&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Antecedentes&lt;span style="display:none"&gt;&amp;lt;A[Plan|Plano]&amp;gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El día 1 de agosto de 2024 el director de la Fundación Mallorca Turismo aprueba la II Convocatoria de subvenciones para fomentar la movilidad sostenible de las producciones audiovisuales en Mallorca en el marco del Plan&lt;span style="display:none"&gt;&amp;lt;A[Plan|Plano]&amp;gt;&lt;/span&gt; de Recuperación, Transformación y Resiliencia, financiado por la Unión Europea -NextGenerationEU. Extracto publicado en el Boletín Oficial de las Islas Baleares núm. 103, de día 6 de agosto de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. La convocatoria se aprueba en ejecución del proyecto Green Film Shooting Plan, que forma parte del proyecto Mallorca Sustainable Hub I, el cual fue aprobado por el Estado Español para ser financiado con fondos europeos Next Generation. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Una vez publicada la convocatoria se comprueba que hay unas empresas incluidas en el epígrafe 019, “otras actividades relacionadas con el cine, el teatro y el circo”, que tienen cabida dentro de la actividad audiovisual, y que no estaba previsto dentro de la convocatoria, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; lo cual se considera adecuado ampliar los epígrafes del IAE beneficiarios en este sentido mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Como es una modificación que amplía el número de personas beneficiarias, y por motivos de transparencia y concurrencia, se considera adecuado dar un plazo de quince días hábiles más para presentar nuevas solicitudes, dado que es el plazo mínimo que establece la Ordenanza General de Subvenciones del Consejo Insular de Mallorca para la presentación de solicitudes de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5&lt;span style="display:none"&gt;&amp;lt;A[Plan|Plano]&amp;gt;&lt;/span&gt;. Informe técnico de 22 de octubre de 2024, favorable a la modificación de la Convocatoria de subvenciones para incluir el epígrafe del IAE 019 como subvencionable, y abrir un nuevo plazo para presentar solicitudes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Informe jurídico de 24 de octubre de 2024 favorable a la Resolución de modificación de la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo eso,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resuelvo&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Primero. &lt;/strong&gt;Modificar el punto 5.1 b) de la II Convocatoria de subvenciones para fomentar la movilidad sostenible de las producciones audiovisuales en Mallorca en el marco del Plan&lt;span style="display:none"&gt;&amp;lt;A[Plan|Plano]&amp;gt;&lt;/span&gt; de Recuperación, Transformación y Resiliencia, financiado por la Unión Europea -NextGenerationEU, para ampliar a los beneficiarios, en el siguiente sentido: &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;Donde dice:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5. Beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.1 Pueden ser beneficiarios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) ...&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) &lt;em&gt;Personas físicas o jurídicas dadas de alta en otros epígrafes diferentes del 961 del IAE &lt;/em&gt;(producción audiovisual) y con sede social en Mallorca, al menos un año antes de la publicación de la Convocatoria en el BOIB y, concretamente, los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 844 – Servicios de publicidad, relaciones públicas y similares&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 854.1 – Alquiler de vehículos sin conductor&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 677.9 – Otros servicios de alimentación propios de la Restauración&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Las personas físicas o jurídicas que cumplen los requisitos anteriores tienen que demostrar su relación con el sector audiovisual, como sigue:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1- Alta en una asociación profesional del sector audiovisual mallorquín, al menos un año antes de la publicación de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2- Relación de producciones audiovisuales y/o clientes a quienes ha dado servicio el último año de actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;Tiene que decir:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5. Beneficiarios&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.1 Pueden ser beneficiarios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) ...&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) &lt;em&gt;Personas físicas o jurídicas dadas de alta en otros epígrafes diferentes del 961 del IAE &lt;/em&gt;(producción audiovisual) y con sede social en Mallorca, al menos un año antes de la publicación de la Convocatoria en el BOIB y, concretamente, los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 844 – Servicios de publicidad, relaciones públicas y similares&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 854.1 – Alquiler de vehículos sin conductor&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 677,9 – Otros servicios de alimentación propios de la restauración&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Epígrafe 019 – Altas actividades relacionadas con el cine, el teatro y el circo&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;* Las personas físicas o jurídicas que cumplen los requisitos anteriores tienen que demostrar su relación con el sector audiovisual, como sigue:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;1- Alta en una asociación profesional del sector audiovisual mallorquín, al menos un año antes de la publicación de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2- Relación de producciones audiovisuales y/o clientes a quienes ha dado servicio el último año de actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Segundo&lt;/strong&gt;. Dar un plazo de presentación de nuevas solicitudes, dado que se amplían los posibles beneficiarios, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; un periodo de quince días hábiles, a contar a partir del día siguiente de la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;Publicar esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante&lt;span style="display:none"&gt;&amp;lt;A[ante|delante de]&amp;gt;&lt;/span&gt; el Consejo Ejecutivo del Consejo Insular de Mallorca, en el plazo de un mes, a partir del día siguiente de la publicación de esta Resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;, de acuerdo con el artículo 121 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas y el artículo 66.2 de la Ley 4/2022, de 28 de junio, de Consejos Insulares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra la desestimación expresa del recurso de alzada se puede interponer un recurso contencioso administrativo ante el juzgado contencioso administrativo de Palma que corresponda, en el plazo de dos meses, a partir del día siguiente de recibir la notificación de la desestimación del recurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra la desestimación por silencio del recurso de alzada, se puede interponer un recurso contencioso administrativo ante el juzgado contencioso administrativo de Palma que corresponda, en el plazo de seis meses, a partir del día siguiente de la desestimación presunta, que se produce tres meses después de interponer el recurso de alzada sin que se haya notificado la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;No obstante, se puede interponer, si es procedente, cualquier otro recurso que se considere oportuno. Todo eso de acuerdo con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, y la Ley 39/2015, mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
