes, también podrán presentarse en las formas previstas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Si se presentan en las oficinas de Correos o en el registro de otra administración, se tendrán que cumplir los siguientes requisitos:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.-La instancia deberá llevar el sello que indique la fecha de entrada en Correos o bien en el registro de otra administración.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.-Se tendrá que enviar por correo electrónico al mail ajuntament@ajsantamariadelcami.net copia de la instancia con el sello que acredite la fecha de entrega dentro del plazo de presentación de solicitudes.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.-La documentación deberá entregarse dentro del plazo de presentación de instancias.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4.-Sin la concurrencia de estos requisitos, no será admitida ninguna instancia.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.-Transcurrido no obstante, el plazo de siete días naturales desde la finalización del plazo de presentación de instancias, sin que haya llegado al registro de este Ayuntamiento la pertinente documentación, no será admitida en ningún caso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La no presentación de las solicitudes en tiempo y forma determinará la inadmisión del/de la aspirante al proceso selectivo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A la mencionada instancia (ver Anexo I) deberá acompañarse la siguiente documentación:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Fotocopia compulsada del documento nacional de identidad o, en caso de no ser español, del documento oficial acreditativo de la personalidad (NIE, pasaporte o tarjeta de residencia).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Fotocopia compulsada de la titulación o titulaciones exigidas en esta convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Copia auténtica del título exigido del nivel de catalán.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Comprobante del pago de la tasa de los derechos de examen.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el justificante de pago debe constar el nombre de la persona aspirante y el concepto debe ser "Derechos de examen plaza arquitecto/a".&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El pago deberá efectuarse en la siguiente cuenta bancaria:&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) Declaración responsable del cumplimiento del requisito de contar con las capacidades y aptitudes físicas y psíquicas que sean necesarias para el ejercicio de las funciones y de no haber sido separado ni despedido, mediante expediente disciplinario, del servicio de cualquiera de las Administraciones Públicas, ni hallarse inhabilitado para el ejercicio de funciones públicas por sentencia firme.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;f) La documentación acreditativa de los méritos que se alegan, en la forma que establece la base octava de esta convocatoria (originales o copias compulsadas). No se podrá valorar ningún mérito que no se haya acreditado con la aportación de la documentación correspondiente en el plazo de presentación de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;g) Hoja de auto-puntuación (de acuerdo con el modelo que consta en el Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La falsedad en los datos que se hagan constar en la solicitud o en la documentación anexa determina la exclusión inmediata de la persona solicitante, sin perjuicio de las medidas legales que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Con la formalización y presentación de la solicitud, los/las aspirantes dan su consentimiento al tratamiento de los datos de carácter personal que son necesarios para tomar parte en la convocatoria y para el resto de la tramitación del proceso selectivo, de acuerdo con la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;PLAZO DE PRESENTACIÓN.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El plazo para presentar solicitudes es de veinte (20) días naturales, a contar a partir del día siguiente que se haya publicado esta convocatoria en el BOE. Si el último día fuera inhábil, se prorrogará el plazo hasta el primer día hábil posterior. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Todos los demás anuncios relativos a esta convocatoria se publicarán en el tablón de anuncios de la página web de esta Corporación Municipal, sin perjuicio que se publiquen en el BOIB los actos que las bases de esta convocatoria determinen expresamente que se tengan que publicar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;SEXTA.