&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;Por Resolución de Alcaldía en fecha 13/06/2024 se crearon los siguientes mercados anuales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;MERCADO SEMANAL DE EL TORO&lt;/strong&gt;; todos los miércoles. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;MERCADO SEMANAL DE PALMANOVA; &lt;/strong&gt;todos los domingos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;MERCADO SEMANAL DE MAGALUF;&lt;/strong&gt; todos los jueves. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo&lt;/strong&gt;.-En el apartado tercero del citado Decreto se resolvió autorizar una serie de categorías dado su interés y atractivo, conforme la previsión del artículo 17.1.h del reglamento municipal de mercados, que son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;1.- ALIMENTACIÓN. Frutas y verduras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;2.- ALIMENTACIÓN. Pan y repostería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3.- ALIMENTACIÓN. Charcutería y conservas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;4.- ALIMENTACIÓN. Frutos secos, encurtidos y golosinas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;5.- ALIMENTACIÓN. Carnes “al ast” y comidas preparadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;6.- PLANTAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;7.- PRODUCTOS ARTESANALES Y ECOLÓGICOS NO COMESTIBLES. Los productos artesanales con carta de artesano vigente otorgada por el Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;8.- TEXTIL. Ropa interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Tras la puesta en marcha de estos nuevos mercados periódicos semanales en el municipio, se ha tenido constancia del interés que ha suscitado, tanto por parte de los vendedores como de los consumidores, de ampliar la categoría de productos, añadiendo, además de la categoría ya existente de “7.- PRODUCTOS ARTESANALES Y ECOLÓGICOS NO COMESTIBLES. Los productos artesanales con carta de artesano vigente otorgada por el Consejo Insular de Mallorca”, la &lt;strong&gt;venta artesanal de productos&lt;/strong&gt;, que implica aquellos productos de artesanía confeccionados, construidos o realizados por el propio vendedor sin la existencia de la carta de artesano del Consejo Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.- &lt;/strong&gt;Consta informe jurídico de la sección de Comercio de fecha 27/09/2024. &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;VALORACIÓN JURÍDICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;El artículo 17 del Reglamento municipal, en el punto 1.h establece la posibilidad que por Alcaldía se puedan autorizar por su interés y atractivo, una serie de productos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:95%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.-&lt;/strong&gt;El artículo 88.6 de la Ley 39/2015 dispone que “la aceptación de informes o dictámenes servirá de motivación a la resolución cuando se incorporen al texto de la misma”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;Por lo expuesto, a tenor de lo dispuesto en la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local, el Reglamento de Mercados y demás legislación aplicable, en base a las competencias delegadas por Decreto de Alcaldía de fecha 12/01/2024, se dicta la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PRIMERO.- AUTORIZAR&lt;/strong&gt; para los tres mercados de nueva creación ubicados en El Toro, Magaluf y Palmanova-Son Caliu, además de las categorías ya autorizadas, una novena categoría: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. VENTA ARTESANAL DE PRODUCTOS. En esta categoría se incluyen: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Productos de artesanía creativa, que es aquella cuya creación, producción, transformación o restauración de productos estéticos con características específicas inspiradas en formas, modelos, elementos decorativos y estilos, dependen del vendedor que se encarga de su confección, construcción o realización. Dentro de esta categoría se incluye: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;a) Producto balear en su más amplia gama de artículos. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;b) Productos derivados del sector de la piel balear&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;c) Otros productos que por su interés y atractivo puedan ser autorizados por la Alcaldía. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;*Para esta nueva categoría de productos deberá presentarse junto con la solicitud fotografías y dossier descriptivo de los productos a comercializar. Para valorar su inclusión o no en los mercados, se creará una comisión de valoración, que valorará cada una de las propuestas presentadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGUNDO.- CONFIRMAR &lt;/strong&gt;las demás prescripciones de la parte dispositiva de la Resolución de Alcaldía de fecha 13/06/2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCERO.- ORDENAR &lt;/strong&gt;la publicación de la presente resolución en el tablón de anuncios municipal y en la página web municipal. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;PIE DE RECURSO. -Lo que traslado a Vd. a los efectos que procedan, significándole que, contra la presente resolución, que pone fin a la vía administrativa, cabe interponer, con carácter potestativo, recurso de reposición ante el mismo órgano que la ha dictado, de acuerdo con lo dispuesto en el art. 123 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas. El plazo para interponerlo es de un mes a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto expresamente el de reposición o se haya producido la desestimación presunta del mismo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El recurso de reposición deberá presentarse en el Registro General de este Ajuntament o en las dependencias y medios a que se refiere el art. 16.4 de la Ley 39/2015 antes citada, y se entenderá desestimado cuando no se resuelva y notifique en el plazo de un mes, a contar del día siguiente a su interposición, quedando en este caso expedita la vía contencioso-administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De no utilizar el recurso potestativo de reposición, cabe interponer directamente recurso contencioso-administrativo, conforme a lo establecido en el artículo 123 anteriormente citado, y en los artículos 45 y siguientes de la Ley 29/98, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa, ante los Juzgados de lo Contencioso-Administrativo de los de Palma de Mallorca en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la presente notificación. Ello sin perjuicio de cualquier otro recurso o acción que se estime pertinente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
