![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Considerando las bases que rigen la concesión de ayudas a acciones para mejorar el conocimiento, la salvaguarda y la difusión del patrimonio histórico de Menorca, incluido el patrimonio cultural inmaterial, y la convocatoria correspondiente al año 2024, aprobadas por el Consejo Ejecutivo día 8 de abril de 2024 y publicadas en el BOIB núm. 58 de 2 de mayo de 2024.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que en las bases y en la convocatoria de estas ayudas se diferencian hasta 6 líneas de subvención, las cuales deben cumplir los requisitos y las condiciones específicas y las comunes sobre las acciones subvencionadas.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Visto el acuerdo del Consejo Ejecutivo de día 29 de julio de 2024, relativo a la aprobación del cambio de los instructores de la convocatoria de ayudas, que se publicó en el BOIB núm. 105 de 10 de agosto de 2024, y según el cual los instructores de las distintas líneas son los siguientes:</span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que la Comisión Evaluadora prevista en el punto 12 de las bases que rigen la convocatoria se reunió los días 2 de septiembre y 10 de octubre de 2024.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que todos los proyectos a los que se propone conceder una ayuda de las líneas 3, 4 y 5 cumplen con el requisito de que las actividades subvencionadas serán aplicadas a planes, programas, anteproyectos y proyectos de inversión o, aunque no se materialice en activos, son susceptibles de producir efectos en varios ejercicios futuros.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que una vez revisadas las solicitudes presentadas y valorados los proyectos por parte de los instructores, en las líneas 1, 3, 5 quedó sin repartir el importe de 12.504,49 € (correspondientes a capítulo 7) y en la línea 6 quedó sin repartir el importe de 20.000 € (correspondientes a capítulo 4).</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que la convocatoria de las ayudas establece que: <span style="color:#00000a">«En caso de que para una línea no se agote la consignación presupuestaria, la cantidad sobrante se asignará, </span>dentro de la misma línea presupuestaria, <span style="color:#00000a">a proyectos de otras líneas siguiendo el orden de puntuación otorgada, y </span>teniendo en cuenta todas las líneas, sin <span style="color:#00000a">que pueda superar la cantidad solicitada ni el importe máximo por solicitud establecido para la línea correspondiente.»</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que <span style="color:#00000a">el importe del remanente de la línea 6 (financiado con una partida del capítulo 4 – gasto corriente) no puede repartirse entre los proyectos del resto de líneas (financiadas con una partida del capítulo 7 – inversiones).</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que <span style="color:#00000a">el remanente de las líneas financiadas con el capítulo 7 por importe de 12.504,49 € </span>debe repartirse entre todas las solicitudes que no han recibido el importe máximo por solicitud establecido en la convocatoria (incluyendo las que ya tienen una ayuda por parte del importe solicitado).</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que al aplicar este criterio los remanentes se distribuyen entre los proyectos que tienen mayor puntuación e incrementan el importe de varias líneas de acuerdo con el siguiente cuadro:</span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que la interventora accidental ha fiscalizado favorablemente la concesión de las ayudas, mediante la firma de la propuesta de resolución del director insular.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dado que el artículo 33.2.K de la Ley 4/2022, de 28 de junio, de consejos insulares, establece como atribución de los consejeros ejecutivos resolver las convocatorias de ayudas y subvenciones.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Como titular del Departamento de Cultura, Educación, Juventud y Deportes, en ejercicio de las competencias atribuidas por el artículo 33 de la Ley 4/2022, de 28 de junio, de consejos insulares, en relación con el Decreto de presidencia núm. 227/2023 de 17 de noviembre, de extinción de un departamento y reestructuración del resto de departamentos (BOIB núm. 158 de 21 de noviembre de 2023)</span></span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Conceder y denegar las ayudas correspondientes a la convocatoria de ayudas a acciones para mejorar el conocimiento, salvaguarda y difusión del patrimonio histórico, incluido el patrimonio cultural inmaterial, de Menorca para el año 2024, de acuerdo con la información que se detalla a continuación:</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>LÍNEA 1. RESTAURACIONES DE BIENES DEL PATRIMONIO HISTÓRICO</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Primero. </strong>Conceder las ayudas que seguidamente se relacionan de acuerdo con lo que prevé la base novena, que dice que se concederá el 100 % de la cantidad solicitada a los proyectos