- ADMISIÓN DE ASPIRANTES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Por el hecho de presentar las instancias solicitando tomar parte en esta convocatoria, los aspirantes se someten y aceptan expresamente sus Bases reguladoras, sin perjuicio de las responsabilidades en que pudiesen incurrir si se apreciara inexactitud fraudulenta en la declaración que formulen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Expirado el plazo de presentación de instancias y comprobada la documentación relativa a los requisitos para participar en el procedimiento que tienen que presentar las personas interesadas, la autoridad convocante dictará una resolución, declarando aprobada la Lista de Admitidos y Excluidos provisional con indicación de las causas de exclusión y concediendo un plazo de enmienda a los excluidos de cinco (5) días naturales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La lista de admitidos y excluidos contenderá también la determinación del lugar y de la fecha de valoración de los méritos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los errores, de hecho, podrán enmendarse en cualquier momento, de oficio o a petición del interesado, de conformidad con el que dispone el artículo 109 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Si no se produjera ninguna reclamación, sugerencia o petición de enmienda, la resolución provisional acontecerá definitiva automáticamente. En cualquier otro caso, resueltas las reclamaciones y enmiendas, se dará publicidad de esto mediante la llanura web del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;SÉPTIMA.- TRIBUNAL CALIFICADOR&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) El Tribunal Calificador será designado por la Alcaldía y sus miembros deberán tener titulación académica igual o superior a la exigida en la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b)&amp;nbsp;Junto con la lista provisional de admitidos y excluidos se hará público el nombre de las personas que compondrán el Tribunal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) Todos los miembros del tribunal tienen voz y voto y sus decisiones se adoptarán por mayoría simple. En caso de empate, decidirá el presidente o presidenta, que tendrá voto de calidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d)&amp;nbsp;El Tribunal no podrá constituirse ni actuar sin la asistencia de la mitad de sus miembros, sean titulares o suplentes, entre los cuales figurarán el/la presidente/a y el/la secretario o secretaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;e) Los miembros del Tribunal tendrán que abstenerse de intervenir, comunicándolo, en su caso, a la autoridad convocante, cuando concurran circunstancias previstas en el artículo 24 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público o si hubieran realizado tareas de preparación de aspirantes a pruebas selectivas en los cinco años anteriores a la publicación de la convocatoria. A la vegada y atendiendo al anterior, los aspirantes podrán recusarlos. La actuación del Tribunal se ajustará al establecido en estas bases y en la legislación que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;f)&amp;nbsp;&amp;nbsp;Si procede, el Tribunal podrá disponer la incorporación a sus trabajos de asesores especialistas para todas o para algunas pruebas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;g) El Tribunal queda autorizado para resolver dudas que se presenten y tomar los acuerdos necesarios por el buen orden del proceso selectivo en todo el que no esté previsto en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;OCTAVA.- INICIO Y DESARROLLO DEL PROCEDIMIENTO DE SELECCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El procedimiento de selección será el de concurso oposición. Por razones de eficiencia, practicidad y celeridad, las pruebas de selección se iniciarán con la fase de concurso y continuarán con la de oposición. La puntuación obtenida en la fase de concurso se aplicará únicamente a aquellos candidatos que superen la fase de oposición.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los aspirantes serán convocados para cada ejercicio en llamamiento único. Los aspirantes perderán su derecho cuando no se presenten en los lugares de celebración cuando ya se hayan iniciado las pruebas o por la inasistencia a éstas, aunque sea por causas justificadas. Los aspirantes tendrán que observar las instrucciones de los miembros de tribunal en relación al adecuado desarrollo de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Cualquier alteración en el normal desarrollo de las pruebas por parte de uno o una aspirante, quedará reflejada en el acta correspondiente, pudiendo continuar el aspirante el desarrollo del ejercicio con carácter condicional hasta tanto resuelva el Tribunal sobre el incidente.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El tribunal tiene que tomar las medidas oportunas para garantizar que los ejercicios de la fase de oposición sean corregidos sin que se conozca la identidad de las personas aspirantes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La calificación definitiva de los aspirantes estará determinada por la suma de puntos obtenida en la fase de concurso, oposición y valoración del catalán, con una puntuación máxima de 100 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Fase de Concurso&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La puntuación obtenida en esta fase únicamente será aplicable a los/las aspirantes que superen la fase de oposición y no tiene carácter eliminatorio. La puntuación máxima de esta fase será de cuarenta (40) puntos. La valoración global de esta prueba será de 0 a 40 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Todos los méritos alegados para esta fase tendrán que poseerse en el momento de presentar la instancia de admisión en las pruebas selectivas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La valoración de los méritos en esta fase de concurso se realizará de la forma siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;1.EXPERIENCIA PROFESIONAL: Máximo 35 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;a) En puestos que comporten el ejercicio de funciones similares a la de la plaza objeto de la convocatoria, ya sea como funcionario interino o de carrera, o