El 12 de abril de 2024, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 52, de 20 de abril de 2024, en la que figuraba una concesión a favor de los interesados ​​señalados en el anexo adjunto.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. El 9 de septiembre de 2024, con registro de entrada núm. GOIBE569603/2024, el interesado SON ARRET, SRM con NIF E07712003, presentó su desistimiento, lo que supone llevar a cabo la revocación total de la ayuda concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El 25 de septiembre de 2024, con registro de entrada núm. GOIBE618802/2024, el interesado BINIGAFULL, S.R.M. con NIF E07458359, presentó su desistimiento, lo que supone llevar a cabo la revocación total de la ayuda concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. El 09 de septiembre de 2024, con registro de entrada núm. GOIBE569603/2024, el interesado MARIA DEL MAR RAMIS VICH con NIF ***5889**, presentó su desistimiento, lo que supone llevar a cabo la revocación total de la ayuda concedida.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa y notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables».</span></span></span></p> <div dir="ltr" id="Secció4"> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas». 8. Ante todo esto, se propone realizar la revocación a causa del desistimiento de la ayuda concedida por los beneficiarios que se indican en el anexo de esta resolución.</span></span></span></p> </div> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Fundamentos de derecho</span></span></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.
