&lt;p&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;1. Con fecha de 19 de diciembre de 2023 se publicó, en el Boletín Oficial de las Islas Baleares n.º 171 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), por la cual se convocan, mediante el procedimiento anticipado de gasto y para los años 2023 y 2024, subvenciones para la creación de empresas de jóvenes agricultores y agricultoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;2. De conformidad con el apartado sexto de la mencionada Resolución, el plazo de presentación de solicitudes acabó el día 29 de febrero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;3. Con fecha de 5 de octubre de 2024 se publicó, en el Boletín Oficial de las Islas Baleares n.º 131 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se modifica y se incrementan los créditos que prevé la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, mediante el procedimiento anticipado de gasto, para los años 2023 y 2024, subvenciones para la creación de empresas de jóvenes agricultores y agricultoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. Teniendo en cuenta que el crédito existente cubre la totalidad de las peticiones de esta convocatoria no hay ningún impedimento para resolver estos expedientes sin afectar el que dispone los apartados séptimo y octavo de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;5. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;6. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados al Anexo Y adjunto no cumplen con alguno de los requisitos previstos a la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados al mencionado anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;7.&amp;nbsp;&lt;span style="display:inline-block"&gt;Corresponde proponer para denegar los expedientes señalados al Anexo Y por los motivos indicados al mencionado anexo.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se modifica y se incrementan los créditos que prevé la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la cual se convocan, mediante el procedimiento anticipado de gasto, para los años 2023 y 2024, subvenciones para la creación de empresas de jóvenes agricultores y agricultoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;3. Orden 10/2023 de la consejera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la cual se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de desarrollo rural de las Islas Baleares 2023-2027, corresponde aprobar la convocatoria de estas ayudas mediante una resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="display:inline-block"&gt;4. Ley 39/2015 de 1 de octubre de régimen jurídico de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Propuesta provisional de resolución de denegación &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Por todo esto, se informa desfavorablemente y propongo al vicepresidente del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Denegar la ayuda solicitada por los interesados que figuran al Anexo I , que &lt;/span&gt;&lt;span style="color:#000000"&gt;es&lt;/span&gt;&lt;span style="color:#000000"&gt; un total de &lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt; expediente y que empieza y acaba con &lt;/span&gt;&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt;NÚRIA ANGLADA MOLL&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, relativa a la línea de ayudas «Creación de empresas de jóvenes agricultores», por no cumplir con alguno de los requisitos que se establecen a la convocatoria y que se especifican al mencionado anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados al Anexo I.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Comunicar esta propuesta provisional a los interesados, haciéndoles constar que disponen de un plazo máximo de 10 días hábiles, contadores desde la publicación a la página web del FOGAIBA de esta propuesta, para presentar alegaciones. En el caso de no hacer uso de su derecho para alegar, en el plazo indicado, o si manifiesta su decisión de no efectuar alegaciones ni aportar nuevos documentos o justificaciones, esta propuesta tendrá carácter definitivo, y se elevará al vicepresidente del FOGAIBA para que dicte la Resolución de denegación de la ayuda solicitada. &lt;/span&gt;&lt;/p&gt;