como personal laboral al servicio de la Administración Local. Se valorará por cada mes de servicios prestados con una puntuación de 0,13 puntos, hasta un máximo de 20 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;b) En lugares que comporten el ejercicio de funciones similares a la de la plaza objeto de la convocatoria con contrato administrativo de servicios en la administración pública. Se valorará por cada mes de servicios prestados con una puntuación de 0,10 puntos, hasta un máximo de 10 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;c) En lugares que comporten el ejercicio de las funciones similares a la de la plaza objeto de la convocatoria, así como otros en el sentido más amplio del desarrollo de las tareas y atribuciones legales de la profesión de arquitecto, ámbito privado, fuera del ámbito de la Administración Pública, tanto por cuenta ajena como autónomo. Se valorará por cada mes de servicios prestados con una puntuación de 0,06 puntos, hasta un máximo de 5 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;d) En ningún caso se tendrán en cuenta las fracciones ni tampoco el tiempo trabajado con carácter de personal eventual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Para acreditar la experiencia profesional en la Administración Pública deberá aportarse original o copia compulsada o compulsada de certificación acreditativa de los servicios prestados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Para acreditar la experiencia profesional en el ámbito privado, fuera del ámbito de la Administración Pública, deberá aportarse el certificado de empresa o entidad correspondiente o bien informe de vida laboral junto con el correspondiente contrato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2.FORMACIÓN ESPECÍFICA: Máximo 4,50 puntos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Cursos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los cursos de formación, jornadas y otras acciones formativas o encuentros profesionales realizados en Organismos, Administraciones o Instituciones públicas o privadas que tengan relación con las funciones propias de la plaza de la convocatoria y/o del desarrollo de la profesión de arquitecto en el sentido amplio de sus tareas y atribuciones profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Se valorará con 0,20 puntos por cada 10 horas lectivas de cursos completos con certificado de aprovechamiento y 0,10 puntos por cada 10 horas lectivas de cursos completos con certificado de asistencia. Si solo figura su duración en días, la equivalencia será de 4 horas por día. Si figura en créditos universitarios, la equivalencia será de 10 horas por crédito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La puntuación máxima de este apartado será de 4,50 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;3.CONOCIMIENTO DE LA LENGUA CATALANA: Máximo 0'50 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Este apartado será valorado de acuerdo con el siguiente baremo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Certificado nivel C2 ............................................... ............. 0,25 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Certificado de conocimientos............................................... .. 0,25 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;de lenguaje administrativo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En el supuesto de que el aspirante acredite la posesión de más de un certificado, sólo es objeto de valoración el certificado que acredita un mayor nivel de conocimiento, excepto cuando se posea certificado de conocimientos de lenguaje administrativo, que será acumulativo al otro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Se reconocerán los certificados que se presenten incluidos en la Orden del Conseller de Educación, Cultura y Universidades, de 21 de febrero de 2013, y según el régimen temporal y de equivalencias que se establece. Los certificados se tendrán que presentar mediante documento original o copia adverada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;4.ACREDITACIÓN DE MÉRITOS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El sistema de acreditación de los méritos alegados será el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Acreditación de los servicios prestados en la Administración: Se realizará mediante certificado de los servicios prestados emitido por el órgano competente en materia de personal de la Administración donde se hubiera prestado, indicando la naturaleza jurídica de la relación, el tiempo exacto de duración y el tipo de funciones desempeñadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Acreditación de los servicios prestados en el sector privado: Se realizará mediante certificado de los servicios prestados emitido por la entidad donde se hubiera prestado, indicando su naturaleza jurídica de la relación, el tiempo exacto de la duración y el tipo de funciones ejercidas o bien mediante informe de vida laboral junto con el correspondiente contrato.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Acreditación de la formación específica: Se presentará fotocopia compulsada (o acompañada del original para el cotejo o compulsa) del diploma o documento acreditativo de la realización del curso específico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Tribunal podrá pedir a los interesados ​​las aclaraciones o, en su caso, la documentación adicional que estime oportuna, con la única finalidad de comprobar la verdad de los méritos aportados con la solicitud para participar en el proceso de selección.