mejor valorados (excepto si se trata de bienes de titularidad privada, en los que la ayuda otorgada no podrá superar el 75% del presupuesto total de la intervención) hasta agotar el presupuesto de esta línea de ayudas:</span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Tercero. </strong>Denegar la solicitud presentada por el Ajuntament de Sant Lluís consistente en la restauración de la carpintería del molí de Dalt por los siguientes motivos:</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Este proyecto consiste en la restauración de dos puertas y en la aplicación de un tratamiento contra la carcoma en las vigas del molino. Las dos puertas objeto de restauración, a pesar de estar integradas en un edificio histórico, no pueden considerarse parte integrante del patrimonio histórico por tratarse de elementos más recientes y no mostrar rasgos tipológicos que puedan revestirlos de un valor etnológico destacado. El tratamiento contra la carcoma de las vigas, por otra parte, debe considerarse un trabajo de mantenimiento ordinario y no forma parte del objeto de esta convocatoria de ayudas. Este tipo de tratamientos pueden ser objeto de ayuda si se integran como una actuación más dentro de un proyecto de restauración propiamente dicho, pero no de forma aislada.</span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CONSIDERACIONES GENERALES</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Las ayudas otorgadas de las diferentes líneas quedan sujetas a las siguientes condiciones y requisitos:</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Primero. </strong>Para las líneas 1 a 5, el plazo máximo para realizar la actividad subvencionada es de un año a contar desde la publicación del acuerdo de concesión de la ayuda en el <em>Butlletí Oficial de les Illes Balears </em>, y para la línea 6 la actividad subvencionada debe realizarse dentro de la primera anualidad de la convocatoria. Salvo que existan causas excepcionales que lo impidan y que el beneficiario deberá alegar por escrito. A la vista de lo anterior, el CIM podrá ampliar el plazo de realización de la actividad por un período de un mes, improrrogable, a contar a partir de la fecha de finalización del plazo para llevar a cabo la actividad.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Segundo. </strong>El importe de las ayudas de las líneas 1 a 5 se aplicará de la siguiente manera: un 50% en el capítulo 7 del programa de Patrimonio Histórico del presupuesto de 2023 y el restante 50% en una partida del capítulo 7 del programa de Patrimonio histórico del presupuesto del año 2024. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El importe de las ayudas de la línea 6 se aplicará en el capítulo 4 del programa de Política Lingüística y Patrimonio Cultural Inmaterial del presupuesto de 2023.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Tercero. </strong>En caso de que la subvención concedida sea sustancialmente inferior al importe solicitado o en caso de que no se disponga de financiación para realizar el proyecto presentado, se conceden quince días hábiles desde que el beneficiario haya recibido la notificación de la concesión por aceptar o renunciar a la ayuda concedida. </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Si no se comunica la renuncia en este plazo, se entenderá aceptado tácitamente el importe de la subvención y deberá justificarse la totalidad del presupuesto de la actividad que se presentó en la convocatoria, y no sólo el importe de la ayuda concedida.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Cuarto. </strong>Si el gasto justificado excede del importe del presupuesto solicitado, la posible desviación presupuestaria irá a cargo del beneficiario de la ayuda. Si por el contrario el gasto justificado es inferior al importe del presupuesto solicitado y subvencionado se reducirá de forma proporcional la subvención concedida.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>REMISIÓN A LA BASE DE DATOS NACIONAL DE SUBVENCIONES Y PUBLICACIÓN DEL ACUERDO</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Remitir a la Base de Datos Nacional de Subvenciones el acuerdo de resolución del expediente de concesión o denegación de las ayudas en cumplimiento del arte. 20.8 de la LGS y publicarlo en el <em>Boletín Oficial de las Illes Balears, </em>haciendo constar los cuadros con las valoraciones de los criterios objetivos que se han tenido en cuenta para su concesión y que figuran como<strong> anexo.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Contra este acuerdo – que no agota la vía administrativa – puede interponerse recurso de alzada ante el Consejo Ejecutivo en el plazo de un mes a contar desde el día siguiente a su publicación, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Dicho recurso se entenderá desestimado, si no se notifica la correspondiente resolución, cuando hayan transcurrido tres meses desde su interposición. Contra la desestimación del recurso de alzada por silencio administrativo podrá interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.</span></span></span></span></p>
