&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Mediante la Resolución de la consejera de Presidencia, Función Pública e Igualdad, de 22 de diciembre de 2022 (BOIB&amp;nbsp;número 168, de 27 de diciembre de 2022), se aprobaron la convocatoria y las bases específicas que tienen que regir el proceso de estabilización por concurso oposición para cubrir las plazas de personal funcionario de la Agencia Tributaria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. En fecha de 18 de julio de 2024 se publicó en el&amp;nbsp;BOIB&amp;nbsp;número 94, la Resolución de la consejera de Presidencia y Administraciones Públicas por la cual se aprobó la lista de aspirantes que han superado el proceso de estabilización por concurso oposición para cubrir plazas de personal funcionario del subgrupo A1, cuerpo de Control, Inspección y Administración Tributaria (escala Administración Tributaria) para la isla de Mallorca de la Agencia Tributaria de las Illes Balears y se ofrecen los puestos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. En fecha de 16 de julio de 2024 se publicó en el&amp;nbsp;BOIB&amp;nbsp;número 93, la Resolución de la consejera de Presidencia y Administraciones Públicas por la cual se aprobó la lista de aspirantes que han superado el proceso de estabilización por concurso oposición para cubrir plazas del subgrupo A2, cuerpo técnico de Inspección y Gestión Tributaria (escala de Gestión Tributaria) para la isla de Ibiza de la Agencia Tributaria de las Illes Balears y se ofrecen los puestos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. En fecha de 18 de julio de 2024 se publicó en el&amp;nbsp;BOIB&amp;nbsp;número 94, la Resolución de la consejera de Presidencia y Administraciones Públicas por la cual se aprobó la lista de aspirantes que han superado el proceso de estabilización por concurso oposición para cubrir plazas de del subgrupo C2, cuerpo auxiliar tributario para las islas de Mallorca y Menorca de la Agencia Tributaria de las Illes Balears y se ofrecen los puestos de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. Una vez que las persones aspirantes que han superado el proceso selectivo hayan presentado la solicitud y se haya comprobado el cumplimiento de los requisitos, tienen que ser nombradas personal funcionario de carrera de la Agencia Tributaria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. La Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. La Ley 3/2007, de 27 de marzo, de la Función Pública de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. El Decreto Ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en la ocupación pública de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. El Decreto 27/1994, de 11 de marzo, por el cual se aprueba el Reglamento de ingreso del personal al servicio de la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. La Resolución de la consejera de Presidencia, Función Pública e Igualdad por la cual se aprueba el proceso de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de la Agencia Tributaria de las Illes Balears (BOIB&amp;nbsp;número 168, de 27 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. La Resolución de la consejera de Presidencia y Administraciones Públicas de modificación de la Resolución de 22 de diciembre de 2022 de la consejera de Presidencia, Función Pública e Igualdad por la cual se aprueba el proceso de estabilización por el sistema de concurso oposición para cubrir las plazas de personal funcionario de la Agencia Tributaria de las Illes Balears (BOIB&amp;nbsp;número 33, de 7 de marzo de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. El Decreto 12/2023, de 10 de julio, y el Decreto 16/2023, de 20 de julio, de la presidenta de las Illes Balears, por los cuales se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears, y se establecen las competencias y la estructura orgánica básica de las consejerías de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;8. La Ley 3/2008, de 14 de abril, de creación y regulación de la Agencia Tributaria de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;9. El Convenio de colaboración &amp;nbsp;entre la Consejería de Presidencia, Función Pública e Igualdad, la Escuela Balear de Administración Pública y la Agencia Tributaria de las Illes Balears de delegación de la competencia para la convocatoria y la gestión del proceso de estabilización de este ente público (BOIB&amp;nbsp;número 116, de 3 de diciembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;10. El artículo 5.2 del anexo del Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la Escuela Balear de Administración Pública.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Por todo ello,&amp;nbsp;dicto&amp;nbsp;la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Adjudicar los puestos de trabajo, de acuerdo con lo que se indica en el anexo de esta Resolución, a las personas aspirantes que han superado el proceso de estabilización por concurso oposición de la Agencia Tributaria de las Illes Balears, después de haber presentado la documentación pertinente, de acuerdo con la petición efectuada y la puntuación obtenida en el proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Comunicar que la toma de posesión se tiene que efectuar en la Agencia Tributaria de las Illes Balears, en el plazo de tres días hábiles a contar a partir del día siguiente a la publicación de esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Antes de tomar posesión del puesto adjudicado, las personas interesadas tienen que hacer constar que no ocupan ningún puesto de trabajo ni que llevan a cabo alguna actividad en el sector público comprendida&amp;nbsp; en el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas. Si lleva a cabo alguna actividad privada, incluidas las de carácter profesional, se tiene que declarar en el plazo de diez días hábiles a contar a partir del día siguiente a la toma de posesión, para que el órgano competente acuerde la declaración de compatibilidad o incompatibilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Informar que, una vez publicado el nombramiento, para adquirir la condición de funcionario de carrera se tiene que efectuar el juramento o la promesa de acatar la Constitución, el Estatuto de Autonomía de la Comunidad Autónoma de las Illes Balears y el ordenamiento vigente y tomar posesión en el plazo reglamentario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. Declarar desistidas en la su solicitud por caducidad y excluidas del procedimiento a las personas que no han presentado el escrito de elección de los puestos de trabajo ofrecidos, por orden de preferencia, y la documentación acreditativa del cumplimiento de los requisitos, de acuerdo con la base 12 de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. Publicar esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