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Fase de Oposición&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En cualquier momento el Tribunal podrá requerir a los opositores para que acrediten su personalidad. Los candidatos tendrán que acudir proveídos del DNI-NIF o Pasaporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La fase de oposición tendrá una puntuación máxima de sesenta (60) puntos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La prueba en la fase de oposición será teórica y práctica, del tipo test. Será de carácter obligatorio y eliminatorio. Consistirá a responder por escrito un cuestionario de 60 preguntas con cuatro respuestas alternativas, de las cuales solo una es correcta, propuesto por el tribunal calificador entre el temario que figura al Anexo III de las presentes bases. El valor de cada respuesta correcta será de 1 punto. La valoración global de esta prueba será de 0 a 60 puntos y hay que obtener un mínimo de treinta y cinco (35) puntos para superarla. La duración máxima de la prueba será de una hora y media (1h30min).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Las preguntas no resueltas y las preguntas dónde figure más de una respuesta no se valorarán. Las preguntas con respuesta errónea se penalizarán con el valor del 50% de la respuesta correcta, es decir, -0'50 puntos. Para efectuar la calificación del ejercicio se aplicará el sumatorio de las preguntas correctas, no resueltas y erróneas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;NOVENA.- ORDEN DE CLASIFICACIÓN DEFINITIVA.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La calificación final del proceso selectivo venderá determinada por la resultante de la suma de las puntuaciones obtenidas por cada aspirante en las tres fases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Para los aspirantes que no consigan sumar la puntuación mínima exigida se considerará que no han superado los requerimientos mínimos de puntuación tal y como se recoge en la Base octava y, entonces, serán automáticamente descartados para la elaboración de la orden de la lista de clasificación definitiva. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Tribunal hará pública la relación final de aprobados por orden de puntuación al Tablón de anuncios de la web de la Corporación y elevará propuesta de nombramiento como Funcionario en prácticas del candidato que haya obtenido la máxima puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En caso de que se produzcan empates, se resolverán atendiendo, sucesivamente, a los siguientes criterios:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;1) Mayor puntuación en la fase de oposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;2) Mayor puntuación en el apartado de experiencia profesional de la fase de concurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;3) Ser mayor de cuarenta y cinco (45) años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Si aún así persistiera el empate, el Tribunal podrá decidir llevar a cabo una entrevista personal a los aspirantes empatados para determinar cuál será el orden definitivo en la obtención de la puntuación para la lista definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los criterios para valorar la entrevista personal serán los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Capacidad de organización y de orientación para conseguir y seguir las tareas del lugar de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Capacidad de integración en equipos de trabajo y para trabajo en equipo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Conocimiento de las tareas, programas y funciones del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Capacidad proactiva y flexibilidad del aspirante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;DÉCIMA.- RESOLUCIÓN DE LA CONVOCATORIA, PUBLICACIÓN Y PROPUESTA DE NOMBRAMIENTO.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El órgano de selección elaborará una lista definitiva general de todas las persones aspirantes aprobadas por orden de puntuación obtenida y elevará al Alcalde una propuesta de nombramiento a favor de la persona que haya obtenido mayor puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La resolución se tiene que hacer pública en el tablón de anuncios de la web del Ayuntamiento de Santa Maria del Camí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La persona aspirante que haya quedado en primer lugar tendrá que presentar, en el plazo de los diez (10) días hábiles siguientes a la exposición en el tablón de anuncios de la web, los documentos acreditativos de que reúne los requisitos establecidos en la Base tercera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Si dentro del plazo indicado, y salvo de casos de fuerza mayor, la persona aspirante propuesta no presentara la documentación o no tuviera los requisitos exigidos, no podrá ser nombrada y el órgano de selección propondrá el nombramiento a favor del aspirante siguiente según el orden de puntuación obtenido en la lista definitiva aprobada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;DÉCIMOPRIMERA.- BOLSA DE SUSTITUCIONES.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Con el resto de aspirantes que hayan superado la calificación final de la convocatoria, en cumplimiento del contenido de las Bases, se constituirá una lista de reserva a cargo de la cual se podrán efectuar nombramientos de acuerdo con el que prevé el TRLEBEP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La lista tendrá una duración máxima de dos (3) años, pudiendo extinguirse su eficacia en el caso de convocarse un nuevo proceso selectivo para la actualización de la mencionada lista en relación al mismo puesto de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;DÉCIMOSEGUNDA.- PERIODO DE PRUEBA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El aspirante nombrado Funcionario verá condicionado su acceso en la plaza a la cual se presenta a la superación de un periodo de pruebas que tendrá una duración de un (1) mes, con carácter obligatorio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;A la finalización del citado período, el aspirante deberá obtener una valoración de apto o no apto, para la que se tomará como referencia el informe que haya emitido la Comisión de Valoración designada a tal efecto y compuesta por los miembros del servicio que corresponda a la plaza. La declaración de aptitud corresponderá a la autoridad competente de la Corporación Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El aspirante que no supere el período de prueba perderá todos los derechos a su nombramiento como Funcionario de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Asimismo, en cualquier momento del período de prueba podrá ser determinada la eliminación de un aspirante por motivos disciplinarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Conforme a lo dispuesto en el Real Decreto 456/1986, de 10 de febrero, los funcionarios en prácticas precederán una retribución equivalente al sueldo y pagas extras de la plaza correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;DECIMOTERCERA.- NOMBRAMIENTO COMO FUNCIONARIO DE CARRERA Y TOMA DE POSESIÓN.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;1. Concluido y superado el período de prueba, el interesado deberá presentar una declaración en la que manifieste que no realiza actividad privada incompatible o sujeta a reconocimiento de compatibilidad. Dicha manifestación hará referencia también a las circunstancias de si se encuentra o no percibiendo pensión de jubilación, retiro u orfandad, por derechos pasivos o por cualquier régimen de seguridad social, público y obligatorio, a los efectos de lo previsto en el artículo 3.2 y disposición transitoria de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas; siendo nombrado funcionario de carrera de este Ayuntamiento, debiendo tomar posesión del cargo en el plazo máximo de cinco (05) días hábiles a partir de la fecha de notificación del nombramiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;2. El que, sin causa suficientemente justificada, no tomara posesión en dicho plazo será declarado cesante, con pérdida de todos los derechos derivados del proceso selectivo y del nombramiento conferido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;3. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En todo el no previsto en las presentes Bases, se estará al que dispone el R.D.L. 5/2015, de 30 de octubre, por el cual se aprueba el Texto Refundido de la Ley del Estatuto del Empleado público, la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, la Ley 20/2006 de 15 de diciembre, municipal y de régimen local de les Illes Balears, el R.D.L. 781/1986, de 18 de abril, por el cual se aprueba el Texto Refundido de Disposiciones Legales vigentes en materia de Régimen Local, la Ley 30/1984, de 2 de agosto, de Medidas para la Reforma de la Función Pública, el R.D. 896/1991, de 7 de junio, por el cual se establecen las reglas básicas y los programas mínimos a que tiene que ajustarse el procedimiento de selección de los funcionarios de Administración Local, el R.D. 364/1995, de 10 de marzo, por el cual se aprueba el Reglamento General de Ingreso del Personal al Servicio de la Administración del Estado y Provisión de Puestos de trabajo y Promoción Profesional de los Funcionarios Civiles de la Administración General del Estado, de aplicación supletoria en la esfera local, y el resto de disposiciones concordantes en la materia, en todo el que no se oponga al R.D.L. 5/2015 mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Lo que se hace público para conocimiento general y en cumplimiento de lo acordado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El recurso de reposición potestativo deberá presentarse en el Registro General de este Ayuntamiento o en las dependencias a que se refiere el artículo 16.4 de la Ley 39/2015, de 1 de octubre, antes mencionada, y se entenderá desestimado cuando no se haya resuelto y notificado la resolución, en el plazo de un mes, contado desde el día siguiente de su interposición, en cuyo caso quedará expedita la vía contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Si no se utiliza el recurso potestativo de reposición, se puede interponer directamente recurso contencioso administrativo, de acuerdo con el artículo 123 antes mencionado y lo que dispone la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, ante el Juzgado de lo Contencioso Administrativo o la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia, según las competencias determinadas por los artículos 8 y 10 de la Ley 29/1998, en el plazo de dos meses contados desde el día siguiente de recibir esta notificación, todo esto sin perjuicio de cualquier otro recurso o acción que se considere conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
